06:08:59 I want to send the request to you and show you what we are
06:09:02 talking about in relationship to each other.
06:09:09 The rezoning request before you this evening is for
06:09:12 multifamily residential, and the vacating is here in the
06:09:26 middle, from Oregon to north Rome, in order to allow for the
06:09:29 project to function as one zoning.
06:09:32 The applicant will talk to.
06:09:34 That I just want to show you that we are talking about the
06:09:36 area in yellow with the vacating through the property along
06:09:39 the way.

06:10:46 I am going to give you a summary, very briefly, just -- with
06:10:52 the planning zone, because I have another function I have to
06:10:56 attend, but the cases are really to the Planning
06:11:01 Commission's finding of consistency.
06:11:03 We have found all five cases that will be before you this
06:11:05 evening consistent.
06:11:06 Also, five cases that will be before you this evening are
06:11:08 located within the central planning district, 50th
06:11:12 street, one located in the Seminole Heights area, two
06:11:14 located in the west bend area to the southeast of historic
06:11:19 neighborhood of West Tampa, and of course one in the SoHo
06:11:22 Planning Commission staff found all these requests before
06:11:25 you this evening consistent with the comprehensive plan.

06:11:53 As Abbye stated I am here on item number 1, in conjunction
06:11:57 with the zoning contingent upon zoning getting Approved. It
06:12:10 runs from Oregon to Rome Avenue.
06:12:14 The petitioner owns property Gray Street, Rome, an improved
06:12:25 right-of-way. This is a photo looking east.

06:13:35 Transportation and solid waste is requesting that a
06:13:37 transportation easement be reserved on this portion right

06:13:49 Staff has no objections as long as the drainage and

06:14:12 The request for rezoning this evening that's before you is
06:14:15 from IG industrial general, PD planned development and PD
06:14:21 planned development alternative to PD planned development
06:14:24 for residential multifamily.
06:14:25 It is to construct 311 multifamily residential units.
06:14:33 With surface parking.
06:14:34 If I can just give you a little bit of history on this
06:14:37 property, I'm not sure that any of you on council, when we
06:14:44 rezoned this back in '06.
06:14:46 It was -- this was what we refer to as west end phases one
06:14:51 and two.
06:14:53 It spans several blocks, and constructed today from town
06:14:59 home Tierra, done PDA so those lots could be development
06:15:06 The properties to the south and including was PD planned
06:15:11 development, not reflected on phase two.
06:15:13 That was a 2007 rezoning.
06:15:16 What this request buff tonight is doing is pulling these
06:15:19 blocks out of both of those projects and creating its own
06:15:23 new PD, planned development, so that site plan for the
06:15:30 project they are requesting 311 units, and I will go through
06:15:34 the waivers that are being requested this evening, as well
06:15:37 as the planned specifications.
06:15:46 Sometimes you will see me show you what was previously
06:15:50 approved as far as these projects, and then what is being
06:15:53 proposed today.
06:15:54 I did not do that in this report because the waivers that
06:15:58 were granted on both of those were really independent to the
06:16:00 projects that went on, and I do have both plans here, for a
06:16:06 point of reference if you wanted to know what went there,
06:16:08 but I really treated this as a new independent application.

06:16:19 Everything was structured parking on those projects.
06:16:23 What we refer to mostly as that have the drives around the
06:16:30 units is out there.
06:16:33 So there was not any surface.
06:16:41 The property is mostly vacant.
06:16:43 There are some industrial uses.
06:16:44 I can show you some pictures of Rome.
06:16:49 Some of them, it's really hard to put into perspective.
06:16:52 The character of the area is more of a transitional type of
06:17:02 Let me put up the zoning atlas.
06:17:06 As I first that west end phase one went all the way from
06:17:09 cypress down to the south side of Carmen, and that PD phase
06:17:15 two picked up and then came over as far west as Fremont and
06:17:21 went down a little bit further.
06:17:31 What I did in my photos is I started here at the corner of
06:17:35 Cass and Oregon, and I kind of went down and around, came
06:17:39 down Fig, went back up.
06:17:40 I had some shots looking both ways.
06:17:43 Most of it, as I said, of course, is vacant.
06:17:48 So It's a little bit difficult.
06:17:52 There are industrial and commercial uses along Oregon.
06:17:57 This is our way down Oregon.

