09:07:39 serves as associate minister at Grace Mary Missionary

09:07:43 Baptist Church under elder Dr. Thomas J. Reed, pastor.

09:07:48 He also served of the golf course union, a Sunday

09:07:53 schoolteacher of youth, and youth young adults, and a choir

09:07:57 member and musician of the church.

09:07:58 Elder Reed was born and raised in Tampa and is a graduate of

09:08:02 Hillsborough High school.

09:08:03 He has attended Hillsborough Community College at mayor

09:08:14 Bible college, president of a company that specializes in

09:08:18 home security and management.

09:08:19 Elder Reed is married and the father of three children and

09:08:23 one grandchild.

09:08:24 Please rise for the invocation and our pledge of allegiance.

09:08:32 O God, we come this morning with a humble spirit, a thankful

09:08:40 We are thankful today, God, because once again you have

09:08:43 afforded us life, health and strength.

09:08:47 Father, we come thanking you, God, for this new year 2014.

09:08:53 We thank you for bringing us through 2013, Lord, and to this

09:08:57 point.

09:08:58 Father, we thank you for this opportunity to stand before

09:09:00 you and before this great body here, Lord.

09:09:05 We pray now, Lord, that you will bless us as we go forward

09:11:55 I noticed in the paper that the state of the city is coming

09:12:00 up.

09:12:03 Unfortunately not to the public but only to the elite.

09:12:08 And at a cost.

09:12:11 I would think that it would come to the public first, and

09:12:14 then to a private entity.

09:12:17 Anyway, item number 2 and 3, handing out a note here.

09:12:35 Risk management.

09:12:35 When we have an accident in the city, the city employee is

09:12:38 not taken off of the driver if they have an accident in a

09:12:44 city vehicle, those privileges are not removed until an

09:12:47 investigation is completed.

09:12:50 I'm sorry, but a vehicle is as bad as a TPD bullet.

09:12:55 So I think we need to put in some guidelines there.

09:13:04 Establishing rental inspections.

09:13:09 Met an 80-year-old man this weekend in an apartment house

09:13:13 that had no heat.

09:13:16 The poor man was freezing his kazoos off.

09:13:20 I put him in on my limited income into the orange motel for

09:13:25 $45 for one night.

09:13:29 Code can't into the apartment because the people have been

09:13:33 told that they will get evicted.

09:13:36 We need to do something about the rental inspections.

09:13:40 We need to inspect all rentals, not just one or two, because

09:13:45 then those two get fixed and all the others are not fixed.

09:13:55 Heat this week was a health situation and it needs to be

09:13:58 corrected.

09:14:04 I have been an advocate for code for many, many years.

09:14:09 As a matter of fact, today is my 63rd birthday.

09:14:13 I have been at this for over 20 years.

09:14:16 The department, I feel, is the most important department in

09:14:19 the entire city.

09:14:20 However, the department has to have some responsibility to

09:14:27 show whether or not their problem sees is working or not.

09:14:31 At this point, they don't.

09:14:34 Civil citation is a joke.

09:14:38 Once liens are assessed on a property, nothing is done, in a

09:14:43 one goes back and says, hey, la, can we get this corrected?

09:14:48 Remove the liens, do whatever is needed.

09:14:50 People are not taken to court, and violations just continue

09:14:55 and continue and continue.

09:14:58 I have a lot more, but my three minutes are up.

09:15:09 As far as rental inspections go, I agree, it should be done

09:15:12 annually.

09:15:13 I don't know where you get the money or the people to be do

09:15:16 it.

09:15:16 That's a whole different conversation.

09:15:19 But I also would like to see the inspections be a little bit

09:15:22 more inclusive or detailed.

09:15:25 We had a house across the street from us that every time

09:15:28 they flushed the toilet it went outside, came up all over

09:15:31 the curb.

09:15:32 No one in the rental inspection ever questions the toilets

09:15:35 to be see if they go away as opposed to stay on the

09:15:37 property.

09:15:38 I would like to see that happen and make sure that the water

09:15:42 faucets work and make sure that the light switch works but

09:15:48 they never check to be see if the sewage leaves the

09:15:51 property.

09:15:54 I would like to see that included.

09:15:55 I find that to be a health issue.

09:15:58 For not only the people residing in the house but the people

09:16:01 living nearby.

09:16:02 Recently the house went into foreclosure, came in, did the

09:16:06 whole thing and now everything works the way it should have

09:16:09 in the first place.

09:16:10 The other thing I would like to talk about is leases for

09:16:14 alternative parking, item number 4.

09:16:17 As you know, I live in Seminole Heights.

