06:05:03 >>CHARLIE MIRANDA: City Council is called to order.

06:05:05 Roll call.

06:05:10 >>YVONNE CAPIN: Present.

06:05:13 >>HARRY COHEN: Here.

06:05:14 >>CHARLIE MIRANDA: Here.

06:05:16 >> Here.

06:05:19 >> I understand there are some items that will not be heard

06:05:22 this evening.

06:05:23 One is number 4.

06:05:24 Does the city have any others? And 7.

06:05:26 Are we sure of that, sir?

06:05:36 Let me ask council members to open 1 through 8.

06:05:39 Motion by Ms. Capin, second by Mr. Reddick.

06:05:42 All in favor?

06:05:43 The Ayes have it unanimously.

06:05:47 Mr. Cohen?

06:05:48 >> Yes, Mr. Chair.

06:05:52 I need to recuse myself from items number 1, 2 and 3

06:05:56 tonight.

06:05:57 My father and my uncle own the building that is directly

06:06:00 adjacent to the property in question, and they run a

06:06:03 business from there, and I have filed the necessary

06:06:09 paperwork with the clerk.

06:06:10 >> And Mr. Cohen, you completed the conflict form, and I

06:06:14 find filed them with the clerk, and you will be abstaining.

06:06:21 >>CHARLIE MIRANDA: Thank you very much, Mr. Cohen.

06:06:21 >>ABBYE FEELEY: Land Development Coordination.

06:06:25 Item number 4, there was a written request for continuance

06:06:28 to June 14th for that item.

06:06:31 Did you already continue that?

06:06:32 I'm sorry.

06:06:40 I have not but anyone here on item number 4? I see none.

06:06:44 >> Move to continue to June 14.

06:06:47 >> I have a motion to continue to June 14th, second bid

06:06:50 Mr. Cohen.

06:06:51 All in favor of the motion please indicate by saying Aye.

06:06:54 Opposed nay.

06:06:55 The ayes have it unanimously.

06:06:56 >>ABBYE FEELEY: Also, item number 7, staff is here this

06:07:01 evening.

06:07:01 We are going to request a continuance on that.

06:07:04 The application actually needs to be changed from a

06:07:07 Euclidean request to a site plan control for a PD.

06:07:11 So staff would request this evening that that case be

06:07:13 continued to June 14th, and that the request be modified

06:07:17 to be RO 1 to PD.

06:07:21 >>CHARLIE MIRANDA: Anyone in the audience this evening come

06:07:23 to speak to item number 7? I see no one.

06:07:27 I need a motion from council to that effect for June

06:07:29 14th.

06:07:30 >> Move to continue to June 14.

06:07:32 >> Second.

06:07:33 >>CHARLIE MIRANDA: Motion by Mr. Cohen.

06:07:35 I have a second by Mrs. Mulhern.

06:07:36 Further discussion by council members?

06:07:41 All in favor of the motion?

06:07:43 The ayes have it.

06:07:44 At 6 p.m. on the 14th.

06:07:50 Item number 1.

06:07:51 >>ABBYE FEELEY: Land development.

06:08:38 Council, items number 1 and 2, a rezoning request with a

06:08:43 vacating associated with it.

06:08:48 Mr. Cook is here this evening to discuss the vacating with

06:08:50 you.

06:08:51 And I will discuss the rezoning and he will discuss the comp

06:08:59 plan portion.

06:08:59 I want to send the request to you and show you what we are

06:09:02 talking about in relationship to each other.

06:09:09 The rezoning request before you this evening is for

06:09:12 multifamily residential, and the vacating is here in the

06:09:26 middle, from Oregon to north Rome, in order to allow for the

06:09:29 project to function as one zoning.

06:09:32 The applicant will talk to.

06:09:34 That I just want to show you that we are talking about the

06:09:36 area in yellow with the vacating through the property along

06:09:39 the way.

06:09:58 >>TONY GARCIA: Planning Commission staff.

06:09:59 I have been sworn in.

06:10:00 >> I don't believe you have sworn the witnesses.

06:10:10 >>CHARLIE MIRANDA: I have not.

06:10:15 The clerk will swear anyone who is going speak on items 1

06:10:19 through 8 omitting 4 and 7.

06:10:21 If you are going speak, stand up. If you think you are

06:10:24 going speak, stand up.

06:10:25 If you think you aren't going to speak, still stand up.

06:10:29 [ Laughter ]

06:10:29 (Oath administered by Clerk).

06:10:37 >>TONY GARCIA: Thank you.

06:10:39 For the record, Tony Garcia, Planning Commission staff.

06:10:42 I have now officially been sworn in, Mr. Shelby.

06:10:46 I am going to give you a summary, very briefly, just -- with

06:10:52 the planning zone, because I have another function I have to

06:10:56 attend, but the cases are really to the Planning

06:11:01 Commission's finding of consistency.

06:11:03 We have found all five cases that will be before you this

06:11:05 evening consistent.

06:11:06 Also, five cases that will be before you this evening are

06:11:08 located within the central planning district, 50th

06:11:12 street, one located in the Seminole Heights area, two

06:11:14 located in the west bend area to the southeast of historic

06:11:19 neighborhood of West Tampa, and of course one in the SoHo

06:11:22 area.

06:11:22 Planning Commission staff found all these requests before

06:11:25 you this evening consistent with the comprehensive plan.

06:11:28 >>CHARLIE MIRANDA: When you say five, I think there's six

06:11:30 left so you lump two of them together?

06:11:33 >> Well, we do not speak on the vacating.

06:11:35 >> All right, thank you.

06:11:40 >>TONY GARCIA: Thank you, sir.

06:11:51 >>JAMES COOK: Land Development Coordination.

06:11:52 I have been sworn.

06:11:53 As Abbye stated I am here on item number 1, in conjunction

06:11:57 with the zoning contingent upon zoning getting Approved. It

06:12:10 runs from Oregon to Rome Avenue.

06:12:14 The petitioner owns property Gray Street, Rome, an improved

06:12:25 right-of-way. This is a photo looking east.

06:12:29 A picture, property on the south part.

06:12:35 Picture of Gray looking west from Oregon Avenue.

06:12:40 There's a couple pictures of the petitioner's property, Gray

06:12:46 Street.

06:12:54 This is -- this owner right here, on this corner, the

06:13:02 property line here.

06:13:03 My understanding is that the petitioner, this property

06:13:06 owner -- the property on the corner here, the structure

06:13:18 right there, and he believes

06:13:28 Ms. Feeley will probably touch on this in the zoning.

06:13:31 The proposed parking lot.

06:13:33 A portion of Gray.

06:13:35 Transportation and solid waste is requesting that a

06:13:37 transportation easement be reserved on this portion right

06:13:40 here, perhaps in the dumpster right here.

06:13:43 Petitioner has agreed to conditions as reflected by solid

06:13:47 works, solid waste, wastewater, water.

06:13:49 Staff has no objections as long as the drainage and

06:13:51 utilities have been reserved.

06:13:53 >>ABBYE FEELEY: Land Development Coordination.

06:14:12 The request for rezoning this evening that's before you is

06:14:15 from IG industrial general, PD planned development and PD

06:14:21 planned development alternative to PD planned development

06:14:24 for residential multifamily.

06:14:25 It is to construct 311 multifamily residential units.

06:14:33 With surface parking.

06:14:34 If I can just give you a little bit of history on this

06:14:37 property, I'm not sure that any of you on council, when we

06:14:44 rezoned this back in '06.

06:14:46 It was -- this was what we refer to as west end phases one

06:14:51 and two.

06:14:53 It spans several blocks, and constructed today from town

06:14:59 home Tierra, done PDA so those lots could be development

06:15:05 independently.

06:15:06 The properties to the south and including was PD planned

06:15:11 development, not reflected on phase two.

06:15:13 That was a 2007 rezoning.

06:15:16 What this request buff tonight is doing is pulling these

06:15:19 blocks out of both of those projects and creating its own

06:15:23 new PD, planned development, so that site plan for the

06:15:30 project they are requesting 311 units, and I will go through

06:15:34 the waivers that are being requested this evening, as well

06:15:37 as the planned specifications.

06:15:46 Sometimes you will see me show you what was previously

06:15:50 approved as far as these projects, and then what is being

06:15:53 proposed today.

06:15:54 I did not do that in this report because the waivers that

06:15:58 were granted on both of those were really independent to the

06:16:00 projects that went on, and I do have both plans here, for a

06:16:06 point of reference if you wanted to know what went there,

06:16:08 but I really treated this as a new independent application.

06:16:11 >>MARY MULHERN: Was there a request for vacancy on that

06:16:15 one?

06:16:17 >>ABBYE FEELEY: No, there was not.

06:16:19 Everything was structured parking on those projects.

06:16:23 What we refer to mostly as that have the drives around the

06:16:30 units is out there.

06:16:33 So there was not any surface.

06:16:41 The property is mostly vacant.

06:16:43 There are some industrial uses.

06:16:44 I can show you some pictures of Rome.

06:16:49 Some of them, it's really hard to put into perspective.

06:16:52 The character of the area is more of a transitional type of

06:17:02 area.

06:17:02 Let me put up the zoning atlas.

06:17:06 As I first that west end phase one went all the way from

06:17:09 cypress down to the south side of Carmen, and that PD phase

06:17:15 two picked up and then came over as far west as Fremont and

06:17:21 went down a little bit further.

06:17:31 What I did in my photos is I started here at the corner of

06:17:35 Cass and Oregon, and I kind of went down and around, came

06:17:39 down Fig, went back up.

06:17:40 I had some shots looking both ways.

06:17:43 Most of it, as I said, of course, is vacant.

06:17:48 So It's a little bit difficult.

06:17:52 There are industrial and commercial uses along Oregon.

06:17:57 This is our way down Oregon.

06:18:02 Very industrial-type buildings.

06:18:05 A lot of gated parking.

06:18:11 Oregon looking west.

06:18:16 This is on Fig looking back east.

06:18:21 This is down at this corner here, the corner of Fig and

06:18:28 Rome, southeast corner of Fig and Rome.

06:18:31 This is working our way back up Rome. This is the west side

06:18:34 of Rome.

06:18:35 The southwest corner of Rome and Fig.

06:18:37 Still moving up Rome looking west.

06:18:43 Along Rome.

06:18:48 A restaurant.

06:18:52 This is about, right in here looking north of Rome Avenue.

06:18:59 There is a stop sign, a crossing right there.

06:19:01 This is the vintage lot.

06:19:10 They span most of that lot.

06:19:12 To the north, here is a little further back picture.

06:19:17 This is the one building that is left on Rome, Carmen and

06:19:24 Gray.

06:19:26 Item number 3 tonight is another piece that's immediately

06:19:29 adjacent to this.

06:19:32 So this is looking south.

06:19:42 You can see most of it is vacant.

06:19:49 This is on Carmen looking west towards Rome, that green and

06:19:53 white building I just showed you, with the little

06:19:55 restaurant.

06:19:57 This is back down here looking back up toward the building.

06:20:12 I think that gives you a little flavor for where we are.

06:20:24 There are eight waivers that are being requested tonight

06:20:29 with this project.

06:20:31 The first is to reduce the vehicle use area green space

06:20:34 requirement from 20% to 11.5%, totaling 11,763 square feet.

06:20:42 The second is to reduce the required multifamily green space

06:20:45 from 350 square feet to 108.5 square feet a unit for a total

06:20:52 47,348.

06:20:55 Square feet.

06:20:56 The third is to reduce the vehicle use area buffer from

06:20:59 three foot to zero foot, so that portion as shown on the

06:21:02 plans to the northwest, building number 3.

06:21:08 The fourth is to 2005 required 50% tree retention to allow

06:21:12 for 100 percent tree removal with exclusion of the grand oak

06:21:16 on the northern block which is shown to be retained.

06:21:19 To reduce the required number of parking spaces from 548

06:21:23 spaces to 388 spaces.

06:21:27 The sixth is to allow tandem parking where the garages are,

06:21:31 and where adequate drive aisle space is provided.

06:21:35 You would have a single car garage with surface outside of

06:21:41 the garage.

06:21:42 The reduced drive aisles from 26 feet to 24 feet and the

06:21:47 request is to reduce the loading berth from three to zero.

06:21:51 As I stated, the 7.63-acre site was previously rezoned at

06:21:57 phases one and two.

06:21:59 It is before you this evening for a request for 311

06:22:01 multifamily dwelling units within -- this would be contained

06:22:06 within seven three-story buildings with surface and some

06:22:10 garage parking.

06:22:12 The proposed building setbacks are zero feet and the maximum

06:22:15 building height is proposed at 55 feet with allowed

06:22:20 encroachment. The required amount of parking is 548 spaces

06:22:23 and 388 spaces are being provided with a waiver being

06:22:26 requested for the deficit.

06:22:28 The property is located within the West Tampa overlay

06:22:31 district, and there are no waivers being requested for that

06:22:34 this evening.