06:19:53 white building I just showed you, with the little

06:20:12 I think that gives you a little flavor for where we are.
06:20:24 There are eight waivers that are being requested tonight
06:20:29 with this project.
06:20:31 The first is to reduce the vehicle use area green space
06:20:34 requirement from 20% to 11.5%, totaling 11,763 square feet.
06:20:42 The second is to reduce the required multifamily green space
06:20:45 from 350 square feet to 108.5 square feet a unit for a total
06:20:55 Square feet.
06:20:56 The third is to reduce the vehicle use area buffer from
06:20:59 three foot to zero foot, so that portion as shown on the
06:21:02 plans to the northwest, building number 3.
06:21:08 The fourth is to 2005 required 50% tree retention to allow
06:21:12 for 100 percent tree removal with exclusion of the grand oak
06:21:16 on the northern block which is shown to be retained.
06:21:19 To reduce the required number of parking spaces from 548
06:21:23 spaces to 388 spaces.
06:21:27 The sixth is to allow tandem parking where the garages are,
06:21:31 and where adequate drive aisle space is provided.
06:21:35 You would have a single car garage with surface outside of
06:21:41 the garage.
06:21:42 The reduced drive aisles from 26 feet to 24 feet and the
06:21:47 request is to reduce the loading berth from three to zero.
06:21:51 As I stated, the 7.63-acre site was previously rezoned at
06:21:57 phases one and two.
06:21:59 It is before you this evening for a request for 311
06:22:01 multifamily dwelling units within -- this would be contained
06:22:06 within seven three-story buildings with surface and some
06:22:10 garage parking.
06:22:12 The proposed building setbacks are zero feet and the maximum
06:22:15 building height is proposed at 55 feet with allowed
06:22:20 encroachment. The required amount of parking is 548 spaces
06:22:23 and 388 spaces are being provided with a waiver being
06:22:26 requested for the deficit.
06:22:28 The property is located within the West Tampa overlay
06:22:31 district, and there are no waivers being requested for that
06:22:34 this evening.
06:22:35 The site has committed to comply.
06:22:38 On pages 4, 5, 6 and 7 of my report, you will see that there
06:22:46 are modifications that need to be made in between first and
06:22:50 second reading.
06:22:51 I have been in discussions with the applicant concerning the
06:22:54 revisions, and they are amenable to make them in between
06:22:59 first and second reading.
06:23:02 Also, furthermore, the remaining pages might have report go
06:23:08 through the PD plan criteria. A little bit different of
06:23:15 configuration. They did have some retail use as well.
06:23:18 There's no retail being proposed this evening.
06:23:20 This is strictly a residential project. I did find it
06:23:24 consistent with the PD criteria. I also provided with you
06:23:26 the waiver criteria on page 9 of your report and some goals,
06:23:30 objectives and policies in the comprehensive plan on page
06:23:35 Lastly, transportation here this evening.
06:23:39 There is a 29% parking waiver being requested on the site
06:23:43 plan, in association with the vacating, and in association
06:23:49 with the applicant's request.
06:23:51 There have been some discussions with city staff as far as
06:23:54 providing some on-street parking.
06:23:56 There are notations on the site plan that speak to that
06:23:59 on-street parking, and that it is conceptual in nature.
06:24:03 If this property were entitled the applicant would have the
06:24:05 opportunity to go through the right-of-way permitting
06:24:07 process to configure those spaces, review and approval of
06:24:12 the city.
06:24:13 So they are not out there today.
06:24:15 That would be something that would happen afterwards.
06:24:18 As you well know, what we have -- when we have on-street
06:24:22 parking that cannot be counted as parking for the project so
06:24:26 that is not contained in the parking calculations, and that
06:24:30 is why the waiver, we always take care of the waiver as if
06:24:35 those do not exist. So that is partially why the waiver is
06:24:38 down to the 388 in order to identify what is currently
06:24:41 proposed on the property without any right-of-way parking.
06:24:46 That being said, staff is available for any questions.