09:16:19 Many, many of the properties, the buildings are built

09:16:22 virtually to the property limits.

09:16:24 If you require them to have a lease, I don't have a problem

09:16:27 with that.

09:16:28 You have to have a lease, vacant lot next door, one across

09:16:33 the street, or whatever it is.

09:16:35 But to require them -- I mean, parking is just an issue.

09:16:40 And if you turn around and say, you know, you have to have

09:16:44 20 parking spaces for this location.

09:16:46 We have one going in, required to have six parking spaces,

09:16:50 and it has seating for 50 people.

09:16:52 Six parking spaces isn't going to make it.

09:16:54 And yet they have got leases with two properties nearby, and

09:16:59 they are talking about maybe requiring that they can't use

09:17:01 them.

09:17:02 So if one guy sells his property that business is put out of

09:17:06 business.

09:17:06 I don't know how you fix that but those are things that need

09:17:09 to be considered when you do this.

09:17:22 I'm here today to talk to item number 3 in section 4, or

09:17:27 section 4, item 3, whatever way you want to look at it.

09:17:31 The 1,000-foot parking extension for valet parking on

09:17:38 particular facilities, one of the problems that T.H.A.N. has

09:17:41 is that one neighborhood has the restaurant two blocks away

09:17:46 there's another neighborhood who is getting the parking lot,

09:17:49 and they don't get notification when they are doing this

09:17:54 renovation, the bar, whoever is using the lot.

09:17:59 The second neighborhood does not get neighborhood because

09:18:02 it's 250 feet away or whatever the rule is now.

09:18:07 I think that maybe to include that in any kind of an

09:18:10 ordinance would be very good for the neighborhood.

09:18:16 Also, whenever we get to the point of having a business

09:18:22 license, tax type arrangement with the extra hours or

09:18:27 things, I think it should be included in that, so if they do

09:18:32 tear up the lease or not have a lease that is valid, that

09:18:35 they would be able to not be able to do business without

09:18:40 having the correct leases and things like that.

09:19:09 You all know that I'm Pastor Williams, where you all are

09:19:14 trying to destroy my church,

09:19:18 The church believes in God, and because of separation of

09:19:24 church and state.

09:19:25 The church believes in God.

09:19:30 Churches that believe in.

09:19:38 The church that believe in God, protecting for our children.

09:19:43 The church that believe in God, preach the truth about Jesus

09:19:48 Christ.

09:19:48 The church that believe in God, want police officers stop

09:19:51 harassing and arresting homeless people.

09:19:54 They have not committed a crime.

09:19:56 The church that believe in God, want the devil, Republican

09:20:00 party, immediately to stop shutting down our government.

09:20:03 The church we believe in God, want the government, the

09:20:10 church that believe in God, keeping the program taken off

09:20:16 the air.

09:20:17 The church that believe in God, want to stop robbing their

09:20:25 customers before Christmas by 10% make 25 billion per year.

09:20:32 Want President Obama and the government to award the victim

09:20:36 of the elementary school one million dollar apiece, total

09:20:43 $26 million.

09:20:45 If the government can give 87 billion of our tax money to

09:20:49 Bank of America, 26 million is nothing but a drop in the

09:20:53 bucket.

09:20:54 The church that believe in God wants better relationship

09:20:58 with our president of Cuba and the Cuban people.

09:21:01 We would like to visit our brothers and sisters and tell

09:21:04 them about our Lord and savior Jesus Christ.

09:21:07 The church that believe in God, believe in John, for God so

09:21:12 loved the world that he gave his only begotten son that

09:21:16 whoever shall believe in him shall not perish but have

09:21:20 everlasting life.

09:21:31 I'm here to speak on items 3 and 4.

09:21:34 Real quickly on item 3.

09:21:40 To the code enforcement additions and instruction, I would

09:21:48 like to be see a way to make that work with the property,

09:21:55 hold the property owner responsible.

09:21:57 And finding a way that we can reduce the amount of time that

09:22:01 it takes to enforce the code without stepping on the

09:22:06 property rights.

09:22:09 On item 4, the parking issues, number one, I have a question

09:22:15 with regard to be a letter that was received on item A under

09:22:20 number 4.

09:22:23 That's the appropriateness of somebody who is appealing a

09:22:25 decision by this council, making a recommendation before

09:22:29 that appeal has run its course.

09:22:32 On top of that, as to the requirements for valet parking, it

09:22:40 would be nice to see a required traffic study in the

09:22:44 district where the people who are going to be required to do

09:22:47 that come up with a traffic study showing the impact of the

09:22:52 additional traffic moving back and forth to bring cars in

09:22:57 and out in the district, but is not necessarily just the

09:23:01 parking.