06:22:35 The site has committed to comply.

06:22:38 On pages 4, 5, 6 and 7 of my report, you will see that there

06:22:46 are modifications that need to be made in between first and

06:22:50 second reading.

06:22:51 I have been in discussions with the applicant concerning the

06:22:54 revisions, and they are amenable to make them in between

06:22:59 first and second reading.

06:23:02 Also, furthermore, the remaining pages might have report go

06:23:08 through the PD plan criteria. A little bit different of

06:23:15 configuration. They did have some retail use as well.

06:23:18 There's no retail being proposed this evening.

06:23:20 This is strictly a residential project. I did find it

06:23:24 consistent with the PD criteria. I also provided with you

06:23:26 the waiver criteria on page 9 of your report and some goals,

06:23:30 objectives and policies in the comprehensive plan on page

06:23:32 10.

06:23:35 Lastly, transportation here this evening.

06:23:39 There is a 29% parking waiver being requested on the site

06:23:43 plan, in association with the vacating, and in association

06:23:49 with the applicant's request.

06:23:51 There have been some discussions with city staff as far as

06:23:54 providing some on-street parking.

06:23:56 There are notations on the site plan that speak to that

06:23:59 on-street parking, and that it is conceptual in nature.

06:24:03 If this property were entitled the applicant would have the

06:24:05 opportunity to go through the right-of-way permitting

06:24:07 process to configure those spaces, review and approval of

06:24:12 the city.

06:24:13 So they are not out there today.

06:24:15 That would be something that would happen afterwards.

06:24:18 As you well know, what we have -- when we have on-street

06:24:22 parking that cannot be counted as parking for the project so

06:24:26 that is not contained in the parking calculations, and that

06:24:30 is why the waiver, we always take care of the waiver as if

06:24:35 those do not exist. So that is partially why the waiver is

06:24:38 down to the 388 in order to identify what is currently

06:24:41 proposed on the property without any right-of-way parking.

06:24:46 That being said, staff is available for any questions.

06:24:53 >>CHARLIE MIRANDA: Any questions by council members at this

06:24:55 time?

06:24:56 Ms. Mulhern?

06:24:57 >>MARY MULHERN: Yes.

06:24:58 Ms. Feeley, I just had one question, because the zoning

06:25:05 atlas and the photo we have don't go very far east.

06:25:11 It looks like I think Gray Street dead-ends at Willow.

06:25:15 Is that right?

06:25:22 To the east as you go --

06:25:26 >> Yes, you're right, I'm sorry, and then drops off.

06:25:31 >>MARY MULHERN: And then as you go west --

06:25:35 >> It goes three miles all the way to Westshore.

06:25:38 >>MARY MULHERN: It goes to Westshore.

06:25:40 Okay.

06:25:41 Thank you.

06:25:41 >>> Good evening, Mr. Chairman, council members.

06:25:51 My name is David Mechanik, 305 South Boulevard, Tampa,

06:25:54 Florida.

06:25:55 I'm here on behalf of polly shores partners, the applicant

06:26:01 for the three requests you have before you this evening.

06:26:05 At this time, I would like to introduce Mr. Anthony Everett,

06:26:10 with Pollack Shore partners, and he will provide you with an

06:26:17 overview of the project and then I will get back up and

06:26:19 speak about some of the technical issues regarding the

06:26:21 application.

06:26:22 >> What I would like to do is pass out a printed version of

06:26:29 the PowerPoint that Mr. Everett is presenting to council.

06:26:32 >> I'm Anthony Everett, 5000 Bayshore Boulevard, Tampa,

06:26:48 Florida.

06:26:49 First I would like to speak to the prior petition for a

06:26:52 second about the vacating.

06:26:53 We normally would not have a request to vacate.

06:26:56 We normally try to build within the block grids that we

06:26:59 have, and it's for us to maintain the block grids, but in

06:27:03 this area the blocks are so narrow that we cannot get a

06:27:07 configuration that is feasible to build, and I think when

06:27:10 you see the surrounding PDs that were done on this, that

06:27:15 he were done at a time when people were not really being

06:27:18 realistic about development.

06:27:22 It's a very aggressive project, it struggled significantly

06:27:25 financially for many years, and would you not be able to

06:27:28 build that same project today.

06:27:29 And so again normally we would not want to try to vacate a

06:27:34 block that we could not configure out configuration that

06:27:37 made any sense from an economic standpoint without having

06:27:40 surface parking and without vacating streets. Anyway, let

06:27:44 me tell you a little about us.

06:27:45 Pollack Shores is an Atlanta based company, was formed in

06:27:51 2006 by a group of multifamily executives who collectively

06:27:55 had more than 100 years of multifamily experience.

06:27:57 Group has been involved in development of multifamily and

06:28:01 management of more than 60,000 units.

06:28:03 And I personally have been involved in developing over

06:28:06 20,000 units in the State of Florida.

06:28:09 Our current portfolio is about 3,000 units and these

06:28:14 properties are located in Atlanta, Nashville, Orlando,

06:28:16 Tampa.

06:28:17 Currently have two properties in Tampa.

06:28:18 We would like to expand in Tampa, if we can find the

06:28:22 opportunity to do so.

06:28:24 Many of you do not know me but I'm a long-time Tampa

06:28:27 residents.

06:28:27 My great grandparents settled in Ybor City, in the late

06:28:32 1800s.

06:28:33 We have been here and tried to be a part of this community

06:28:36 for many years.

06:28:37 We always try to promote Tampa in our neighborhoods and I

06:28:40 have always built quality projects, and this project will

06:28:43 keep to that standard.

06:28:44 I think if you go out and look at any of the projects I have

06:28:47 been involved with, we have always tried to maintain a high

06:28:49 level of standard with landscaping and quality materials

06:28:54 that are first class.

06:28:56 And I think you will be very proud to see what we plan to

06:28:58 propose on the site.

06:28:59 In looking at the neighborhoods, we try to Councilwoman a

06:29:02 project, we fit into the character of the neighborhood, and

06:29:06 AP warehouse district so you can see our elevation.

06:29:08 Some of them are multi-unit in design.

06:29:13 And we try to use standards and traditional development

06:29:16 standards which the city is, I guess, planning to embrace

06:29:18 for this west end area and we think that's a great plan for

06:29:23 the city to try to master plan this area, being so close to

06:29:27 downtown, we think it's a scenario that can really help the

06:29:32 engine of growth for Tampa's downtown, and having more

06:29:35 housing close to downtown would be a great thing.

06:29:39 You look at our site plan.

06:29:40 We have a series of buildings that are built around the

06:29:44 parking.

06:29:45 The overlay district requires to us shield the parking with

06:29:47 the buildings, and we do that.

06:29:49 We have three story buildings in our north block.

06:29:52 We actually have only half of this block.

06:29:54 And on this part of this block we plan a linear park.

06:29:58 That linear park will remain open forth to the public.

06:30:03 The developer made a commitment total neighbors to keep the

06:30:05 park opened, and the neighbors have got asked me to make a

06:30:12 commitment, to leave that park open, and we are willing to

06:30:15 do.

06:30:16 In a we end up with security issues we are going to work

06:30:18 with our neighbors to try to figure out ways to address the

06:30:20 security issues.

06:30:21 We are going to join the neighborhood watch, be part of the

06:30:23 North Hyde Park association, and we are going to do what we

06:30:26 can to try to help the neighborhood.

06:30:28 This parcel is Mr. Saavedra's warehouse.

06:30:35 We do have a lot right here that's going to be the subject

06:30:37 of the next rezoning petition.

06:30:39 And as part of our plan, we are going to improve that lot

06:30:43 for Mr. Saavedra.

06:30:49 We have joint access for Gray Street and we are going to

06:30:52 make, and additional landscaping around this property.

06:31:03 One of the challenges we face is just not high enough to

06:31:09 justify the parking garage nor the building of a building

06:31:14 that's higher than four stories.

06:31:15 And that's really why we ended up having to ask for the

06:31:18 parking waivers, because we needed to do a surface park

06:31:21 project.

06:31:23 We wanted to incorporate ULI standards and having a walkable

06:31:27 community that had streetscapes, and great public access,

06:31:30 you know, to our project.

06:31:32 So some of our units have Brookstone type stoops -- I'm

06:31:39 sorry, Brown stone type stoops that access directly to the

06:31:42 street from the unit.

06:31:43 We plan a streetscape that would have -- there's no lighting

06:31:47 out there right now so we would plan streetlights much like

06:31:50 you see in southern Hyde Park.

06:31:53 Two of the challenges we face are really the parking code

06:31:56 and green space code.

06:31:57 We agree adequate parking is very necessary, and in most

06:32:02 multifamily urban in-fill projects, a parking ratio of one

06:32:06 parking space per bedroom is what you would strive to

06:32:10 achieve.

06:32:11 While we don't have all of our parking on-site we do have

06:32:15 currently 93 spaces planned for the street, and we do have

06:32:20 preliminary agreement William city staff to do, once we get

06:32:24 our permit, to do a maintenance and use agreement that will

06:32:27 allow us to maintain that parking to build and maintain at

06:32:30 our cost, and to have that parking available to the public

06:32:33 for as long as our project is there.

06:32:35 Now, we know we cannot count that parking towards our

06:32:38 requirement, but we want to you please consider mitigating

06:32:40 factor, and we believe that that will be great guest

06:32:45 parking, that we have adequate parking for our residents.

06:32:47 The green space requirement is a requirement, 350 square

06:32:53 feet per unit, really a requirement that we see in a

06:32:55 locality of suburban areas.

06:32:57 You know, when you are developing in urban areas it's very

06:32:59 difficult to find enough land, 3 -- 350 square feet per unit

06:33:05 in green space.

06:33:06 And in other municipalities, they actually count hardscape

06:33:11 toward the green space open requirement, and that's to

06:33:13 encourage court yards like we have, you know, maybe

06:33:17 sculpture or public art work, different things than just

06:33:21 open green lawns, and so the request for the green space

06:33:26 waiver was because we were not able to meet the 350 square

06:33:29 feet per unit.

06:33:30 We believe we are going to have a very high quality project

06:33:32 with lots of urban green space, and as much as we could

06:33:36 possibly have, we won't meet the amount indicated --

06:33:40 actually, we'll see the amount indicated in the waiver as

06:33:43 much as we can.

06:33:45 Anyway, I would like to try to run you through some of our

06:33:49 elevations here.

06:33:51 If we go to the PowerPoint presentation.

06:33:55 So this is looking down from the corner -- let's see, that's

06:34:03 the corner of Carmen and Rome looking east.

06:34:07 On the top.

06:34:08 On the bottom, that is our leasing -- I'm sorry, that's

06:34:15 looking back to the south towards Rome.

06:34:19 Here is the aerial view of the projects.

06:34:24 The corner down at the bottom of the picture is our leagues

06:34:27 office.

06:34:28 That's a four-story building.

06:34:30 And the building directly to the east of that, to the right,

06:34:32 is a three-story townhouse building.

06:34:36 The next building is a three-story townhouse building.

06:34:38 The next donut, if you will, is a three story building.

06:34:42 And then the buildings on the north block are three stories.

06:34:46 It's just another view of the project looking to the

06:34:50 southeast from Rome.

06:34:57 Some of our buildings are under garages, and in behind some

06:35:02 of those garages we do have an area where we can do some

06:35:05 tandem parking if you allow it, and what we have done in the

06:35:08 past and we have committed to the city, we didn't

06:35:11 actually -- it wasn't made a requirement of our petitions,

06:35:15 but we are willing to commit to a restriction.

06:35:21 If the parking behind the garage can only be used by the

06:35:25 person who leases that garage.

06:35:28 And we put up signs for that, and we found in other projects

06:35:32 that we have done the tandem parking on Harbor Island and

06:35:36 other places that we need to lease that -- that tandem space

06:35:40 needs to be used by the person who is leasing the garage

06:35:42 because obviously if somebody parks behind it they can't get

06:35:44 out.

06:35:46 We also have a restriction that the garage must be used for

06:35:49 vehicular parking only.

06:35:51 And so it can't be used for storage.

06:35:53 And we have storage, you know, closets on-site that we do

06:35:58 lease to our residents for them to use for storage.

06:36:01 So we have a prohibition for storage.

06:36:05 Just another elevation building.

06:36:07 That shows you a couple of the stoops we have on the upper

06:36:10 level.

06:36:11 This is the three-story building, looking down, on the top

06:36:15 it's looking down on the Carmen side and this linear park

06:36:20 that I was talking about across the street will look

06:36:22 directly into this opening.

06:36:23 So from the linear park on Carmen street you will be able to

06:36:27 see all the way through that courtyard, and there will be a

06:36:30 fountain in there, and it will be very nice.

06:36:34 And we are trying to build a community that even though does

06:36:38 have security, and is secure for our residents, that feels

06:36:42 open and works well with the neighborhood.

06:36:46 Just another rendering in that same building.