06:25:41 >>> Good evening, Mr. Chairman, council members.
06:25:51 My name is David Mechanik, 305 South Boulevard, Tampa,
06:25:55 I'm here on behalf of polly shores partners, the applicant
06:26:01 for the three requests you have before you this evening.
06:26:05 At this time, I would like to introduce Mr. Anthony Everett,
06:26:10 with Pollack Shore partners, and he will provide you with an
06:26:17 overview of the project and then I will get back up and
06:26:19 speak about some of the technical issues regarding the
06:26:22 >> What I would like to do is pass out a printed version of
06:26:29 the PowerPoint that Mr. Everett is presenting to council.
06:26:32 >> I'm Anthony Everett, 5000 Bayshore Boulevard, Tampa,
06:26:49 First I would like to speak to the prior petition for a
06:26:52 second about the vacating.
06:26:53 We normally would not have a request to vacate.
06:26:56 We normally try to build within the block grids that we
06:26:59 have, and it's for us to maintain the block grids, but in
06:27:03 this area the blocks are so narrow that we cannot get a
06:27:07 configuration that is feasible to build, and I think when
06:27:10 you see the surrounding PDs that were done on this, that
06:27:15 he were done at a time when people were not really being
06:27:18 realistic about development.
06:27:22 It's a very aggressive project, it struggled significantly
06:27:25 financially for many years, and would you not be able to
06:27:28 build that same project today.
06:27:29 And so again normally we would not want to try to vacate a
06:27:34 block that we could not configure out configuration that
06:27:37 made any sense from an economic standpoint without having
06:27:40 surface parking and without vacating streets. Anyway, let
06:27:44 me tell you a little about us.
06:27:45 Pollack Shores is an Atlanta based company, was formed in
06:27:51 2006 by a group of multifamily executives who collectively
06:27:55 had more than 100 years of multifamily experience.
06:27:57 Group has been involved in development of multifamily and
06:28:01 management of more than 60,000 units.
06:28:03 And I personally have been involved in developing over
06:28:06 20,000 units in the State of Florida.
06:28:09 Our current portfolio is about 3,000 units and these
06:28:14 properties are located in Atlanta, Nashville, Orlando,
06:28:17 Currently have two properties in Tampa.
06:28:18 We would like to expand in Tampa, if we can find the
06:28:22 opportunity to do so.
06:28:24 Many of you do not know me but I'm a long-time Tampa
06:28:27 My great grandparents settled in Ybor City, in the late
06:28:33 We have been here and tried to be a part of this community
06:28:36 for many years.
06:28:37 We always try to promote Tampa in our neighborhoods and I
06:28:40 have always built quality projects, and this project will
06:28:43 keep to that standard.
06:28:44 I think if you go out and look at any of the projects I have
06:28:47 been involved with, we have always tried to maintain a high
06:28:49 level of standard with landscaping and quality materials
06:28:54 that are first class.
06:28:56 And I think you will be very proud to see what we plan to
06:28:58 propose on the site.
06:28:59 In looking at the neighborhoods, we try to Councilwoman a
06:29:02 project, we fit into the character of the neighborhood, and
06:29:06 AP warehouse district so you can see our elevation.
06:29:08 Some of them are multi-unit in design.
06:29:13 And we try to use standards and traditional development
06:29:16 standards which the city is, I guess, planning to embrace
06:29:18 for this west end area and we think that's a great plan for
06:29:23 the city to try to master plan this area, being so close to
06:29:27 downtown, we think it's a scenario that can really help the
06:29:32 engine of growth for Tampa's downtown, and having more
06:29:35 housing close to downtown would be a great thing.
06:29:39 You look at our site plan.
06:29:40 We have a series of buildings that are built around the
06:29:45 The overlay district requires to us shield the parking with
06:29:47 the buildings, and we do that.
06:29:49 We have three story buildings in our north block.
06:29:52 We actually have only half of this block.
06:29:54 And on this part of this block we plan a linear park.
06:29:58 That linear park will remain open forth to the public.
06:30:03 The developer made a commitment total neighbors to keep the
06:30:05 park opened, and the neighbors have got asked me to make a
06:30:12 commitment, to leave that park open, and we are willing to
06:30:16 In a we end up with security issues we are going to work
06:30:18 with our neighbors to try to figure out ways to address the
06:30:20 security issues.
06:30:21 We are going to join the neighborhood watch, be part of the
06:30:23 North Hyde Park association, and we are going to do what we
06:30:26 can to try to help the neighborhood.
06:30:28 This parcel is Mr. Saavedra's warehouse.
06:30:35 We do have a lot right here that's going to be the subject
06:30:37 of the next rezoning petition.
06:30:39 And as part of our plan, we are going to improve that lot
06:30:43 for Mr. Saavedra.
06:30:49 We have joint access for Gray Street and we are going to
06:30:52 make, and additional landscaping around this property.
06:31:03 One of the challenges we face is just not high enough to
06:31:09 justify the parking garage nor the building of a building
06:31:14 that's higher than four stories.
06:31:15 And that's really why we ended up having to ask for the
06:31:18 parking waivers, because we needed to do a surface park
06:31:23 We wanted to incorporate ULI standards and having a walkable
06:31:27 community that had streetscapes, and great public access,
06:31:30 you know, to our project.
06:31:32 So some of our units have Brookstone type stoops -- I'm
06:31:39 sorry, Brown stone type stoops that access directly to the
06:31:42 street from the unit.
06:31:43 We plan a streetscape that would have -- there's no lighting
06:31:47 out there right now so we would plan streetlights much like
06:31:50 you see in southern Hyde Park.
06:31:53 Two of the challenges we face are really the parking code
06:31:56 and green space code.
06:31:57 We agree adequate parking is very necessary, and in most
06:32:02 multifamily urban in-fill projects, a parking ratio of one
06:32:06 parking space per bedroom is what you would strive to
06:32:11 While we don't have all of our parking on-site we do have
06:32:15 currently 93 spaces planned for the street, and we do have
06:32:20 preliminary agreement William city staff to do, once we get
06:32:24 our permit, to do a maintenance and use agreement that will
06:32:27 allow us to maintain that parking to build and maintain at
06:32:30 our cost, and to have that parking available to the public
06:32:33 for as long as our project is there.
06:32:35 Now, we know we cannot count that parking towards our
06:32:38 requirement, but we want to you please consider mitigating
06:32:40 factor, and we believe that that will be great guest
06:32:45 parking, that we have adequate parking for our residents.
06:32:47 The green space requirement is a requirement, 350 square
06:32:53 feet per unit, really a requirement that we see in a
06:32:55 locality of suburban areas.
06:32:57 You know, when you are developing in urban areas it's very
06:32:59 difficult to find enough land, 3 -- 350 square feet per unit
06:33:05 in green space.
06:33:06 And in other municipalities, they actually count hardscape
06:33:11 toward the green space open requirement, and that's to
06:33:13 encourage court yards like we have, you know, maybe
06:33:17 sculpture or public art work, different things than just
06:33:21 open green lawns, and so the request for the green space
06:33:26 waiver was because we were not able to meet the 350 square
06:33:29 feet per unit.
06:33:30 We believe we are going to have a very high quality project
06:33:32 with lots of urban green space, and as much as we could
06:33:36 possibly have, we won't meet the amount indicated --
06:33:40 actually, we'll see the amount indicated in the waiver as
06:33:43 much as we can.
06:33:45 Anyway, I would like to try to run you through some of our
06:33:49 elevations here.
06:33:51 If we go to the PowerPoint presentation.
06:33:55 So this is looking down from the corner -- let's see, that's
06:34:03 the corner of Carmen and Rome looking east.
06:34:07 On the top.
06:34:08 On the bottom, that is our leasing -- I'm sorry, that's
06:34:15 looking back to the south towards Rome.
06:34:19 Here is the aerial view of the projects.
06:34:24 The corner down at the bottom of the picture is our leagues
06:34:28 That's a four-story building.
06:34:30 And the building directly to the east of that, to the right,
06:34:32 is a three-story townhouse building.
06:34:36 The next building is a three-story townhouse building.
06:34:38 The next donut, if you will, is a three story building.
06:34:42 And then the buildings on the north block are three stories.
06:34:46 It's just another view of the project looking to the
06:34:50 southeast from Rome.
06:34:57 Some of our buildings are under garages, and in behind some
06:35:02 of those garages we do have an area where we can do some
06:35:05 tandem parking if you allow it, and what we have done in the
06:35:08 past and we have committed to the city, we didn't
06:35:11 actually -- it wasn't made a requirement of our petitions,
06:35:15 but we are willing to commit to a restriction.
06:35:21 If the parking behind the garage can only be used by the
06:35:25 person who leases that garage.
06:35:28 And we put up signs for that, and we found in other projects
06:35:32 that we have done the tandem parking on Harbor Island and
06:35:36 other places that we need to lease that -- that tandem space
06:35:40 needs to be used by the person who is leasing the garage
06:35:42 because obviously if somebody parks behind it they can't get
06:35:46 We also have a restriction that the garage must be used for
06:35:49 vehicular parking only.
06:35:51 And so it can't be used for storage.
06:35:53 And we have storage, you know, closets on-site that we do
06:35:58 lease to our residents for them to use for storage.
06:36:01 So we have a prohibition for storage.
06:36:05 Just another elevation building.
06:36:07 That shows you a couple of the stoops we have on the upper
06:36:11 This is the three-story building, looking down, on the top
06:36:15 it's looking down on the Carmen side and this linear park
06:36:20 that I was talking about across the street will look
06:36:22 directly into this opening.