09:23:02 It's the amount of traffic that's generated through the

09:23:11 additional people on crowded streets of South Howard.

09:23:14 Even North Howard for that matter.

09:23:18 >>CHARLIE MIRANDA: For the record the clerk needs your name

09:23:27 >> Okay, I'm Ed Tillou from Sulphur Springs.

09:23:37 I had a little bit of a breakdown to go around.

09:23:45 Okay.

09:23:45 I just happened -- and this is what I will be talking about,

09:23:55 an old issue of national geographic.

09:23:57 And the thing is that from time to time, movies, and the

09:24:06 best movie is -- one is American Hustle which has

09:24:18 Trafficante, Jr., and it's played by Robert De Niro, and

09:24:26 there should be a bronze plaque commemorating but not

09:24:31 commending Santos Trafficante Jr., local businessman, what

09:24:37 years he was here.

09:24:39 Over on 19th and 7th Avenue, catercorner from

09:24:44 Tropicana is where the old Tropicana was, and he used to

09:24:48 hold court.

09:24:49 But in any event, with respect -- very much on this area

09:24:56 because DeSoto was searching for the fountain of youth.

09:24:59 Now, it was not Ponce DeLeon had the chance to change the

09:25:05 awareness but he didn't.

09:25:07 Ponce DeLeon, he found what was called the fountain of

09:25:09 youth in Safety Harbor and it didn't seem to work.

09:25:13 But the thing is, at least as an historical point there that

09:25:18 could be corrected.

09:25:19 Now, no harm.

09:25:23 I mentioned that because I was in medical school and that

09:25:26 was the motto of the medical profession, first do no harm.

09:25:30 And this group is part of a process of doing harm, not as

09:25:35 much as county commission, because county commission, they

09:25:39 are like out of control.

09:25:40 But the thing is the county commission commended

09:25:49 Merrill Hotage? And what happens with this level is that

09:25:55 Quizno's across the street has gone out of business, and I

09:26:04 talked to City Council, an empty business rolling out the

09:26:11 red carpet to hog heaven, and now the thing is meat has by

09:26:24 investigations gotten a clean bill of health more or less.

09:26:26 It has found that all the bad effects of meat are the

09:26:29 processed meet meat, the sodium nitrate in it.

09:26:33 I eat a lot of it.

09:26:34 Hotdogs have a lot of it.

09:26:35 It's the sodium nitrate that probably kills the good

09:26:38 bacteria in your intestinal tract.

09:26:42 >>CHARLIE MIRANDA: Thank you very much.

09:26:42 I have learned a lot.

09:26:45 >> no, no, I'm not talking to you, I'm talking to myself.

09:26:49 I'm not buying a volt today.

09:27:02 I came to speak on item 49, but it's more in-depth in

09:27:07 reference to the E bars and all those issues.

09:27:18 >>CHARLIE MIRANDA: Excuse me, that's a public hearing.

09:27:20 And in those cases, you have to speak at the time of the

09:27:22 hearing.

09:27:23 Those are quasi-judicial.

09:27:25 You have to be sworn in and everything else.

09:27:27 >> When that comes up I'll be back.

09:27:31 >> When we call for that hearing, it will be sometime after

09:27:33 9:30.

09:27:35 I apologize for not saying that earlier.

09:27:55 I hate to put that the way, but it was last year.

09:27:58 So any reconsideration of matters from anyone in the

09:28:04 audience to this council that was passed at the last

09:28:06 meeting?

09:28:07 I see none.

09:28:08 We go to the 9:00 item number 1.

09:28:11 It would be the junior league making a 5-minute presentation

09:28:15 on human trafficking.

09:28:22 >> Mary Ellen, junior affairs league, Junior League, Florida

09:28:27 State public affairs committee, and she is here to make a

09:28:31 presentation on human trafficking.

09:28:34 And I want to point out that this is the winter issue, and

09:28:39 in it is a very excellent article on the human trafficking

09:28:47 and the trafficking awareness campaign that the Junior

09:28:51 League is putting forth.

09:28:52 >> Thank you very much for having me.

09:28:56 Please bring up the presentation.

09:29:04 The junior league of Tampa has been very much involved in

09:29:06 the issue of human trafficking and child sex trafficking for

09:29:12 several years, and we are very excited to have been selected

09:29:20 as a public service client for the year, and they have

09:29:23 created a wonderful issue-based awareness campaign about

09:29:28 human trafficking.