06:36:49 This is the four-story building on the corner of Rome and

06:36:54 Fig.

06:36:54 The upper level is the corner of Rome and Fig.

06:36:57 And then this is the -- coming down Fig Street.

06:37:03 Inside of it is where the leagues office was located.

06:37:06 In the middle we have another pass through into the

06:37:09 courtyard so you would be able to see in the courtyard on

06:37:13 the Fig side also.

06:37:14 These are townhouse buildings.

06:37:16 On the street side is the elevation down below.

06:37:18 And on the backside in the garage is the elevation.

06:37:23 Just another elevation of that building.

06:37:25 And then this is that same elevation along Carmen.

06:37:32 In clogs we believe we are building a high quality project

06:37:34 that's going to fit well within the neighborhood.

06:37:36 Yes, we have some challenges, and we do need some waivers

06:37:40 from the city.

06:37:40 But normally, developing in a neighborhood like this, that

06:37:44 has had some economic challenges, people need public

06:37:47 assistance, and public financing to be able to do this.

06:37:50 And we are funding this completely privately.

06:37:54 We just need a little help from the city on allowing us to

06:37:57 build that street parking, and to be able to put that

06:38:01 additional parking in the neighborhood.

06:38:04 I appreciate your time tonight.

06:38:05 I hope you will give us favorable consideration.

06:38:08 And I hope to bring David Mechanik up to answer any other

06:38:11 questions.

06:38:14 >>CHARLIE MIRANDA: Any questions at this time by council

06:38:16 members?

06:38:17 Ms. Capin?

06:38:19 >>YVONNE CAPIN: I was looking at this -- I guess it would be

06:38:22 the same photo, this one here.

06:38:28 I see the existing build thawing referred to that Mr.

06:38:31 Saavedra, and you said that there was an agreement with him,

06:38:39 with the owner of this property for access?

06:38:43 Tell me again?

06:38:44 >> Yes, there is an agreement for access for Gray Street, if

06:38:49 Gray Street is vacated.

06:38:51 We would both use Gray Street for access for us.

06:38:53 It would be accession for removal of our trash exactors,

06:38:57 access to the back of this property.

06:39:02 And actually we provided a copy of it.

06:39:06 >>YVONNE CAPIN: And the lineal park that you referred to,

06:39:08 how wide is that?

06:39:12 >> It's about 55 feet wide.

06:39:15 There's actually a Tampa Electric company easement along the

06:39:18 back edge of it.

06:39:20 There's a 5-foot strip that you can't build on.

06:39:24 But that's going to be -- really it's a linear park.

06:39:28 So we are going to try to build it with impervious sidewalk

06:39:32 coming through it, and then landscaping on both sides.

06:39:37 >>YVONNE CAPIN: This is your property on the other side of

06:39:39 the linear park?

06:39:41 >> This is not.

06:39:45 This is architect taking --

06:39:49 >>YVONNE CAPIN: I remember the -- okay.

06:39:54 >> Yeah, there was a restaurant there, and then there's an

06:39:57 electrician there.

06:39:59 And we actually contacted them to try to see if we could

06:40:02 include them in our project, and they were not interested.

06:40:05 >> Well, because you showed the building in the front of Mr.

06:40:10 Saavedra.

06:40:12 I wondered why the building here in this corner was not

06:40:15 shown.

06:40:16 It threw me off a little bit.

06:40:18 And when you say the garage, you have the garage.

06:40:21 I see the garage is here.

06:40:23 And the tandem parking, so they can they can park right

06:40:28 behind the garage --

06:40:29 >> Not that area.

06:40:30 >> Not in this area?

06:40:32 >> There are only four areas on the site with tandem

06:40:37 parking, and certainly where there's not enough room for the

06:40:40 tandem parking behind, we would not propose to do it.

06:40:42 And we have actually talked to -- some of these spaces will

06:40:50 not work and some of them will.

06:40:51 If we are allowed to get into permitting, we will work out

06:40:54 those issues and make sure that each of those tandems is

06:40:57 technically correct.

06:40:58 >> How many units again?

06:41:00 >> It's 311 units.

06:41:01 And actually it's less units per acre than what was entitled

06:41:06 on the property -- well, the density was higher on the

06:41:11 parcels that we are zoned for.

06:41:13 We are about 41 units per acre. I don't remember what the

06:41:16 density was before.

06:41:18 In the mid 40s or low 40. 44, think.

06:41:23 >>YVONNE CAPIN: The density is lower, but there's a lot of

06:41:25 surface parking here.

06:41:27 There is a lot of surface parking.

06:41:29 >> And that's, unfortunately, when we get into an area where

06:41:33 we can't make a parking garage work, this is the only thing

06:41:39 we can do.

06:41:40 >>YVONNE CAPIN: Thank you.

06:41:43 Thank you for straightening that out for me.

06:41:45 >>CHARLIE MIRANDA: Any other questions by council members?

06:41:47 Mr. Mechanik?

06:41:54 >>DAVID MECHANIK: I have been sworn.

06:41:55 Just a couple of housekeeping items.

06:41:57 I just wanted to state for the record that all. Changes to

06:42:00 the site plans that Abbye has indicated in her report, we do

06:42:05 agree to, and we intend to make those changes between first

06:42:09 and second reading, should council approve this request.

06:42:13 I just wanted to state, also, the on-street parking that Mr.

06:42:17 Everett is talking about would be constructed and maintained

06:42:21 at Pollack Shores' expense, and we fully understand the

06:42:26 administrative costs that we have to go to, and we have

06:42:29 every confidence that we can satisfy the code requirements

06:42:32 for providing the spaces.

06:42:35 So that's why we are asking council to at least consider the

06:42:39 existence of those spaces, not withstanding that you can't

06:42:43 consider them on-site parking.

06:42:46 Finally, I would just like to say in support of our

06:42:49 waivers -- and I think Mr. Everett already articulated

06:42:53 this -- but this is a very urban development.

06:42:57 It's very consistent with the kind of standards recommended

06:43:00 by am ULI, and I would just like to mention one of the

06:43:04 specific items in the ULI report that the City of Tampa

06:43:08 received, is to consider reducing parking requirements, in

06:43:15 order to facilitate more urban development, to promote

06:43:21 transit usage, and frankly foot traffic.

06:43:23 And so we are hoping that you view this project as

06:43:28 consistent as those standards, and the urban nature of this

06:43:33 project really is the justification for all of the

06:43:37 particular waiver requests we have asked for this evening.

06:43:40 And with that, we'll answer any other questions.

06:43:44 >>CHARLIE MIRANDA: Mrs. Montelione?

06:43:45 >>LISA MONTELIONE: Good evening, Mr. Mechanik.

06:43:47 Is there any bicycle parking planned in this project?

06:43:51 Because with the proximity to downtown, and cycling becoming

06:43:55 more and more popular with our population --

06:43:58 >> Absolutely.

06:43:59 We provide actual storage closets that have exit points for

06:44:04 our residents, and we actually hang the bicycles in vertical

06:44:08 racks so they are secure, but then residents can come in and

06:44:12 out.

06:44:12 >>LISA MONTELIONE: Fantastic.

06:44:14 Thank you so much.

06:44:15 >> Any other questions by council members?

06:44:18 Anyone in the audience who would care to speak on this item,

06:44:21 first item number 1?

06:44:23 Anyone?

06:44:24 Care to speak on item number 1?

06:44:26 Please come forward.

06:44:27 >> I actually grew up in West Tampa.

06:44:45 And there's a church will, I don't know if you please know

06:44:51 about it but on the corner of Oregon and Gray.

06:44:55 And that church has been there for 107 years.

06:44:58 And Gray Street has been not only, you know, 275, it's a

06:45:07 major freeway, and that's how a lot of members go back and

06:45:10 forth or commute back and forth to that church.

06:45:13 And you traveling there, that same street for 20, 30, 40

06:45:19 years and all of a sudden it's going to be blocked off,

06:45:27 that's a lot of unfamiliar obstacles.

06:45:30 And in doing so, it makes it difficult for the elderly to

06:45:35 commute back and forth to church.

06:45:37 I'm not saying that it's a bad idea.

06:45:41 For land development to progress.

06:45:43 But I'm saying that maybe we need to take into account that

06:45:48 Gray Street, they should look off instead of on.

06:45:59 I also have a petition here.

06:46:06 With 78 church members on it saying that they want you to

06:46:09 reconsider, or at least give them an opportunity to come

06:46:11 down also and speak on behalf of it.

06:46:16 >>CHARLIE MIRANDA: They are certainly welcome.

06:46:18 They are not here today, I assume, unless my assumptions are

06:46:23 wrong.

06:46:23 But they are certainly entitled, if this was to go and pass

06:46:26 today to come back when it comes back for second reading.

06:46:31 That's the perfect welcome.

06:46:33 We welcome that will kind of dialogue and debate.

06:46:36 >> Yes, sir.

06:46:45 Mr. Reddick?

06:46:47 Sir, Mr. Reddick has a question.

06:46:48 >>FRANK REDDICK: Is that Salem?

06:46:54 >> Yes, sir.

06:46:55 >>FRANK REDDICK: All right, thank you.

06:47:03 >>CHARLIE MIRANDA: Would anyone else care to speak on item

06:47:05 number 1?

06:47:07 Ms. Mulhern?

06:47:09 >>MARY MULHERN: I have a question for Mr. Mechanik.

06:47:14 It looks like -- I'm looking at this first page on here how

06:47:38 many parking spaces does closing gray give you?

06:47:41 >> May I speak to that?

06:47:43 It's not only the additional parking.

06:47:44 It's the configuration themselves.

06:47:49 It's not possible for us to -- building efficient enough to

06:47:56 be economically viable without closing Gray Street.

06:47:59 So we thought -- certainly like I said before, we don't want

06:48:04 to close streets at all.

06:48:06 We thought with the alternate routes that were available

06:48:08 onto Carmen and Fig.

06:48:09 And then if we did do traffic counts, our traffic engineer

06:48:13 can count to you, were done in the streets, because I

06:48:16 believe there's minimal traffic being used on the streets

06:48:19 daily.

06:48:20 And so certainly we are concerned with our neighbors.

06:48:22 We want to work with our neighbors.

06:48:24 And we even -- the city has even asked us to enhance, put a

06:48:31 sidewalk in, and put a curb cut in on the right-of-way in

06:48:34 front of the lot that they own next to us which they use for

06:48:37 parking.

06:48:37 But without vacating Gray Street, our project is not

06:48:41 feasible.

06:48:42 >>MARY MULHERN: Why couldn't you have drawn something --

06:48:48 when I look at this picture, I just see parking.

06:48:51 What else are you gaining if you close -- if we vacate that

06:48:54 street?

06:48:55 >> Well, the shape of that building, the donut building,

06:48:58 even though it doesn't look like it encroaches, there are

06:49:03 utilities that are near the portion of the building that

06:49:06 need to be relocated further south.

06:49:10 The access in, Gray Street across, the city code on drive

06:49:15 aisle widths and just parking counts period, the parking

06:49:21 count would drop probably by about 15%.

06:49:26 It's not that we really wanted to close Gray Street.

06:49:28 We couldn't come up with another way of building an

06:49:32 economically feasible project in this area.

06:49:37 >> Our parking requirements, because of our lack of transit

06:49:44 and because the way our code is written, they are pretty

06:49:47 strict, but I also feel that, you know, everybody likes to

06:49:50 talk about ULI and good urban design, but I think the grid

06:49:56 is really important part of urban design.

06:50:01 I mean --

06:50:02 >> I agree.

06:50:04 >>MARY MULHERN: The fab risk it.

06:50:06 So I think to close down a public street, an entire block of

06:50:11 a public street, needs to be -- I would think it needs to be

06:50:17 a last resort.

06:50:18 >> And it absolutely was a last resort for us in the design

06:50:22 of our project. We went through many iterations on trying

06:50:25 to protect the grid.

06:50:27 And we could not come up with a plan that actually was

06:50:31 feasible to build.

06:50:32 And it's true, the blocks in that area, if you are going to

06:50:38 build, townhouse projects, fur going to build high-rise, you

06:50:43 know, which is not economically feasible, the other block is

06:50:48 zoned for high-rise, and so that block will be coming in at

06:50:51 some point if anybody tries to develop it for rezoning.

06:50:54 They are going face the same challenges that we did.

06:50:56 And so I think it will be a long time before you see

06:50:59 development in this area, if you are not allowed to do

06:51:01 surface parking projects, and I don't think that you can get

06:51:05 the economy to scale that you need without having a bigger

06:51:11 block pattern.

06:51:11 The vintage blocks, you look at their block, and it's a much

06:51:15 larger block, and really that's what we are facing, too.

06:51:24 >>CHARLIE MIRANDA: Any other council members?

06:51:25 Let me say this on Gray Street.

06:51:27 Maybe the city can tell us.

06:51:31 Gray doesn't go all the way through.

06:51:33 I think the armory is in the way of gray.