06:38:01 additional parking in the neighborhood.

06:42:13 I just wanted to state, also, the on-street parking that Mr.
06:42:17 Everett is talking about would be constructed and maintained
06:42:21 at Pollack Shores' expense, and we fully understand the
06:42:26 administrative costs that we have to go to, and we have
06:42:29 every confidence that we can satisfy the code requirements
06:42:32 for providing the spaces.
06:42:35 So that's why we are asking council to at least consider the
06:42:39 existence of those spaces, not withstanding that you can't
06:42:43 consider them on-site parking.
06:42:46 Finally, I would just like to say in support of our
06:42:49 waivers -- and I think Mr. Everett already articulated
06:42:53 this -- but this is a very urban development.
06:42:57 It's very consistent with the kind of standards recommended
06:43:00 by am ULI, and I would just like to mention one of the
06:43:04 specific items in the ULI report that the City of Tampa
06:43:08 received, is to consider reducing parking requirements, in
06:43:15 order to facilitate more urban development, to promote
06:43:21 transit usage, and frankly foot traffic.
06:43:23 And so we are hoping that you view this project as
06:43:28 consistent as those standards, and the urban nature of this
06:43:33 project really is the justification for all of the
06:43:37 particular waiver requests we have asked for this evening.
06:43:40 And with that, we'll answer any other questions.

06:45:07 major freeway, and that's how a lot of members go back and

06:45:13 And you traveling there, that same street for 20, 30, 40
06:45:19 years and all of a sudden it's going to be blocked off,
06:45:27 that's a lot of unfamiliar obstacles.
06:45:30 And in doing so, it makes it difficult for the elderly to
06:45:35 commute back and forth to church.
06:45:37 I'm not saying that it's a bad idea.
06:45:41 For land development to progress.
06:45:43 But I'm saying that maybe we need to take into account that
06:45:48 Gray Street, they should look off instead of on.
06:45:59 I also have a petition here.
06:46:06 With 78 church members on it saying that they want you to
06:46:09 reconsider, or at least give them an opportunity to come
06:46:11 down also and speak on behalf of it.

06:48:09 And then if we did do traffic counts, our traffic engineer
06:48:13 can count to you, were done in the streets, because I
06:48:16 believe there's minimal traffic being used on the streets
06:48:20 And so certainly we are concerned with our neighbors.
06:48:22 We want to work with our neighbors.
06:48:24 And we even -- the city has even asked us to enhance, put a
06:48:31 sidewalk in, and put a curb cut in on the right-of-way in
06:48:34 front of the lot that they own next to us which they use for
06:48:37 But without vacating Gray Street, our project is not
06:48:42 >>MARY MULHERN: Why couldn't you have drawn something --
06:48:48 when I look at this picture, I just see parking.
06:48:51 What else are you gaining if you close -- if we vacate that
06:48:55 >> Well, the shape of that building, the donut building,
06:48:58 even though it doesn't look like it encroaches, there are
06:49:03 utilities that are near the portion of the building that
06:49:06 need to be relocated further south.
06:49:10 The access in, Gray Street across, the city code on drive
06:49:15 aisle widths and just parking counts period, the parking
06:49:21 count would drop probably by about 15%.
06:49:26 It's not that we really wanted to close Gray Street.
06:49:28 We couldn't come up with another way of building an
06:49:32 economically feasible project in this area.
06:49:37 >> Our parking requirements, because of our lack of transit
06:49:44 and because the way our code is written, they are pretty
06:49:47 strict, but I also feel that, you know, everybody likes to
06:49:50 talk about ULI and good urban design, but I think the grid
06:49:56 is really important part of urban design.