09:29:29 We just found that not a lot of people in our community

09:29:32 really know that it's happening, or understand what it is.

09:29:35 They think it might be illegal immigrants.

09:29:37 In order to raise money for survivors and get the services

09:29:42 they need, and creating a baseline awareness, that's really

09:29:46 what this campaign is designed to do.

09:29:48 I am going to briefly walk you through what the campaign is

09:29:51 like, actually launching this week, and you will see more

09:29:53 materials come out throughout January, and Gas Lyke park

09:30:01 from 4 to 7:00.

09:30:07 How they can help and also provide help to child sex victims

09:30:12 through the human trafficking hotline.

09:30:14 This is really going to be a campaign for all the different

09:30:18 organizations working very hard in the community helping

09:30:20 survivors in law enforcement.

09:30:22 And there are about 100 different organizations that make up

09:30:25 members the campaign against human trafficking, and this

09:30:28 campaign is specifically going to help them and provide

09:30:31 materials that they can then use with one message.

09:30:37 These are some of the organizations involved.

09:30:39 And one of the things than we found is why don't people

09:30:42 already know about this issue

09:30:43 And really we found that it's an uncomfortable topic for

09:30:46 people to discuss.

09:30:47 They really don't want to recognize it's actually happening.

09:30:49 And the general term of trafficking is very confusing, and

09:30:52 often related to drugs.

09:31:01 Ow we found that trafficking does very much relate to modern

09:31:05 day slavery, and that is a much more appropriate term, and

09:31:09 our campaign is -- people understand the term and understand

09:31:14 it relates to modern day slavery.

09:31:17 And this is what some of the slides look like, our logo.

09:31:24 It's a very gritty logo. It's not a clean and pretty

09:31:27 subject.

09:31:28 And most of the campaigns you have seen out there in the

09:31:31 community are black and red and white.

09:31:33 This campaign is a lot of purple, and testimonials, and it's

09:31:40 going to be you will note that FBI has a campaign, Tampa's

09:31:48 office has a campaign, everybody is doing something, but

09:31:50 they are doing something different, different messages,

09:31:53 different audiences, different calls to action.

09:31:56 There isn't one central campaign.

09:31:57 We are hoping that this campaign is the aggregator, one

09:32:02 central place where people can go and get information.

09:32:08 Several that you are going to see around town they actually

09:32:11 started to hit this week on Clear Channel, digital boards in

09:32:14 the Tampa Bay area, and there is going and the sex slavery,

09:32:21 and we think if people see that they will be helped by that.

09:32:26 Another example, we rank third nationally in Florida in

09:32:29 human trafficking, and sex slavery, ask to provide 15 sexual

09:32:36 acts per night.

09:32:40 Another provided pieces online.

09:32:43 Our Web site launched yesterday.

09:32:45 We encourage you visit, which includes

09:32:50 many resources and information, and all of our events for

09:32:53 the coming week.

09:32:55 A little bit more about what the Web site, the page on our

09:32:59 Web site, what you are going to see, and you can click on

09:33:02 any of these items for additional information.

09:33:04 And we have several partners.

09:33:07 SunTrust building, it's going to light up purple on Saturday

09:33:10 in support of our campaign.

09:33:11 And we are hoping for all of next week as well.

09:33:14 We just haven't received confirmation on that.

09:33:17 And we also see these stickers that can be put on businesses

09:33:20 whether it's convenience stores, gas stations, malls,

09:33:23 hotels, a lot of different places where victims might be

09:33:26 found, might be targeted, and these are things where people

09:33:30 would say not in our house.

09:33:32 This is human trafficking, not a safe house that people can

09:33:36 come for help but an zero tolerance zone.

09:33:40 That's going to be in phase two of our thinking.

09:33:43 You see what that might look like.

09:33:45 You are going to be seeing around town, what this might look

09:33:49 like.

09:33:50 We'll have those available for sale this Saturday.

09:33:52 And you will also be seeing efforts around town as well.

09:33:58 We have several media partners, Bright House, Verizon, Clear

09:34:02 Channel, business journal, we have a little over $100,000 in

09:34:09 donated media so far to get the campaign on the street and

09:34:11 our goal is to get 500,000 donated and it will run through

09:34:19 the spring.

09:34:20 And that is our presentation.

09:34:21 Thank you very much.

09:34:26 will be speaking as well as commissioner Sandy Murman, will

09:34:30 be presenting this presentation as well in Tallahassee on

09:34:32 Tuesday to the human trafficking legislative working group

09:34:38 in hopes that this campaign will go statewide.