06:51:36 And then when you start from the west heading east, again it

06:51:40 doesn't go through because of a park.

06:51:44 >> It goes east about 600 feet and then stops.

06:51:46 To the west, I think it going jog as round the armory but

06:51:51 gray goes all the way through.

06:51:53 >>CHARLIE MIRANDA: That far it goes tall way through.

06:51:54 And Tampa park also -- it stops there.

06:52:02 Any other questions by council members?

06:52:05 Anyone else in the audience to ho would like to speak on

06:52:08 this item number 1?

06:52:11 Rebuttal?

06:52:12 You have that right, Mr. Mechanik, if you want to speak to

06:52:14 anything that has been brought up.

06:52:19 >>DAVID MECHANIK: Actually in response to Ms. Mulhern's

06:52:22 question, I think Mr. Everett really addressed the comments

06:52:25 from the reverend, and we certainly respect their concerns.

06:52:28 But we did analyze the street has very low traffic volumes,

06:52:33 and there are numerous other alternatives for traversing

06:52:38 that neighborhood.

06:52:39 So we don't really have anything further to add.

06:52:41 Thank you.

06:52:43 >>CHARLIE MIRANDA: I need a motion to close.

06:52:45 Motion by Mrs. Montelione to close, second by Mr. Suarez.

06:52:48 All in favor of the motion please indicate by saying aye.

06:52:51 Opposed nay.

06:52:52 The ayes have it unanimously Mr. Reddick?

06:53:06 We'll go from rate to left.

06:53:07 Any other council members?

06:53:08 Mr. Suarez, would you like to take number 1?

06:53:11 >>MIKE SUAREZ: Yes, sir.

06:53:14 I move an ordinance being presented for first reading

06:53:16 consideration, an ordinance vacating, closing,

06:53:17 discontinuing, and abandoning that section or right-of-way

06:53:21 known as Gray Street, on the east by Rome Avenue, on the

06:53:25 west by Oregon street legally described in section 1 hereof

06:53:30 subject to certain easement reservations, covenants,

06:53:33 conditions, restrictions more particularly set forth herein

06:53:36 providing an effective date.

06:53:38 >>CHARLIE MIRANDA: We have a motion by Mr. Suarez.

06:53:40 Do I have a second?

06:53:42 Seconded by Mrs. Montelione.

06:53:44 All in favor of that motion please indicate by saying aye.

06:53:48 Opposed nay.

06:53:50 The motion is not passed.

06:53:52 The vote is 3 to 2.

06:53:54 Roll call vote if you want to put it in the record.

06:53:57 >>THE CLERK: Roll call vote.

06:54:04 Suarez.

06:54:05 >>MIKE SUAREZ: Yes.

06:54:07 >>FRANK REDDICK: No.

06:54:08 >>CHARLIE MIRANDA: Yes.

06:54:10 >>MARY MULHERN: No.

06:54:12 >>LISA MONTELIONE: Yes.

06:54:16 >> And Capin?

06:54:18 >>YVONNE CAPIN: Yes.

06:54:18 >> Let me say this.

06:54:20 When a council member is not here, they have televisions

06:54:25 where Ms. Capin was.

06:54:26 I'm making that assumption because we have a thing called

06:54:29 food.

06:54:29 And we are here and we don't have time just like you do.

06:54:35 Soap I want to tell you where we are at.

06:54:39 So if you want to take that vote again.

06:54:41 The maker was Mr. Suarez.

06:54:42 The second was Mrs. Montelione.

06:54:47 All in favor of item number 1, in the affirmative being

06:54:52 passed please indicate by saying aye.

06:54:54 Opposed nay.

06:54:55 >>THE CLERK: Motion carried with Reddick and Mulhern voting

06:54:59 no and Cohen abstaining.

06:55:00 Second reading and adoption will be on June 7th at 9:30

06:55:03 a.m.

06:55:04 >> Thank you very much for attending.

06:55:10 >>DAVID MECHANIK: We are sorry some bankrupt but all three

06:55:14 items, we are requesting that they be scheduled for second

06:55:17 reading at a council workshop on May 24th.

06:55:21 We beg your indulgence, because we have a closing deadline,

06:55:26 and if the property is not finally approved by the 24th,

06:55:32 then we run into legal problems.

06:55:36 >>CHARLIE MIRANDA: Mr. Suarez?

06:55:38 >>MIKE SUAREZ: Mr. Chair, I will not be here on the

06:55:40 24th.

06:55:41 >>CHARLIE MIRANDA: I was going to take the floor myself but

06:55:43 you beat me to it because I won't be here on the 24th.

06:55:47 You better extend your deadline.

06:55:49 >> I think under the circumstances we will go with the

06:55:53 normally scheduled date.

06:55:57 >>CHARLIE MIRANDA: What a brilliant idea.

06:55:59 >>DAVID MECHANIK: We withdraw our request.

06:56:00 Thank you, Mr. Chairman.

06:56:03 >>CHARLIE MIRANDA: Okay.

06:56:04 Item number 2.

06:56:05 >>MARTIN SHELBY: Mr. Chairman, you heard the report on item

06:56:15 number 1 and 2 together.

06:56:16 So if you want to ask if there's anybody to speak.

06:56:19 >>CHARLIE MIRANDA: I will ask the public again if anyone

06:56:21 wants to speak on -- they are entitled to speak on item

06:56:23 number 2.

06:56:24 And I want to give them tall opportunities so the record

06:56:27 will be crystal clear.

06:56:29 Anyone who would like to speak on item number 2, please come

06:56:33 forward.

06:56:34 I see no one.

06:56:35 I need a motion to close.

06:56:38 Motion by Mr. Reddick.

06:56:40 I have a second by Mrs. Montelione.

06:56:41 All in favor of the motion please indicate by saying aye.

06:56:44 Opposed nay.

06:56:46 Is hearing is now closed.

06:56:48 Item number 2.

06:56:49 Mrs. Capin, would you kindly take item number 2?

06:56:53 >>YVONNE CAPIN: An ordinance being presented for first

06:56:55 reading consideration, an ordinance rezoning property in the

06:56:58 general vicinity of 1502, 1504, 1505, 1506, 1507, 1508,

06:57:09 1509, 1511 and 1515 West Gray Street, 1506, 1516, and 1544

06:57:19 west Cass Street, 1523 through 1525 west Carmen street, 405

06:57:31 north Rome Avenue and 5072 north Oregon Avenue in the city

06:57:35 of Tampa, Florida, and more particularly described in

06:57:38 section 1 from zoning district classifications IG industrial

06:57:42 general to PD, planned development, and PDA, planned

06:57:46 development alternative, residential, multifamily, retail

06:57:49 and office, to PD planned development, residential

06:57:52 multifamily, providing an effective date.

06:57:53 >> Second.

06:57:57 >>CHARLIE MIRANDA: I have a motion by Mrs. Capin on item

06:57:59 number 2.

06:57:59 I have a second by Mr. Suarez.

06:58:00 Further discussion by council members?

06:58:02 All in favor of the motion please indicate by saying aye.

06:58:05 Opposed nay.

06:58:06 >>THE CLERK: Motion carried with Reddick and Mulhern voting

06:58:11 no and Cohen abstaining.

06:58:13 Second reading and adoption will be on June 7th at 9:30

06:58:16 a.m.

06:58:19 >>CHARLIE MIRANDA: Thank you very much.

06:58:21 All those attending.

06:58:23 Item number 3.

06:59:10 >>ABBYE FEELEY: Land development coordination.

06:59:12 Item number 368 is the last lath little piece of items 1 and

06:59:16 2 that we didn't get to. Request buff tonight is from PDA

06:59:19 planned development alternative.

06:59:21 This is 502 north Oregon.

06:59:24 Actually a portion of that is a Carmen address.

06:59:27 PDA, alternative residential million, retail and office to

06:59:32 PD, parking commercial off-street.

06:59:37 There's one waiver being requested and that is to reduced

06:59:40 the required green area from toxic chemicals 17.8% which is

06:59:44 a waiver of 87 square feet.

06:59:51 Previous applications, we just talked about.

06:59:53 As you know was from Cass down to gray with vacating of

07:00:00 gray. This is the parking lot referred to just to the west

07:00:02 of the previous, just to the east of the existing commercial

07:00:08 light industrial use that is located to the west at Carmen,

07:00:19 Row and gray.

07:00:21 Zoning atlas, PDA to the north, PD to the south.

07:00:26 The majority of the west side of roam is IG and the piece of

07:00:29 property that this piece will be serving is zoned IG,

07:00:32 industrial general.

07:00:59 The combination of the buffer from the multifamily

07:01:01 residential and the landscape buffer that would be plant by

07:01:05 this applicant.

07:01:15 I have pictures of the property along Carmen looking south.

07:01:17 This is moving west.

07:01:25 This is Mr. Saavedra's property that's been referenced

07:01:30 several times this evening.

07:01:31 This is to the east, the that was just previously rezoned.

07:01:35 This is Rome looking at Carmen.

07:01:37 As you can see there's parking right now on the north side

07:01:40 of Carmen on vacant property.

07:01:50 The request before you this evening under this PD

07:01:53 application is for ten parking space parking lot.

07:01:56 It is a 50 by 103 parcel and it was previously rezoned as

07:02:00 part of the west end mixed use project phase one.

07:02:05 Parking lot will serve the property to the west and is

07:02:08 located within the West Tampa overlay district.

07:02:12 One item, a couple of site plan modifications that need to

07:02:16 be made.

07:02:16 We need them to revise the chain link fence.

07:02:20 Chain link is not permitted in the overlay and that will be

07:02:23 replaced with decorative rods, iron-type fencing notation,

07:02:28 and also to take off the language on the site plan related

07:02:32 to the waiver being requested.

07:02:34 The waiver is being requested and we will now have that on

07:02:37 the site plan property.

07:02:41 Transportation had a couple of modifications that were

07:02:43 needed related to the flair, and there is a diagram located

07:02:48 in there, and then the last modification was by tree and

07:02:51 landscape for the waiver to be added for the 87 square feet.

07:02:56 Staff provided you with a brief analysis on pages 3 and 4 in

07:02:59 your waiver criteria on page 5.

07:03:01 I am available for any questions.

07:03:03 Thank you.

07:03:05 >>CHARLIE MIRANDA: Thank you very much.

07:03:07 Petitioner?

07:03:07 >> Mr. Chairman, council members, my name is David Mechanik,

07:03:14 305 South Boulevard.

07:03:17 I'm here representing the applicant Pollack Shores partners.

07:03:22 This is really a companion to the other two applications

07:03:25 that you just approved.

07:03:26 It's to facilitate additional parking for Mr. Saavedra's

07:03:33 property, and we don't really have anything further to add

07:03:36 unless council has any questions.

07:03:38 But it's a companion, if you will, to the project you just

07:03:43 approved.

07:03:44 A separate application simply because it's not going to be

07:03:47 part of this PD zoning application.

07:03:50 >>CHARLIE MIRANDA: Mrs. Montelione?

07:03:51 >>LISA MONTELIONE: Thank you.

07:03:53 This is the part that I think Mr. Everett referred to as

07:03:57 doing decorative fencing along the adjacent property.

07:04:00 And I do want to say something that may or may not be able

07:04:06 to change right now.

07:04:08 But sometimes it frustrates me how engineers just think in a

07:04:12 linear fashion.

07:04:16 We have got one, two, three trees, I think, that are coming

07:04:19 out, or at least two, it looks like two and a palm, a 19 and

07:04:25 a 24-inch right there in that driveway.

07:04:27 >> I'm sorry, not interrupt.

07:04:30 Councilwoman Montelione, I did check those trees, and they

07:04:37 are actually an invasive species.

07:04:40 Not only invasive species, but they grow like -- I forget

07:04:44 the word, but basically in that area, noxious types of

07:04:50 situations.

07:04:53 But I know it's hard.

07:04:55 >>LISA MONTELIONE: Okay.

07:04:57 All right.

07:04:57 Well, just note to all the engineers out there working on

07:05:00 parking.

07:05:01 You know, a little creative never hurt anybody.

07:05:07 You know, doing the straight line thing is easy.

07:05:09 And sometimes -- but do it this way, we have always done it

07:05:16 that way.

07:05:17 >>CHARLIE MIRANDA: Okay, any other council members AT&T at

07:05:18 this time?

07:05:19 Anyone in the public who would dire speak on item number 3?

07:05:22 Please come forward.

07:05:25 I see no one.

07:05:28 I have a motion to close by Mr. Suarez.

07:05:30 Seconded by Mr. Reddick.

07:05:32 All in favor of the motion please indicate by saying aye.

07:05:35 Opposed nay.

07:05:36 The ayes have it unanimously.

07:05:37 Mr. Reddick, will you kindly take number 3?

07:05:42 Okay, we can't take it, sir.

07:05:43 I apologize to you.

07:05:45 Ms. Mrs. Montelione.