06:50:06 So I think to close down a public street, an entire block of
06:50:11 a public street, needs to be -- I would think it needs to be
06:50:17 a last resort.
06:50:18 >> And it absolutely was a last resort for us in the design
06:50:22 of our project. We went through many iterations on trying
06:50:25 to protect the grid.
06:50:27 And we could not come up with a plan that actually was
06:50:31 feasible to build.
06:50:32 And it's true, the blocks in that area, if you are going to
06:50:38 build, townhouse projects, fur going to build high-rise, you
06:50:43 know, which is not economically feasible, the other block is
06:50:48 zoned for high-rise, and so that block will be coming in at
06:50:51 some point if anybody tries to develop it for rezoning.
06:50:54 They are going face the same challenges that we did.
06:50:56 And so I think it will be a long time before you see
06:50:59 development in this area, if you are not allowed to do
06:51:01 surface parking projects, and I don't think that you can get
06:51:05 the economy to scale that you need without having a bigger
06:51:11 block pattern.
06:51:11 The vintage blocks, you look at their block, and it's a much
06:51:15 larger block, and really that's what we are facing, too.

07:08:25 As Tony did state, this is in the central planning district.
07:08:29 And the Planning Commission did find it consistent.
07:08:39 This site was previously rezoned in 2005 and much of what
07:08:45 you see on the site plan before you this evening is
07:08:47 identical to that with some modification.
07:08:54 The first item is the addition of the restaurant use.
07:08:57 There was not previously restaurant approved in this PD
07:09:02 zoning but we are adding that tonight.
07:09:04 The second is the surface parking area which is located at
07:09:07 the northeast corner and the southwest corners of the
07:09:13 There were surface parking areas that were not previously
07:09:15 there either.
07:09:18 I am going to go through now and talk about the parameters
07:09:21 of this project and also show you some photos and the zoning
07:09:27 This is the property located on swan, just south of Swann
07:09:32 and actually links up to Swann on Howard.
07:09:37 The building that's located at the southeast corner of Swann
07:09:40 and Howard Avenue.
07:09:46 The one waiver on the page of your site of your staff report
07:09:51 that you see was to allow replacement of trees since
07:09:54 existing trees were required for the previous development,
07:09:58 and that's really what happens when you have a plan.
07:10:01 And I'll show you some pictures of the site.
07:10:03 But most of those trees are trees that are in island and the
07:10:06 parking lot that were required at the time, that the first
07:10:09 shopping or the first development was placed there.
07:10:14 So all these trees you see here that will now be taken out,
07:10:18 since they are mitigated for the site one time, these trees
07:10:21 will be required to be replaced at an inch for inch.
07:10:27 The other waiver is waiver 2 through 7 are new waivers that
07:10:33 are being requested as a result of the application that is
07:10:36 before you tonight.
07:10:38 The other thing I wanted to say was, the Z 05-125, purchase
07:10:45 student 394, you get five years to substantially construct a
07:10:49 PD development.
07:10:50 Substantial construction is typically 50% of that
07:10:55 If this PD today, the Z 05 were to go into permitting, it
07:10:59 would be subject to codes that are in place today because
07:11:01 they have exceeded the five years for substantial
07:11:04 So some of the waivers that you see on the plan today are
07:11:08 waivers that are due now to codes that would be required to
07:11:11 comply with, such takes first one, to reduce the minimum
07:11:16 amount of landscape area for multifamily dwelling with
07:11:19 vehicular use from 350 down to 80 square feet.
07:11:23 The Z 05 had a waiver from 350 to 250, and at the time in
07:11:29 '05 there was no payment of fee in lieu required, so going
07:11:34 from 350 down to 80, but there will also be a payment in
07:11:38 lieu fee that will be required for that square footage which
07:11:41 is being waived.
07:11:42 The third is to reduce the special street set back from 46
07:11:46 feet to 41 feet, based on the proposed building location.
07:11:52 That was not on the previous plan, but given the location of
07:11:56 the previous building, it appears that that was granted.
07:11:59 Number 4 was section 27-242, to reduce the required number
07:12:03 of off-street parking spaces from 584 to 495.
07:12:08 >>MARY MULHERN: He there was no parking waiver granted on
07:12:10 the 2005 PD that currently is entitled on this property.
07:12:15 Number 5 is section 27-246 to allow reduction in the drive
07:12:19 aisle width from 26 feet to 24 feet.
07:12:24 Six is section 27-247 to reduce the required number of
07:12:28 loading berths from 3 to 2.
07:12:31 And the last is on those two loading berths that instead of
07:12:37 212 by 30 and 112 by 60, it's going to be 212 by 30 loading
07:12:44 The request before you this evening is for 235 multifamily
07:12:47 residential units and 137,125 square feet of retail,
07:12:53 restaurant and office uses, of which 9500 may be restaurant
07:12:59 with 2,125 square foot of outdoor patio.
07:13:04 The patio would be associated with the restaurant as well.
07:13:08 There's a 4.1-acre site, and it is surrounded by a mix of
07:13:13 multi-and commercial use as long South Howard Avenue.
07:13:16 The project will contain one four-story multifamily
07:13:21 residential building with retail restaurant and business
07:13:23 occupying the first floor along South Howard and potentially
07:13:27 some office 3,000 square feet along west swan.
07:13:31 There is integrated garage at the southeast corner of the
07:13:37 It was rezoned in 2005 for 248 units.
07:13:41 So this is 13 units less than what it is currently entitled
07:13:47 And the current rezoning request as to restaurant use and
07:13:50 makes other minor modifications including surface parking
07:13:52 along the southwest and northeast corners as I previously
07:13:57 The PD setbacks are proposed at 10-foot north, south, east
07:14:01 and west.
07:14:02 A maximum building highlight of 60 feet.
07:14:05 And the garage not to exceed 55 feet.
07:14:07 That not to exceed 55 was carried over from the 2005
07:14:13 Based on the configuration being requested, 584 spaces are
07:14:17 required and 495 spaces are being provided.
07:14:20 This is a 15% waiver that's being requested.
07:14:24 No waivers are being requested to the South Howard overlay.
07:14:28 They are committing to comply.
07:14:31 Based on staff's review, there are some minor site plan
07:14:34 modifications that still need to be addressed.
07:14:38 I have identified those for you on pages 2, 3 and 4 of your
07:14:42 staff report, as well as provided the purpose and intent of
07:14:48 the PD on pages 5, 6 and 7 and some comp plan policies on
07:14:52 pages 8 and 9.
07:14:55 I will go ahead and show you some pictures of the property.
07:14:57 I did provide you a revision sheet which outlines the
07:15:01 modifications that need to be made.
07:15:03 There was one handwritten in there.
07:15:07 Right now, the current plan shows a sidewalk that runs
07:15:11 around the perimeter of the parking garage.
07:15:13 The previous plan did not.
07:15:16 Previous approved PD does not have that so they are going to
07:15:20 remove some of that along the east.
07:15:22 That would be the Sweetbay grocery store side that will
07:15:24 allow them to bump up some of their green space, actually
07:15:28 bump up the waiver, not to 80 square feet but to 89 square
07:15:33 feet a unit.
07:15:34 So that modification would be addressed in the revision
07:15:39 sheet also.
07:15:40 So down from 350 to 89 square feet.