07:05:47 >>LISA MONTELIONE: I move an ordinance being presented for

07:05:49 first reading consideration.

07:05:51 An ordinance rezoning property in the general vicinity of

07:05:53 502 north Oregon Avenue, a portion of -- in the city of

07:05:58 Tampa, Florida and more particularly described in section 1

07:06:00 from zoning district classifications PDA planned development

07:06:03 alternative, residential multifamily, retail and office, to

07:06:06 PD, planned development, parking, commercial off-street,

07:06:10 providing an effective date, including whatever notations

07:06:13 that were provided by staff on the sheet.

07:06:15 >>MIKE SUAREZ: Second.

07:06:18 >>CHARLIE MIRANDA: I have a motion by Mrs. Montelione,

07:06:20 second by Mr. Suarez.

07:06:22 Further discussion by council members? All in favor?

07:06:23 Opposed?

07:06:24 >>THE CLERK: Motion carried with Reddick and Mulhern voting

07:06:29 no, and Cohen abstaining.

07:06:33 Second reading and adoption will be on June 7 at 9:30 a.m.

07:06:37 >> I just want to be clear I.don't have a recollection

07:06:43 whether the motion for item number 2 included the revision.

07:06:45 So that I just wanted to be clear for the record.

07:06:48 >>CHARLIE MIRANDA: Redo it?

07:06:50 >>MARTIN SHELBY, no I wanted to be clear.

07:06:51 I apologize for interrupting.

07:06:53 >>ABBYE FEELEY: There was a revision sheet with this one

07:06:57 also.

07:06:58 >>CHARLIE MIRANDA: I thank you all very much for appearing.

07:07:06 Item 48 was taken care of.

07:07:07 That will be heard on June 14th at 6:00.

07:07:10 Item number 5.

07:08:00 >>ABBYE FEELEY: Land Development Coordination.

07:08:03 Item 5, Z-12-15 located at 708 South Howard Avenue.

07:08:09 The request before you this evening is from PD planned

07:08:12 development residential multifamily retail and office to PD

07:08:15 planned development, residential, multifamily retail office

07:08:18 and restaurant.

07:08:25 As Tony did state, this is in the central planning district.

07:08:29 And the Planning Commission did find it consistent.

07:08:39 This site was previously rezoned in 2005 and much of what

07:08:45 you see on the site plan before you this evening is

07:08:47 identical to that with some modification.

07:08:54 The first item is the addition of the restaurant use.

07:08:57 There was not previously restaurant approved in this PD

07:09:02 zoning but we are adding that tonight.

07:09:04 The second is the surface parking area which is located at

07:09:07 the northeast corner and the southwest corners of the

07:09:11 property.

07:09:13 There were surface parking areas that were not previously

07:09:15 there either.

07:09:18 I am going to go through now and talk about the parameters

07:09:21 of this project and also show you some photos and the zoning

07:09:26 atlas.

07:09:27 This is the property located on swan, just south of Swann

07:09:32 and actually links up to Swann on Howard.

07:09:37 The building that's located at the southeast corner of Swann

07:09:40 and Howard Avenue.

07:09:46 The one waiver on the page of your site of your staff report

07:09:51 that you see was to allow replacement of trees since

07:09:54 existing trees were required for the previous development,

07:09:58 and that's really what happens when you have a plan.

07:10:01 And I'll show you some pictures of the site.

07:10:03 But most of those trees are trees that are in island and the

07:10:06 parking lot that were required at the time, that the first

07:10:09 shopping or the first development was placed there.

07:10:14 So all these trees you see here that will now be taken out,

07:10:18 since they are mitigated for the site one time, these trees

07:10:21 will be required to be replaced at an inch for inch.

07:10:26 Amount.

07:10:27 The other waiver is waiver 2 through 7 are new waivers that

07:10:33 are being requested as a result of the application that is

07:10:36 before you tonight.

07:10:38 The other thing I wanted to say was, the Z 05-125, purchase

07:10:45 student 394, you get five years to substantially construct a

07:10:49 PD development.

07:10:50 Substantial construction is typically 50% of that

07:10:53 development.

07:10:55 If this PD today, the Z 05 were to go into permitting, it

07:10:59 would be subject to codes that are in place today because

07:11:01 they have exceeded the five years for substantial

07:11:04 construction.

07:11:04 So some of the waivers that you see on the plan today are

07:11:08 waivers that are due now to codes that would be required to

07:11:11 comply with, such takes first one, to reduce the minimum

07:11:16 amount of landscape area for multifamily dwelling with

07:11:19 vehicular use from 350 down to 80 square feet.

07:11:23 The Z 05 had a waiver from 350 to 250, and at the time in

07:11:29 '05 there was no payment of fee in lieu required, so going

07:11:34 from 350 down to 80, but there will also be a payment in

07:11:38 lieu fee that will be required for that square footage which

07:11:41 is being waived.

07:11:42 The third is to reduce the special street set back from 46

07:11:46 feet to 41 feet, based on the proposed building location.

07:11:52 That was not on the previous plan, but given the location of

07:11:56 the previous building, it appears that that was granted.

07:11:59 Number 4 was section 27-242, to reduce the required number

07:12:03 of off-street parking spaces from 584 to 495.

07:12:08 >>MARY MULHERN: He there was no parking waiver granted on

07:12:10 the 2005 PD that currently is entitled on this property.

07:12:15 Number 5 is section 27-246 to allow reduction in the drive

07:12:19 aisle width from 26 feet to 24 feet.

07:12:24 Six is section 27-247 to reduce the required number of

07:12:28 loading berths from 3 to 2.

07:12:31 And the last is on those two loading berths that instead of

07:12:37 212 by 30 and 112 by 60, it's going to be 212 by 30 loading

07:12:43 berths.

07:12:44 The request before you this evening is for 235 multifamily

07:12:47 residential units and 137,125 square feet of retail,

07:12:53 restaurant and office uses, of which 9500 may be restaurant

07:12:59 with 2,125 square foot of outdoor patio.

07:13:04 The patio would be associated with the restaurant as well.

07:13:08 There's a 4.1-acre site, and it is surrounded by a mix of

07:13:13 multi-and commercial use as long South Howard Avenue.

07:13:16 The project will contain one four-story multifamily

07:13:21 residential building with retail restaurant and business

07:13:23 occupying the first floor along South Howard and potentially

07:13:27 some office 3,000 square feet along west swan.

07:13:31 There is integrated garage at the southeast corner of the

07:13:36 site.

07:13:37 It was rezoned in 2005 for 248 units.

07:13:41 So this is 13 units less than what it is currently entitled

07:13:46 for.

07:13:47 And the current rezoning request as to restaurant use and

07:13:50 makes other minor modifications including surface parking

07:13:52 along the southwest and northeast corners as I previously

07:13:56 mentioned.

07:13:57 The PD setbacks are proposed at 10-foot north, south, east

07:14:01 and west.

07:14:02 A maximum building highlight of 60 feet.

07:14:05 And the garage not to exceed 55 feet.

07:14:07 That not to exceed 55 was carried over from the 2005

07:14:11 rezoning.

07:14:13 Based on the configuration being requested, 584 spaces are

07:14:17 required and 495 spaces are being provided.

07:14:20 This is a 15% waiver that's being requested.

07:14:24 No waivers are being requested to the South Howard overlay.

07:14:28 They are committing to comply.

07:14:31 Based on staff's review, there are some minor site plan

07:14:34 modifications that still need to be addressed.

07:14:38 I have identified those for you on pages 2, 3 and 4 of your

07:14:42 staff report, as well as provided the purpose and intent of

07:14:48 the PD on pages 5, 6 and 7 and some comp plan policies on

07:14:52 pages 8 and 9.

07:14:55 I will go ahead and show you some pictures of the property.

07:14:57 I did provide you a revision sheet which outlines the

07:15:01 modifications that need to be made.

07:15:03 There was one handwritten in there.

07:15:07 Right now, the current plan shows a sidewalk that runs

07:15:11 around the perimeter of the parking garage.

07:15:13 The previous plan did not.

07:15:16 Previous approved PD does not have that so they are going to

07:15:20 remove some of that along the east.

07:15:22 That would be the Sweetbay grocery store side that will

07:15:24 allow them to bump up some of their green space, actually

07:15:28 bump up the waiver, not to 80 square feet but to 89 square

07:15:33 feet a unit.

07:15:34 So that modification would be addressed in the revision

07:15:39 sheet also.

07:15:40 So down from 350 to 89 square feet.

07:15:49 Here is the zoning atlas sheet.

07:15:51 You will see the subject property shown in green, Swann to

07:15:55 the north, Howard to the west.

07:15:57 This is the small MRI building here.

07:16:05 As you are familiar, Panera Bread, Starbuck's directly

07:16:09 across the street, the mixed use.

07:16:12 There's no residential but mixed commercial.

07:16:15 And that interfaces with the project.

07:16:19 This cut-out here at the southeast corner, that is owned by

07:16:24 the Bern's property, and there is a cross-access agreement

07:16:27 here for the vacated Avenue.

07:16:41 I am going to show you some photos.

07:16:46 That is that access that I just spoke of, the vacating.

07:16:50 The property is gated so it was hard for me to get behind

07:16:54 there and show you.

07:16:58 This is the Bern's property to the south.

07:17:04 This is along Howard, that same property.

07:17:10 This is the subject property looking north from Inman over

07:17:15 to gate.

07:17:16 This is immediately across the street on Howard, the west

07:17:19 side of Howard.

07:17:22 Looking up Howard.

07:17:27 This is from 717 looking back east.

07:17:34 And this is at the northeast corner of Howard and Swann.

07:17:46 If modifications are made between first and second reading

07:17:49 staff did find the application consistent with City of Tampa

07:17:51 code.

07:17:51 Thank you.

07:17:56 >>CHARLIE MIRANDA: Any questions by council members at this

07:17:57 time?

07:17:57 Petitioner?

07:18:07 >>DAVID MECHANIK: 305 South Boulevard, Tampa, Florida.

07:18:10 And I have been sworn.

07:18:12 I'm here tonight representing the applicant.

07:18:16 And I have we've me this evening Mr. Bart French,

07:18:21 vice-president of investments, with Post Properties.

07:18:25 And Mr. Kevin Polston, Sr., vice-president for commercial,

07:18:30 also with Post Properties.

07:18:33 At this time I would like to ask Mr. French to give you an

07:18:38 overview of the project.

07:18:39 And then I will speak to have some of the issues regarding

07:18:43 the staff reports and so forth.

07:18:46 Thank you.

07:18:46 >> Bart French, 3329 Shady Valley, Dallas, Texas.

07:18:57 We are excited about getting back into the development

07:19:00 market.

07:19:01 As Abbye alluded to we were going to start this deal four or

07:19:05 five years ago.

07:19:06 Unfortunately, the economy didn't cooperate with us.

07:19:11 But we are happy to be back here talking to you all at this

07:19:15 point.

07:19:15 Let me tell you a little bit about Post Properties before we

07:19:19 start on the development.

07:19:20 We are a publicly traded trust based out of Atlanta.

07:19:27 We primarily have assets in the southeast, Texas, and mid

07:19:31 Atlantic, approximately 23,000 apartment homes in those

07:19:36 markets, and we are typically a long-term holder.

07:19:42 Our business is to build a portfolio and grow it versus

07:19:48 build them to sell them.

07:19:50 So it's kind of an overview from Post Properties'

07:19:55 standpoint.

07:19:56 The deal in question, just to give you a quick overview, is

07:20:06 to orient you to the site.

07:20:07 So we have South Howard Avenue running north-south, and then

07:20:13 Swann Avenue is east and west.

07:20:15 What we have here is a four-story building.

07:20:20 On the front along South Howard, we have got the retail,

07:20:24 restaurant, and some of our amenities for the development.

07:20:29 With three floors of apartments up above.

07:20:31 And then along the back of what we call the donut here is

07:20:36 four stories of apartment units.

07:20:39 And then we have a structured parking garage that's just

07:20:42 under 55 feet. So it's five levels, four stories.

07:20:47 And then the first floor parking off of South Howard, and

07:20:54 then it's all one level at that point.

07:20:56 And then for the residential, you have access off of Swann

07:21:02 and there's a ramp that goes up to the second floor.

07:21:05 If you are familiar with Post Properties deals, they are

07:21:09 heavily landscaped.

07:21:11 You will want to create a walkable environment, in our

07:21:16 developments, if you are familiar with harbor place, that's

07:21:18 a good example of the types of deals we do.

07:21:23 Over half of our properties across the portfolio are mixed

07:21:28 use developments like this.

07:21:29 We have a lot of experience operating, developing and

07:21:34 operating properties such as this.

07:21:37 So that's kind of the overview.

07:21:40 This is actually a shot of the developments.

07:21:47 And if you are familiar with 717 south it's actually right

07:21:50 here.

07:21:51 But this is the hard corner.

07:21:54 This is the old Inman drive so you are driving back to the

07:21:57 garage.