07:18:33 At this time I would like to ask Mr. French to give you an
07:18:38 overview of the project.
07:18:39 And then I will speak to have some of the issues regarding
07:18:43 the staff reports and so forth.

07:18:57 We are excited about getting back into the development
07:19:01 As Abbye alluded to we were going to start this deal four or
07:19:05 five years ago.
07:19:06 Unfortunately, the economy didn't cooperate with us.
07:19:11 But we are happy to be back here talking to you all at this
07:19:15 Let me tell you a little bit about Post Properties before we
07:19:19 start on the development.
07:19:20 We are a publicly traded trust based out of Atlanta.
07:19:27 We primarily have assets in the southeast, Texas, and mid
07:19:31 Atlantic, approximately 23,000 apartment homes in those
07:19:36 markets, and we are typically a long-term holder.
07:19:42 Our business is to build a portfolio and grow it versus
07:19:48 build them to sell them.
07:19:50 So it's kind of an overview from Post Properties'
07:19:56 The deal in question, just to give you a quick overview, is
07:20:06 to orient you to the site.
07:20:07 So we have South Howard Avenue running north-south, and then
07:20:13 Swann Avenue is east and west.
07:20:15 What we have here is a four-story building.
07:20:20 On the front along South Howard, we have got the retail,
07:20:24 restaurant, and some of our amenities for the development.
07:20:29 With three floors of apartments up above.
07:20:31 And then along the back of what we call the donut here is
07:20:36 four stories of apartment units.
07:20:39 And then we have a structured parking garage that's just
07:20:42 under 55 feet. So it's five levels, four stories.
07:20:47 And then the first floor parking off of South Howard, and
07:20:54 then it's all one level at that point.
07:20:56 And then for the residential, you have access off of Swann
07:21:02 and there's a ramp that goes up to the second floor.
07:21:05 If you are familiar with Post Properties deals, they are
07:21:09 heavily landscaped.
07:21:11 You will want to create a walkable environment, in our
07:21:16 developments, if you are familiar with harbor place, that's
07:21:18 a good example of the types of deals we do.
07:21:23 Over half of our properties across the portfolio are mixed
07:21:28 use developments like this.
07:21:29 We have a lot of experience operating, developing and
07:21:34 operating properties such as this.
07:21:37 So that's kind of the overview.
07:21:40 This is actually a shot of the developments.
07:21:47 And if you are familiar with 717 south it's actually right
07:21:51 But this is the hard corner.
07:21:54 This is the old Inman drive so you are driving back to the
07:21:57 So we drips the FAP sad of the garage to look more like a
07:22:00 building and not an enlarge precast garage.
07:22:05 This is the hard corner where we are contemplating putting
07:22:08 And then in the middle we are looking at doing some of our
07:22:12 amenities, the leagues office, as well as our fitness
07:22:15 And then some retail down at the other hard corner.
07:22:21 And then this is the view off Swann Avenue.
07:22:26 So this centimeter four floors of apartment homes.
07:22:30 And then as alluded to earlier the residents will actually
07:22:34 access the garage off of Swann.
07:22:37 And there's a ramp that gets up to the second floor. So we
07:22:39 are separating the parking so that you don't have residents
07:22:43 and retail crossing over.
07:22:49 Let's see what else.
07:22:50 We have the one elevation.
07:23:01 And then last but not least is the elevation.
07:23:06 So St. Louis Howard Avenue.
07:23:07 So we are showing the retail out front here of how it would
07:23:17 So, Dave, do you want to talk a little more?