07:21:57 So we drips the FAP sad of the garage to look more like a

07:22:00 building and not an enlarge precast garage.

07:22:05 This is the hard corner where we are contemplating putting

07:22:08 retail.

07:22:08 And then in the middle we are looking at doing some of our

07:22:12 amenities, the leagues office, as well as our fitness

07:22:14 center.

07:22:15 And then some retail down at the other hard corner.

07:22:21 And then this is the view off Swann Avenue.

07:22:26 So this centimeter four floors of apartment homes.

07:22:30 And then as alluded to earlier the residents will actually

07:22:34 access the garage off of Swann.

07:22:37 And there's a ramp that gets up to the second floor. So we

07:22:39 are separating the parking so that you don't have residents

07:22:43 and retail crossing over.

07:22:49 Let's see what else.

07:22:50 We have the one elevation.

07:23:01 And then last but not least is the elevation.

07:23:06 So St. Louis Howard Avenue.

07:23:07 So we are showing the retail out front here of how it would

07:23:12 look.

07:23:17 So, Dave, do you want to talk a little more?

07:23:21 >>CHARLIE MIRANDA: If I may just a second.

07:23:22 Stop the clock.

07:23:23 I want to make sure that everyone who has spoken or will

07:23:26 speak has been sworn in.

07:23:26 >> Bart French.

07:23:33 (Oath administered by Clerk)

07:23:47 >>DAVID MECHANIK: Okay.

07:23:50 I am going to ask Mr. Pollack to hand out some things.

07:23:55 We have some letters from the park land civic association

07:23:58 indicating it has no objection to our rezoning request this

07:24:02 evening.

07:24:04 I am also providing a copy of an e-mail from Randolph

07:24:12 Merrill, also known as searing Merrill, indicating that he

07:24:19 represents a group of property owners, and I will explain

07:24:23 this now just a second, indicating that they also support

07:24:26 our request, if we make certain changes to our application,

07:24:31 and with your indulgence, what I would like to do is

07:24:36 describe those changes, and with all respect to Abbye, she

07:24:40 has not had a chance to see these.

07:24:43 We have been working with this group of property owners the

07:24:45 last week and a half, and we were only able to come to a

07:24:49 conclusion this afternoon literally right after 5:00 today,

07:24:55 and so what I would like to do is describe those changes to

07:25:00 you.

07:25:03 As indicated by Abbye, we have requested a parking waiver.

07:25:13 This group of property owners basically are comprised of the

07:25:16 owners of the plaza where 717 restaurant is and Starbuck's,

07:25:21 the Panera bread and the retail there, and of course the

07:25:25 offices.

07:25:25 The owner of the CVS on the opposite, the northern corner,

07:25:30 and also I believe the owner. Blockbuster block on the

07:25:35 northeast corner of this intersection, which covers all the

07:25:39 corners of the intersection other than the subject property.

07:25:44 Those property owners were concerned about the impact of our

07:25:51 request for a reduction in the required number of parking,

07:25:55 specifically as it relates to the restaurant uses.

07:26:00 And while I would like to state for the record that we

07:26:03 believe that based on Post's experience round the country,

07:26:10 and in connection with the technical analysis that we did,

07:26:13 we were providing sufficient parking to accommodate all of

07:26:16 the uses on-site including the restaurants.

07:26:20 We were happy to make this accommodation to those property

07:26:24 owners in order that we could satisfy their concerns, and

07:26:31 they would in fact support the project.

07:26:37 So again I know that Abbye hasn't seen that, and this makes

07:26:42 for a little bit difficult situation here, but we would like

07:26:45 to present the additional corrections.

07:26:50 And by the way, we do agree with all of the correction and

07:26:53 changes which Abbye presented earlier, and we will make

07:26:57 those changes before second reading, should council approve

07:27:01 us on first reading here tonight.

07:27:03 But here are the changes.

07:27:04 And I should really emphasize that they are all designed to

07:27:10 reduce the demand on parking for our restaurant uses, and

07:27:15 therefore we are essentially narrowing the scope of our

07:27:22 waiver request.

07:27:24 So we are asking for less of a waiver than we were in our

07:27:27 original application.

07:27:29 So there are basically four conditions which are reflected

07:27:33 in that correction sheet.

07:27:36 One is that the indoor restaurant area would be no greater

07:27:40 than 8200 feet.

07:27:44 Our original application has that number at 9500.

07:27:48 So we have reduced the amount of indoor restaurant space by

07:27:53 1300 feet.

07:27:57 The second condition we would like to add is that no more

07:28:01 than three restaurant uses can be established within this

07:28:04 project.

07:28:05 The third condition is that a maximum -- any one restaurant

07:28:11 cannot exceed a total of 6500 square feet.

07:28:16 And finally that the restaurant occupancy for the entire

07:28:21 project would not exceed a total of 600 occupants.

07:28:25 We had previously identified a number at 670 occupants.

07:28:33 So we have restricted the ability to provide for all these

07:28:38 occupants.

07:28:39 And we have also reduced it, all of which goes to reduce the

07:28:43 parking demand quite considerably by about 13%.

07:28:48 In fact, if you looked at the restaurant, in isolation, our

07:28:55 parking being provided, actually is one space short of

07:29:01 what's actually required by code.

07:29:03 So we have essentially eliminated the waiver request for the

07:29:07 restaurant use.

07:29:10 With that, I would just like to maybe comment on a couple of

07:29:14 other waiver requests, and I'm sure staff is going to

07:29:18 comment on our proposed changes this evening.

07:29:21 But I would like to just finish this part of the

07:29:23 presentation.

07:29:26 The reduction in green space waiver, there was essentially

07:29:29 an error in calculation when this project was approved in

07:29:33 2005.

07:29:34 The building footprint that you see here today, with the

07:29:38 amount of green space available, is exactly the same, a

07:29:42 footprint, and amount of green space that was approved in

07:29:47 2005.

07:29:47 However, the calculation was done in error.

07:29:49 So we had to ask for additional -- an additional waiver in

07:29:54 order to accommodate what was actually approved back then.

07:30:00 The parking waiver, I think we have discussed fairly

07:30:03 substantially.

07:30:06 The other waivers all began very similar to the earlier

07:30:10 project.

07:30:11 This is a very urban mixed use project with retail,

07:30:15 restaurant and residential.

07:30:18 And all of the idea behind this subpoena to build it in an

07:30:21 urban setting, much like the developments across the street

07:30:25 and what the city is trying to encourage elsewhere.

07:30:28 So all of these waivers are really justified and driven by

07:30:33 the urban character of this development.

07:30:36 So at this point we would answer any questions and see if

07:30:41 the staff has any comments about our proposed changes.

07:30:45 >>CHARLIE MIRANDA: Any questions by council members at this

07:30:46 time?

07:30:47 Ms. Mulhern?

07:30:48 >>MARY MULHERN: Do you have this e-mail from Anna Lisa

07:30:55 Myers?

07:30:56 She had a lot of questions?

07:31:02 Maybe you could explain again that -- or maybe Abbye can

07:31:06 confirm that but I didn't understand about the green space.

07:31:22 Did you understand that?

07:31:24 >>ABBYE FEELEY: Actually I don't because the surface

07:31:26 parking was not shown there so there was more green space so

07:31:28 I don't think it was miscalculation.

07:31:30 I'm looking for my old --

07:31:35 >>MARY MULHERN: Okay.

07:31:35 >>ABBYE FEELEY: I'm a little bit confused myself at the

07:31:39 moment.

07:31:39 >>MARY MULHERN: That was one of my questions.

07:31:42 Maybe you can see if you can figure that out by the end of

07:31:45 this hearing.

07:31:48 What about the setback on Swann?

07:31:50 I'm trying to understand it.

07:31:53 I guess I need to hear maybe from the petitioner on -- not

07:31:56 on Swann, I'm sorry.

07:31:58 >> Tallahassee special street setback reduction.

07:32:01 There's a waiver on Swann.

07:32:02 I had mentioned that in my report.

07:32:04 In 0757 when PDs were done they were a little different than

07:32:09 how they are done today.

07:32:10 Like tonight when these revisions would come up, people

07:32:13 would have been writing on plans and making modifications.

07:32:16 We don't roll that way anymore, so to speak.

07:32:20 So there are some waivers that were captured that were not

07:32:24 formerly waivers on the 075 plan but were inherently granted

07:32:29 because of the location of where the building is.

07:32:32 The building is exactly the same place on Swann.

07:32:34 So although the special street setback waiver wasn't on the

07:32:38 05 plan, we are capturing it on this plan to make sure that

07:32:41 the waivers are correct.

07:32:42 But the building wasn't exactly in the same place.

07:32:46 Special street setback requirement was still there in 05.

07:32:49 >>MARY MULHERN: But there is -- she's saying -- there is a

07:32:53 waiver for the reduction.

07:32:58 >>ABBYE FEELEY: Special street setback waiver from the

07:33:00 center line of Swann Avenue.

07:33:02 Not from the property line.

07:33:03 It's a special street setback waiver for sunset to 27-99.

07:33:09 And given that the building was exactly the same location,

07:33:12 we assumed it was inherently granted under the 05 but we are

07:33:17 memorializing that through putting it on as a real waiver

07:33:21 now.

07:33:21 >>MARY MULHERN: But her concern -- and I know how busy that

07:33:26 subpoena there, too -- that that's -- --

07:33:35 >>ABBYE FEELEY: It meets all the site visibility.

07:33:38 >>MARY MULHERN: Transportation doesn't have a problem with

07:33:40 that?

07:33:41 >>ABBYE FEELEY: No.

07:33:42 In fact, you will see -- and then the parking agreement that

07:33:51 apparently you hadn't seen until now either, there's no

07:33:54 parking agreement.

07:33:55 >>MARY MULHERN: Well, I'm sorry, not the parking agreement.

07:33:58 Parking spaces, the waivers, the number of spaces.

07:34:03 The waiver.

07:34:07 >>ABBYE FEELEY: Yes, what's being adjusted, yeah.

07:34:09 Is that overall, Mr. Mechanik --

07:34:14 >>ABBYE FEELEY: He's going to have answer that.

07:34:15 >>MARY MULHERN: Are you saying the waiver here says from

07:34:20 584 to 495 spaces.

07:34:23 Are you saying now that you are back up to almost 580?

07:34:29 >>DAVID MECHANIK: No. No. We are saying that we

07:34:31 essentially replaced the parking that we internally allocate

07:34:34 to the restaurant use.

07:34:36 We are still asking for the waiver as it relates to the

07:34:38 residential and the retail.

07:34:41 But the restaurant use will be parked as per code minus one

07:34:49 space under the revised-open.

07:34:51 >>MARY MULHERN: But those haven't been separated out, just

07:34:56 the park waiver.

07:34:57 So what is the reduction now?

07:35:00 You said it's a 15% reduction.

07:35:04 What are you -- is there -- can you give me a number? In

07:35:08 spaces, percentage or something?

07:35:15 >>DAVID MECHANIK: Let me ask Kevin Polston to tans question

07:35:19 about parking numbers.

07:35:20 And I do have some better information for you on the other

07:35:23 two questions you asked.

07:35:24 >> Kevin Polston, with Post Properties, 4401 Hyde Park lane

07:35:32 Atlanta, and I have not been sworn in.

07:35:33 (Oath administered by Clerk)

07:35:42 >> So total parking required as a result of the reduction in

07:35:45 the restaurant area, and the occupancy, the maximum

07:35:48 occupancy affiliated with those restaurants, the total

07:35:51 parking required for the project has gone from 584 to 572, a

07:35:55 net reduction of 12 spaces.

07:35:57 So therefore the reduction in the waiver is from 89 spaces

07:36:01 to 77 spaces.

07:36:02 So that drops us from 15.2% to 13.57%.

07:36:07 >>MARY MULHERN: Okay.

07:36:08 So the waiver --

07:36:10 >> The waiver is reduced.

07:36:11 Net parking is reduced.

07:36:15 The parking provided is the same so therefore the waiver is

07:36:17 reduced.

07:36:18 The requested waivers are reduced by 12%.

07:36:20 >>MARY MULHERN: I think it's considerable asking for the

07:36:23 parking waivers.

07:36:24 I lived in that neighborhood, and I went for lunch there

07:36:28 today, and would drive around in circles to find a parking

07:36:34 spot.

07:36:35 It was difficult.

07:36:36 So, you know, it can't be a problem with a restaurant.

07:36:43 At lunch time on a Thursday you can't find a parking spot.

07:36:46 >> Yes, ma'am, if I may.

07:36:49 We also currently own 2,000 parking in the Tampa area, three

07:36:57 blocks to the east we own Post Hyde Park, 476 apartment

07:37:02 homes there, Post apartment place we have 578, I believe is

07:37:05 the number.

07:37:06 So we have experience within each of these in town

07:37:12 communities so the waiver relates to the apartment counts

07:37:16 and Post Hyde Park has a ratio of 1.31 parking spaces per

07:37:22 apartment unit.