07:23:55 We have some letters from the park land civic association
07:23:58 indicating it has no objection to our rezoning request this
07:24:04 I am also providing a copy of an e-mail from Randolph
07:24:12 Merrill, also known as searing Merrill, indicating that he
07:24:19 represents a group of property owners, and I will explain
07:24:23 this now just a second, indicating that they also support
07:24:26 our request, if we make certain changes to our application,
07:24:31 and with your indulgence, what I would like to do is
07:24:36 describe those changes, and with all respect to Abbye, she
07:24:40 has not had a chance to see these.
07:24:43 We have been working with this group of property owners the
07:24:45 last week and a half, and we were only able to come to a
07:24:49 conclusion this afternoon literally right after 5:00 today,
07:24:55 and so what I would like to do is describe those changes to
07:25:03 As indicated by Abbye, we have requested a parking waiver.
07:25:13 This group of property owners basically are comprised of the
07:25:16 owners of the plaza where 717 restaurant is and Starbuck's,
07:25:21 the Panera bread and the retail there, and of course the
07:25:25 The owner of the CVS on the opposite, the northern corner,
07:25:30 and also I believe the owner. Blockbuster block on the
07:25:35 northeast corner of this intersection, which covers all the
07:25:39 corners of the intersection other than the subject property.
07:25:44 Those property owners were concerned about the impact of our
07:25:51 request for a reduction in the required number of parking,
07:25:55 specifically as it relates to the restaurant uses.
07:26:00 And while I would like to state for the record that we
07:26:03 believe that based on Post's experience round the country,
07:26:10 and in connection with the technical analysis that we did,
07:26:13 we were providing sufficient parking to accommodate all of
07:26:16 the uses on-site including the restaurants.
07:26:20 We were happy to make this accommodation to those property
07:26:24 owners in order that we could satisfy their concerns, and
07:26:31 they would in fact support the project.
07:26:37 So again I know that Abbye hasn't seen that, and this makes
07:26:42 for a little bit difficult situation here, but we would like
07:26:45 to present the additional corrections.
07:26:50 And by the way, we do agree with all of the correction and
07:26:53 changes which Abbye presented earlier, and we will make
07:26:57 those changes before second reading, should council approve
07:27:01 us on first reading here tonight.
07:27:03 But here are the changes.
07:27:04 And I should really emphasize that they are all designed to
07:27:10 reduce the demand on parking for our restaurant uses, and
07:27:15 therefore we are essentially narrowing the scope of our
07:27:22 waiver request.
07:27:24 So we are asking for less of a waiver than we were in our
07:27:27 original application.
07:27:29 So there are basically four conditions which are reflected
07:27:33 in that correction sheet.
07:27:36 One is that the indoor restaurant area would be no greater
07:27:40 than 8200 feet.
07:27:44 Our original application has that number at 9500.
07:27:48 So we have reduced the amount of indoor restaurant space by
07:27:53 1300 feet.
07:27:57 The second condition we would like to add is that no more
07:28:01 than three restaurant uses can be established within this
07:28:05 The third condition is that a maximum -- any one restaurant
07:28:11 cannot exceed a total of 6500 square feet.
07:28:16 And finally that the restaurant occupancy for the entire
07:28:21 project would not exceed a total of 600 occupants.
07:28:25 We had previously identified a number at 670 occupants.
07:28:33 So we have restricted the ability to provide for all these
07:28:39 And we have also reduced it, all of which goes to reduce the
07:28:43 parking demand quite considerably by about 13%.
07:28:48 In fact, if you looked at the restaurant, in isolation, our
07:28:55 parking being provided, actually is one space short of
07:29:01 what's actually required by code.
07:29:03 So we have essentially eliminated the waiver request for the
07:29:07 restaurant use.
07:29:10 With that, I would just like to maybe comment on a couple of
07:29:14 other waiver requests, and I'm sure staff is going to
07:29:18 comment on our proposed changes this evening.
07:29:21 But I would like to just finish this part of the
07:29:26 The reduction in green space waiver, there was essentially
07:29:29 an error in calculation when this project was approved in
07:29:34 The building footprint that you see here today, with the
07:29:38 amount of green space available, is exactly the same, a
07:29:42 footprint, and amount of green space that was approved in
07:29:47 However, the calculation was done in error.
07:29:49 So we had to ask for additional -- an additional waiver in
07:29:54 order to accommodate what was actually approved back then.
07:30:00 The parking waiver, I think we have discussed fairly
07:30:06 The other waivers all began very similar to the earlier
07:30:11 This is a very urban mixed use project with retail,
07:30:15 restaurant and residential.
07:30:18 And all of the idea behind this subpoena to build it in an
07:30:21 urban setting, much like the developments across the street
07:30:25 and what the city is trying to encourage elsewhere.
07:30:28 So all of these waivers are really justified and driven by
07:30:33 the urban character of this development.
07:30:36 So at this point we would answer any questions and see if
07:30:41 the staff has any comments about our proposed changes.

07:32:34 So although the special street setback waiver wasn't on the
07:32:38 05 plan, we are capturing it on this plan to make sure that
07:32:41 the waivers are correct.
07:32:42 But the building wasn't exactly in the same place.

07:37:49 We typically park our urban apartment units at one part per
07:37:54 unit to 1.5 per unit.
07:37:57 Our other two projects in this neighborhood, in-town
07:38:02 neighborhood are 1.3 and 1.39 and with the waiver requested
07:38:06 parking is 1.43 marks per unit for Post Hyde Park.
07:38:11 Sole we would actually be parking in two units in excess of
07:38:15 what we have the sister parks at so that sort of waiver real
07:38:21 relates to the count related to the apartment units.