07:37:23 Post Harbor Place is a ratio of 1.39 parking spaces per

07:37:28 apartment unit.

07:37:29 And the code, the visitor parking under the Tampa code and

07:37:36 the number of parking spaces required for the number of

07:37:38 units translates to a ratio on this project of about 1.75

07:37:43 parking spaces per unit, which is -- we find more applicable

07:37:47 once again to a suburban environment.

07:37:49 We typically park our urban apartment units at one part per

07:37:54 unit to 1.5 per unit.

07:37:57 Our other two projects in this neighborhood, in-town

07:38:02 neighborhood are 1.3 and 1.39 and with the waiver requested

07:38:06 parking is 1.43 marks per unit for Post Hyde Park.

07:38:11 Sole we would actually be parking in two units in excess of

07:38:15 what we have the sister parks at so that sort of waiver real

07:38:21 relates to the count related to the apartment units.

07:38:23 >>MARY MULHERN: So for the restaurant you are saying you --

07:38:29 I kind of missed that what David is saying.

07:38:32 You satisfied the people who are concerned from what?

07:38:42 Which property was it?

07:38:43 >> We met with the owners of the Panera shopping center area

07:38:47 across the street, and the shopping center to the south of

07:38:50 that, that has Starbuck's, 717.

07:38:53 >> Right across Howard, right.

07:38:56 >> Yes, yes.

07:38:57 And so they were concerned about the parking impact, wand

07:39:00 you have already indicated is a stressful situation.

07:39:02 We feel by bringing 235 apartment units to this we will be

07:39:08 bringing more walking traffic for those restaurants.

07:39:10 Not only the restaurants on our side but all of the

07:39:12 restaurants up and down South Howard reinforcing the policy,

07:39:18 we understand the South Howard overlay, to create a more

07:39:21 urban, walkable environment.

07:39:22 >>MARY MULHERN: Thank you.

07:39:32 >>DAVID MECHANIK: I would like to try to answer the other

07:39:34 two questions a little better than I did before.

07:39:38 But the green space, the miscalculation -- and I don't think

07:39:44 Abbye was even aware of it, but at the time, the engineers

07:39:51 or whoever were preparing these calculations assumed they

07:39:56 could count hard space as "open space," and so all of the

07:39:59 hard surfaces, the plazas, you know, which are paved, and

07:40:03 that school area, all got calculated, so the waiver request

07:40:07 was much smaller than what they thought they needed, but in

07:40:11 fact they needed the same waiver requests, or just about.

07:40:14 I realize there are some additional surface parking spaces

07:40:18 which we have done to try and put as many parking spaces as

07:40:23 we can on the property.

07:40:24 So it's not identical.

07:40:26 But the building footprint and the land area of course are

07:40:30 the same. So what we are saying is that what council

07:40:33 approved in 2005 is really what we are asking council to

07:40:37 approve today as far as the green space.

07:40:40 It just wasn't calculated correctly back in 2005.

07:40:44 So we are correctly now calculating the green space waiver

07:40:49 that we need, and we are showing.

07:40:51 That but the physical building was the same back then as it

07:40:57 is today.

07:40:57 >> They didn't ask for a big enough waiver.

07:41:01 >>DAVID MECHANIK: Correct.

07:41:01 Correct.

07:41:01 >>MARY MULHERN: And you are asking for a bigger waiver.

07:41:05 >>DAVID MECHANIK: Correct.

07:41:05 In fact, the building also that was approved by council is

07:41:08 the same building with essentially the same green area as it

07:41:11 was before.

07:41:14 The only thing I wanted to add on the Swann setback is I

07:41:17 think that's an older regulation, when the idea was to

07:41:23 create, I think, wider expansive boulevards and more open

07:41:29 vistas.

07:41:30 The trend now of course through the Howard Avenue overlay

07:41:33 being the example is they want you to build buildings closer

07:41:36 to the street, not farther away.

07:41:38 So the waiver on Swann is simply to actually have a building

07:41:44 footprint that's consistent with it, and behind the Howard

07:41:48 overlay which is a 10-foot setback from the street

07:41:52 right-of-way.

07:41:52 So I think we are just doing what is the --

07:41:56 >>MARY MULHERN: Okay, so that helps, so it's actually ten

07:41:58 feet from the street.

07:41:59 >> Correct.

07:42:01 >>MARY MULHERN: What about on Howard?

07:42:05 >> So it's a more urban look and feel.

07:42:07 And that's what I think the city is trying to accomplish

07:42:09 with the overlay.

07:42:10 >>MARY MULHERN: Yeah, I think -- I always end up

07:42:13 disagreeing with that idea.

07:42:15 I think we need something in between because I think by

07:42:17 pushing everything so close to the street.

07:42:20 We have the problem where it's often not enough room to

07:42:24 walk, definitely, not room for a stroller, or whatever.

07:42:29 >> We do have very large sidewalks.

07:42:33 >>MARY MULHERN: What are the sidewalk widths?

07:42:38 >> Bart French: It's about 257 feet from the edge of the

07:42:42 right-of-way into where the building starts.

07:42:46 So we have got -- there's actually a colonnade that extends

07:42:50 about eight feet from the edge of the building into where

07:42:53 the retail actually starts.

07:42:54 And you have some covered walkway there as well to blend in

07:42:58 with the sidewalk out there.

07:43:03 >>CHARLIE MIRANDA: Any other council members at this time?

07:43:10 I'm sorry, Mrs. Montelione?

07:43:13 >>LISA MONTELIONE: In looking over Ms. Myer's e-mail, often

07:43:18 people put the thing that pops into their head first, you

07:43:21 know, on the top of the list.

07:43:23 And the number one item here is pets.

07:43:29 And could you address, are there areas within the project

07:43:34 for dog walking?

07:43:37 >> Certainly, I can address that.

07:43:41 It's not an insignificant number of our residents that have

07:43:45 pets, particularly dogs, throughout our communities across

07:43:48 the country.

07:43:51 And what we have done to help clean things up, so to speak,

07:43:56 what thrill have little pet wait stations at every point of

07:44:03 egress out the building so people can pick up after their

07:44:06 pets.

07:44:06 >> But there's no dog walking area?

07:44:11 I mean, I was at Channelside recently, and even rooftops

07:44:14 they have a dog walking area.

07:44:16 >> So we have a couple -- obviously it's an urban

07:44:23 development.

07:44:24 So we are maximizing the building cover around the land.

07:44:28 But we do have a couple of areas of green space on-site.

07:44:33 Namely this area between our building and the diagnostic

07:44:37 center that's at the hard corner of Swann and Howard.

07:44:41 So we have a couple of areas of egress in this side of the

07:44:46 building.

07:44:46 And so a number people probably come out here and walk their

07:44:50 dogs in this area.

07:44:51 And then back along the garage, we do have some green space

07:44:55 along the side and along the back in this area back here

07:44:58 that, you know, we made this available for residents that

07:45:02 doesn't mean --

07:45:04 >> Are they designated? Because I have been to places where

07:45:06 it has little signs, designated dog walking area.

07:45:10 >> We'll have signage for that.

07:45:12 But obviously we'll put waste stations out there as well.

07:45:21 >>CHARLIE MIRANDA: I think Julia Cole wanted to make a

07:45:23 statement.

07:45:23 >>JULIA COLE: Legal department.

07:45:28 As was stated, and Mr. Mechanik did state when he submitted

07:45:31 the proposed new conditions to be placed on the site plan,

07:45:35 Abbye Feeley has not had an opportunity, staff has not had

07:45:39 an opportunity review those revisions.

07:45:41 And your code is very specific on changes being made after

07:45:44 site plans have been received by staff prior to them coming

07:45:47 to your hearing, so where we are negotiating these things on

07:45:51 the record or trying to figure them out by chicken scratch.

07:45:55 What your code says is if it's a minor site plan to either

07:45:58 test or the actual graphic on the code, then we can go ahead

07:46:02 and go forward that evening, if you read it on first reading

07:46:05 and those changes can be made between first and second

07:46:08 reading.

07:46:08 However, if the changes that are proposed are substantial,

07:46:12 then per code it requires a four-week continuance at first

07:46:15 reading to allow staff to review those provisions.

07:46:22 Abbye has taken a few minutes Tom at least kind of have a

07:46:25 first look at the conditions, and it is her position, and I

07:46:29 that agree with her that these changes are substantial and

07:46:31 will require a four-week continuance in order to move

07:46:34 forward with this proposal and the new conditions.

07:46:40 >>CHARLIE MIRANDA: Petitioner?

07:46:42 Thank you very much.

07:46:44 >>DAVID MECHANIK: We understand the position that the staff

07:46:46 is in.

07:46:47 They can't review.

07:46:49 I just want council to understand and staff, we really -- we

07:46:53 are left with no choice. We were only able to come to

07:46:56 agreement this afternoon.

07:46:59 >>CHARLIE MIRANDA: We are not saying that you did have a

07:47:00 choice.

07:47:01 But I think you understand now that council has very little

07:47:03 choice if any at all.

07:47:07 >>DAVID MECHANIK: I understand.

07:47:08 We just did our best.

07:47:09 But we understand the consequences.

07:47:10 Thank you.

07:47:12 >>CHARLIE MIRANDA: Okay.

07:47:15 In Ms. Cole, do you then suggest this petition be held for

07:47:19 four weeks?

07:47:20 >>JULIA COLE: Yes, I would recommend you go ahead and

07:47:21 continue this case for four weeks to the next night meeting,

07:47:24 June 14th.

07:47:30 Hold on, Abbye.

07:47:32 I am going to recommend that you don't take testimony that

07:47:34 the point in time because the plan may change and we don't

07:47:36 know, there may have to be some discussions between staff

07:47:39 and the applicant and what you might have at that point in

07:47:41 time might be somewhat different.

07:47:43 Thank you.

07:47:43 >>CHARLIE MIRANDA: I understand.

07:47:44 Any other comments by council at this time?

07:47:45 Ms. Mulhern?

07:47:47 >>MARY MULHERN: If we are going to continue this, I would

07:47:49 like to suggest that the concerns expressed in this letter,

07:47:54 especially the ones that Councilwoman Montelione mentioned,

07:47:57 and I did, too, about the green space, you have the

07:47:59 opportunity to see if you can find some more green space

07:48:03 area when you come back.

07:48:06 >>LISA MONTELIONE: I didn't ask this question earlier, but

07:48:15 maybe you did when I left the room, but were there meetings

07:48:19 with the neighborhood association and with the residents in

07:48:22 the area?

07:48:27 Were there meetings between --

07:48:30 >>DAVID MECHANIK: Yes, we met with two neighborhood groups

07:48:32 as well as -- actually, three neighborhood groups, as well

07:48:36 as the commercial business owners.

07:48:38 >>LISA MONTELIONE: And I know we have the letter in support

07:48:43 and the e-mail that said if you make changes they'll

07:48:45 support.

07:48:49 One of the points that Ms. Myer brings up in her e-mail is

07:48:52 the residents have worked really hard to make that

07:48:54 neighborhood desirable which is why you want to place your

07:48:57 project there, and, you know, perhaps don't want to say

07:49:04 concessions, but some accommodations of the neighborhood

07:49:08 might work.

07:49:09 And if there are others, I encourage if you are watching to

07:49:13 contact Mr. Mechanik and maybe work those items out.

07:49:20 >>DAVID MECHANIK: Thank you.

07:49:21 >>CHARLIE MIRANDA: Mr. Cohen?

07:49:22 >>HARRY COHEN: Just for the record, the e-mail that

07:49:24 everyone is referring to I believe is in the quasi-judicial

07:49:27 box and was sent to all council members, I think today,

07:49:31 actually.

07:49:35 Ms. Cole, is it appropriate to make any comments regarding

07:49:37 this project now, or should we wait till next week?

07:49:40 >> If you have any particular questions regard Waugh heard,

07:49:47 but if it's going to be generalized comments relating to

07:49:50 approval or disapproval, I would be cognizant of the fact

07:49:53 that that you may get a site plan or some notes that are

07:49:56 somewhat different.

07:49:56 >>HARRY COHEN: I just want to make one comment, and this is

07:50:03 to second what Ms. Mulhern was saying about the parking

07:50:07 situation on this particular block.

07:50:09 I had the same experience she's had.

07:50:12 I live in that area.

07:50:14 And the parking right now is very, very tight.

07:50:16 So, you know, anything we can do to mitigate that problem

07:50:22 between now and the next evening meeting I think would be a

07:50:26 good idea.

07:50:28 >>CHARLIE MIRANDA: Any other council members?

07:50:29 >> June 14th.

07:50:36 >>CHARLIE MIRANDA: Need a motion for --

07:50:38 >> June 14th at 6 p.m.

07:50:41 >> Motion by Mr. Cohen, second by Mr. Suarez on this item.

07:50:46 Z-12-15 for June 14th at 6:00.