07:38:43 >> We met with the owners of the Panera shopping center area

07:38:57 And so they were concerned about the parking impact, wand
07:39:00 you have already indicated is a stressful situation.
07:39:02 We feel by bringing 235 apartment units to this we will be
07:39:08 bringing more walking traffic for those restaurants.
07:39:10 Not only the restaurants on our side but all of the
07:39:12 restaurants up and down South Howard reinforcing the policy,
07:39:18 we understand the South Howard overlay, to create a more
07:39:21 urban, walkable environment.

07:39:34 two questions a little better than I did before.
07:39:38 But the green space, the miscalculation -- and I don't think
07:39:44 Abbye was even aware of it, but at the time, the engineers
07:39:51 or whoever were preparing these calculations assumed they
07:39:56 could count hard space as "open space," and so all of the
07:39:59 hard surfaces, the plazas, you know, which are paved, and
07:40:03 that school area, all got calculated, so the waiver request
07:40:07 was much smaller than what they thought they needed, but in
07:40:11 fact they needed the same waiver requests, or just about.
07:40:14 I realize there are some additional surface parking spaces
07:40:18 which we have done to try and put as many parking spaces as
07:40:23 we can on the property.
07:40:24 So it's not identical.
07:40:26 But the building footprint and the land area of course are
07:40:30 the same. So what we are saying is that what council
07:40:33 approved in 2005 is really what we are asking council to
07:40:37 approve today as far as the green space.
07:40:40 It just wasn't calculated correctly back in 2005.
07:40:44 So we are correctly now calculating the green space waiver
07:40:49 that we need, and we are showing.
07:40:51 That but the physical building was the same back then as it
07:40:57 is today.
07:40:57 >> They didn't ask for a big enough waiver.

07:41:30 The trend now of course through the Howard Avenue overlay
07:41:33 being the example is they want you to build buildings closer
07:41:36 to the street, not farther away.
07:41:38 So the waiver on Swann is simply to actually have a building
07:41:44 footprint that's consistent with it, and behind the Howard
07:41:48 overlay which is a 10-foot setback from the street
07:41:52 So I think we are just doing what is the --

07:42:53 the retail actually starts.
07:42:54 And you have some covered walkway there as well to blend in
07:42:58 with the sidewalk out there.

07:43:51 And what we have done to help clean things up, so to speak,
07:43:56 what thrill have little pet wait stations at every point of
07:44:03 egress out the building so people can pick up after their

07:44:55 along the side and along the back in this area back here

07:46:29 that agree with her that these changes are substantial and

07:52:24 This property is for a special use in 2000 for a residential
07:52:30 facility, professional residential facility.
07:52:34 And in 2000 it was granted 115 beds.
07:52:37 As you know, with special uses, they are allowed some minor
07:52:41 modifications after they are approved.
07:52:43 The request buff tonight allowable modifications that can be
07:52:49 achieved administratively as part of the reason why we are
07:52:52 back before you.
07:52:54 The request is to increase number of beds from 115 beds to
07:52:58 176 beds, and also allow for an 8,565 square foot expansion.
07:53:07 The site is surrounded by commercial to the north and south,
07:53:11 50th street to the west, and commercial and I-4
07:53:14 interstate 4 to the east.
07:53:15 The proposed as I stated modification exceeds that, which
07:53:20 can be approved administratively.
07:53:29 We will go ahead and show you the property. It is shown

07:53:32 As you can see, the CI commercial intensive zoning really
07:53:35 wraps around the property to the north and to the south.
07:53:42 There is a little bit of RN 16.
07:53:45 A 50th street is to the west.
07:53:47 There is some RN 16 that kind of meets 50th
07:53:51 predominantly CGRO-18 and CGI down to the south.
07:53:58 There is one waiver.
07:53:59 So -- I'm sorry, there are a couple of waivers associated

07:54:08 special use that was approved for the property in 2000, and
07:54:12 this is to allow the reduction in the drive aisle from 26
07:54:15 feet to much 24 feet to allow for parking in those areas as

07:54:23 reduction from another residential facility from 2,000 to
07:54:29 1790 feet.

08:12:11 Today, May 10th, 2012, marks Tampa Fire Rescue's

08:12:24 This incredible team of men and women not only provides us
08:12:28 with services such as life and safety emergency responses,
08:12:31 public education, keeping our local businesses save through
08:12:35 inspections and emergency management, they also have an
08:12:37 incredible commitment to our community.
08:12:40 "Paint Your Heart Out" Tampa, the 5-K run and the badge bowl
08:12:43 are joust few community service activities they participate
08:12:46 in annually.
08:12:47 In addition, Tampa Fire Rescue is a national accredited
08:12:50 agency, a status they achieved in 2010 after rigorous
08:12:55 accreditation process by the commission on fire
08:12:58 accreditation international.
08:13:00 I just want to take a moment to congratulate all the members
08:13:03 of Tampa Fire Rescue for this huge milestone and thank them
08:13:06 for their continued dedication and commitment to all of the
08:13:11 citizens of our great city and invite the public if you
08:13:13 haven't been to the fire museum, it is really an interesting
08:13:19 afternoon to spend looking at how things used to be done and
08:13:24 how far we have come in 117 years.

08:14:12 they have to navigate Busch Boulevard, and there is no -- at
08:14:17 the intersection of Busch Boulevard and 22nd street.
08:14:20 I would like to see if transportation can look at this area
08:14:25 of traffic light at the intersection of Busch Boulevard and
08:14:28 12th street would be helpful.
08:14:29 So I would like to make that motion for transportation to
08:14:33 please look at the area.