07:50:50 That's item number 5 on the agenda.

07:50:51 All in favor of the motion please indicate continue to that

07:50:54 date.

07:50:54 Please indicate by saying aye.

07:50:57 Opposed nay.

07:50:59 Motion passes unanimously.

07:51:05 Okay.

07:51:05 We go to item number 6.

07:51:07 >>ABBYE FEELEY: Land Development Coordination.

07:52:02 Item 6, Z-12-107 located at 3107 north 50th street, and

07:52:09 the request before you is for a special use for professional

07:52:12 residential facility.

07:52:14 The zoning is CI commercial intensive.

07:52:24 This property is for a special use in 2000 for a residential

07:52:30 facility, professional residential facility.

07:52:34 And in 2000 it was granted 115 beds.

07:52:37 As you know, with special uses, they are allowed some minor

07:52:41 modifications after they are approved.

07:52:43 The request buff tonight allowable modifications that can be

07:52:49 achieved administratively as part of the reason why we are

07:52:52 back before you.

07:52:54 The request is to increase number of beds from 115 beds to

07:52:58 176 beds, and also allow for an 8,565 square foot expansion.

07:53:07 The site is surrounded by commercial to the north and south,

07:53:11 50th street to the west, and commercial and I-4

07:53:14 interstate 4 to the east.

07:53:15 The proposed as I stated modification exceeds that, which

07:53:20 can be approved administratively.

07:53:29 We will go ahead and show you the property. It is shown

07:53:31 here in green.

07:53:32 As you can see, the CI commercial intensive zoning really

07:53:35 wraps around the property to the north and to the south.

07:53:42 There is a little bit of RN 16.

07:53:45 A 50th street is to the west.

07:53:47 There is some RN 16 that kind of meets 50th

07:53:51 predominantly CGRO-18 and CGI down to the south.

07:53:58 There is one waiver.

07:53:59 So -- I'm sorry, there are a couple of waivers associated

07:54:03 with the application tonight.

07:54:06 Three of those waivers were previously granted under the

07:54:08 special use that was approved for the property in 2000, and

07:54:12 this is to allow the reduction in the drive aisle from 26

07:54:15 feet to much 24 feet to allow for parking in those areas as

07:54:21 illustrated on the plan and to allow for distance separation

07:54:23 reduction from another residential facility from 2,000 to

07:54:29 1790 feet.

07:54:33 That facility is owned by the applicant which is here this

07:54:38 evening.

07:54:38 The new waiver is a parking waiver, one parking space from

07:54:42 45 spaces to 44 spaces.

07:54:53 Here is the aerial of the property shown here in yellow.

07:54:57 On your site plan you will see that the proposed addition is

07:55:00 going to come out of the existing building to the west here,

07:55:06 shown on your plan here, and then am square footage to the

07:55:12 east here.

07:55:14 They are also going to be enclosing some areas to the south

07:55:16 of the existing building here.

07:55:19 And creating some parking spaces in this location here.

07:55:24 Access will remain the same.

07:55:28 Traffic flow and configuration.

07:55:35 This is a picture of the existing facility.

07:55:41 This is from the entryway.

07:55:43 This is from the southwest corner looking back.

07:55:46 This is from the entryway looking east.

07:55:55 Some pictures of that existing grass parking that's there.

07:56:00 The entrance looking north.

07:56:04 Tampa entrance looking back toward 50th.

07:56:08 This is the property to the south.

07:56:11 This is another view across 50th to the northwest.

07:56:15 And 50th to the southwest.

07:56:23 There are some site plan modifications that need to be made

07:56:26 in between first and second reading.

07:56:28 Many of these were given at the BRC.

07:56:32 Not sure what happened.

07:56:33 They were not incorporated onto the site plan.

07:56:35 I have provided those to you on a revision sheet.

07:56:40 And on page 7 of your staff report I did provide the special

07:56:46 use criteria for professional residential facility.

07:56:51 The first is that 2,000 feet which the waiver is being

07:56:54 requested.

07:56:59 Because it's at 1700.

07:57:02 The second is it should not be established within 1200 feet

07:57:05 of a congregate living facility.

07:57:09 It is not a standard has been met there.

07:57:11 Shall be no external evidence of such use that standard has

07:57:13 been met.

07:57:14 And lastly -- I'm sorry, two more -- the standards of the

07:57:18 state Department of Health and rehabilitation services and

07:57:22 state department of correction shall be met.

07:57:23 And lastly that the site plan must thoroughly describe the

07:57:27 type of treatment and security that will be provided at the

07:57:30 facility.

07:57:31 There was a notation on the previous plan that I need to

07:57:34 carry forward on that one, really to the security and we'll

07:57:37 handle that between first and second reading.

07:57:39 Staff available for any questions.

07:57:40 >> Staff?

07:57:46 Thank you.

07:57:47 Petitioner?

07:57:47 >> Rebecca Johns, 201 North Franklin Street suite 2000 here

07:57:55 on behalf of the petitioner and I have been sworn.

07:57:58 I will be very brief.

07:58:01 Not to rehash what Abbye has said.

07:58:03 But this is merely an extension. Special use permit.

07:58:09 This is the existing building.

07:58:15 Here in the green is the new building that they want to

07:58:17 build for administrative offices meeting area.

07:58:20 There will be no beds in this new area but they will be

07:58:23 moving some of the administrative and then adding the new

07:58:27 beds in the old building.

07:58:30 And the basketball court, and like she said, it's enclosing

07:58:34 a little bit of the existing building.

07:58:38 It is in compliance with section 27-272 which is the

07:58:46 professional residential facility, special use criteria,

07:58:50 other than the existing waiver.

07:58:53 Everything else is in compliance.

07:58:54 The petitioner is here, and the engineer is here, if you

07:58:57 have any questions.

07:58:59 >>CHARLIE MIRANDA: Any questions by council members at this

07:59:00 time?

07:59:02 Mr. Reddick?

07:59:03 >>FRANK REDDICK: Thank you, Mr. Chairman.

07:59:06 One located at -- at 50, is this the one?

07:59:15 >> Yes, sir.

07:59:15 >> Isn't it 50th and Columbus?

07:59:21 >>FRANK REDDICK: Isn't it at 50th and Columbus drive?

07:59:24 >> I'm sorry, this is not my file.

07:59:30 I don't really know.

07:59:32 >>CHARLIE MIRANDA: We almost figured that out.

07:59:36 50th and 21st.

07:59:37 >> 50th and 21st.

07:59:41 Residential facility.

07:59:44 >> I need your name for the record.

07:59:45 >> I'm Mary Lynn Olry, 3612 west Santiago street, Tampa, and

07:59:51 the CEO.

07:59:53 >>FRANK REDDICK: 50 and 21st Avenue?

07:59:56 >> No, 21st -- it's about four blocks north of I-4.

08:00:06 >>FRANK REDDICK: Right, right.

08:00:07 And the reason I raise the question is I thought 50th

08:00:11 and Columbus, because I see where they have a neighborhood

08:00:19 association, and Oak Park is across Columbus where they

08:00:27 wouldn't be the direct association that is affiliated with

08:00:31 this location.

08:00:32 >> We sent the notice to the neighborhood association that

08:00:36 was provided to us by the city.

08:00:38 So I don't really know.

08:00:40 >>FRANK REDDICK: They are not in the boundary.

08:00:43 So they cross 50 and Columbus going south.

08:00:48 And that's the reason I was asking the question, was this

08:00:52 facility on 50 and Columbus.

08:00:54 On 21st.

08:00:55 >> Because of the change I actually met with Grant Park

08:00:59 neighborhood association with Ralph Johnson, and I met with

08:01:06 the Oak Park neighborhood association.

08:01:08 I actually have a letter actually supporting this, but I

08:01:12 didn't know that I D needed them for this.

08:01:16 It's not the neighborhood association we were given by the

08:01:18 city.

08:01:19 >>FRANK REDDICK: Right.

08:01:20 And I think you need to get with the neighborhood hills

08:01:24 college association because that will be directly reflected

08:01:27 to 21st and 50th.

08:01:29 But I just wanted -- I saw this, and that's why I wanted to

08:01:35 ask that question.

08:01:36 21st.

08:01:37 >> I apologize.

08:01:38 I just knew 50th street.

08:01:44 >>CHARLIE MIRANDA: Thank you, Mr. Reddick.

08:01:45 Any other comments by council members?

08:01:49 Tampa presentation, have you concluded with it?

08:01:51 >> We are done.

08:01:52 >>CHARLIE MIRANDA: Does anyone in the audience dire speak on

08:01:54 this item number 6, V-12-107?

08:01:59 Please come forward.

08:02:00 I see no one.

08:02:01 >>MIKE SUAREZ: Motion to close.

08:02:05 >>FRANK REDDICK: Second.

08:02:06 >>CHARLIE MIRANDA: All in favor of the motion?

08:02:08 Opposed?

08:02:09 The ayes have it.

08:02:42 >>CHARLIE MIRANDA: I have a second by Mr. Cohen on a close

08:02:50 >>THE CLERK: Motion carried with Mulhern being absent at

08:02:52 vote.

08:02:53 Second reading and adoption will be on June 7th at 9:30

08:02:55 a.m.

08:02:57 >>CHARLIE MIRANDA: Thank you very much.

08:02:58 Item number 7 has been taken care of.

08:03:00 And that will be heard on June 14th at 6:00 p.m.

08:03:04 We go to item number 8.

08:03:35 >>ABBYE FEELEY: Land Development Coordination.

08:03:37 Item number 8 is Z-12-14, located 2115, 2119 west

08:03:44 Hillsborough Avenue.

08:03:46 The request before you tonight is from CI commercial

08:03:49 intensive, CG commercial general, and RS-50 residential

08:03:54 single-family to CI commercial intensive.

08:03:56 This is a Euclidean zoning request, and there is no site

08:04:01 plan.

08:04:02 There are no waivers.

08:04:04 It must comply with CII standards.

08:04:07 And the underlying land use on the property allows for the

08:04:10 request to be made to be CI.

08:04:13 It is community commercial 35.

08:04:21 Here is the zoning atlas.

08:04:22 You can see the three districts I just told you.

08:04:26 They are CG on the southern southwest portion and the

08:04:31 southeast portion of the site.

08:04:33 There's CI right in the center of the site.

08:04:36 And then the one lot at the northwest corner, and the two

08:04:41 lots at the northeast corner are the residential.

08:04:50 The RS-50.

08:04:51 The RS-50 comes down here.

08:04:53 That RM-24 goes just to that block there but the RS-50 kind

08:04:57 of comes down here and goes into that's little notches

08:05:01 there.

08:05:02 The Sweetbay grocery store right here to the west.

08:05:07 The property we are talking about is the Paragon music site.

08:05:18 It is shown here.

08:05:19 There are several -- there's a large building on there.

08:05:23 I'll show you some pictures of that.

08:05:24 Immediately across this street there's a car wash here, at

08:05:28 the intersection here is that Macy's furniture outlet area

08:05:33 there.

08:05:47 Here is the property.

08:05:48 Kind of hard to get good shots across Hillsborough, and so

08:05:52 many cars.

08:05:53 This is also on the property on the west side.

08:05:59 To the east there's a new family dollar store.

08:06:10 This is the rear along Mohawk.

08:06:12 This is about the family dollar.

08:06:15 This is the rear of the existing property.

08:06:17 There is a wall there.

08:06:19 This is the car wash I referred to along the south.

08:06:24 Some residential along Mohawk.

08:06:27 That's a view of Mohawk looking west.

08:06:32 There is that retail use again.

08:06:38 The rear, moving down toward the Sweetbay.

08:06:43 So this is kind of the northwest portion.

08:06:47 There's where mop hawk goes into Sweetbay.

08:06:50 This is to the north along Mohawk.

08:06:55 There's a few others.

08:06:58 This site will need to be developed, all, but all parking.

08:07:01 There will be no waivers allowed when they go to permit

08:07:05 since it is a Euclidean zoning district.

08:07:08 And the site is 420 by 208 which is just over two acres of

08:07:17 which 25,000 is currently zoned CI commercial intensive.

08:07:23 I have provided you with the remaining requirements on pages

08:07:27 2 and staff found the request consistent.

08:07:29 >> Good evening.

08:07:38 Tom Park, 9801 Lila Avenue, Tampa, representing the owner.

08:07:42 I have been sworn.

08:07:43 And really I have nothing to add that staff hasn't already

08:07:47 said.

08:07:49 Any of you familiar with the property, there's four

08:07:50 buildings on the site.

08:07:51 The large one is used by Paragon Music.

08:07:57 The other three are pretty much in disrepair.

08:07:59 Even though it's not a PD, the plan is to raze three

08:08:06 buildings and construct one.

08:08:08 It will be about a 4,000 square foot smaller retail

08:08:11 building.

08:08:13 >>CHARLIE MIRANDA: Any questions by council members at this

08:08:14 time?