09:34:42 It was very informative, very brief and very to the point.

09:34:45 And we have always appreciated the junior league and what

09:34:47 you do.

09:34:48 And let me say one thing, when you do something, you do it

09:34:52 right.

09:35:09 Lykes Gas Lyke park downtown.

09:35:11 We'll have six or seven food trucks there, we will have a

09:35:16 band, we'll have T-shirts for sale, several of our community

09:35:19 partners, and sharing information about what they do from

09:35:23 law enforcement to service providers, and have a brief

09:35:26 presentation at 5:30 with be some of our elected officials

09:35:29 in law enforcement and a candlelight vigil.

09:35:32 >> I also noticed that the color is purple.

09:35:34 I serve on the board of directors of the spring of Tampa Bay

09:35:38 which is also purpose and very significant.

09:35:42 Very significant.

09:35:53 >>MIKE SUAREZ: First, thank you for bringing this forward.

09:35:56 Last year, I had worked with our attorneys, and with some of

09:36:02 the members of the Tampa Police Department, and a private

09:36:07 attorney talking about how massage parlors lead to a lot of

09:36:12 the human trafficking that goes on, especially in our city.

09:36:20 Some were using zoning rules to deal with the problem.

09:36:23 The legislature had taken up this issue last year, as you

09:36:26 know. I would suggest that if but haven't already, and met

09:36:31 with Mrs. Harcourt from your group, talking about some of

09:36:35 the people to contact, Kathleen O'Donniley.

09:36:43 The statewide prosecutor is already looking at this as part

09:36:46 of what they want to do, both Ms. O'Donniley and they have

09:36:53 this on the radar.

09:36:56 Please have it on the radar.

09:36:58 And give me the name of the Web site.

09:36:59 You went through it quickly and I want to make sure that

09:37:02 everyone out there can hear it.

09:37:53 could request a letter from council be sent to our

09:37:55 legislative delegation to be sure that they are supportive

09:37:59 of Ross Santos' bill and that they have be a Senate sponsor

09:38:09 So we all want to be see this happen, and work towards

09:38:12 having our legislation in place, hopefully before the end of

09:38:19 the session.

09:38:20 Maybe it's one thing that we can get accomplished in the new

09:38:22 year so looking forward to that.

09:38:26 And I had talked with you before about some of the things

09:38:28 that I have looked at across the country, and it's come up

09:38:32 with our legal staff when it was brought here before council

09:38:35 before, and that is using code enforcement to rein in those

09:38:42 massage parlors and establishments because it's often very

09:38:45 difficult to prosecutor to close them down for any other

09:38:49 reason.

09:38:52 Is the Department of Health looking at licensing of people

09:38:54 who are working there, how many people are there, and

09:38:57 something as simple as, you know, in San Francisco they are

09:39:01 required in massage parlor to wear white coats and if they

09:39:08 go in and they aren't wearing white coats, that's a charge

09:39:11 that they can use to close them down.

09:39:13 It seems very simple and it seems kind of, you know, outside

09:39:16 of what you would think of a reason to shut somebody down or

09:39:21 to repeatedly fine individuals, but there might be some

09:39:27 extraordinary things we can come up with to assist.

09:39:30 >> And we found out that the county -- we will be working

09:39:34 with the county along with other members of the community

09:39:37 campaign.

09:39:37 The county is doing a collaborative lab in February and it's

09:39:42 going to be a full day, the cooperative lab in St. Pete on

09:39:49 really what our county can do in response in terms of the

09:39:52 strategic approach.

09:40:21 just pushing the message out, helping us reach the people

09:40:25 who live in our inner City of Tampa, let them know about the

09:40:28 Web site, let them know how they can get involved, so any

09:41:45 requested our total number, dollar amount of for calendar

09:41:53 years 2013 and the number was $2.57 million.

09:42:11 >>ERNEST MUELLER: Assistant city attorney.

09:42:22 We have three parts, A, B, C.

09:42:24 We'll begin with A, providing a report, recommendation for

09:42:27 the establishment of the rental inspection program.

09:42:32 The last several months the legal department and

09:42:34 neighborhood empowerment has been working toward revamping

09:42:37 our current system of regulating residential units.

09:42:41 In fact, we had a legal intern come in and help us on this.

09:42:46 I would like to take this opportunity.

09:42:53 The department's work thus far has included researching the

09:42:57 city's legal authority with regard to regulating and

09:43:00 inspecting rental units, and determining what exactly the

09:43:03 city is able to do with the available resources with the

09:43:06 number of rental units thereof.

09:43:09 We are looking to create a registration system, number one,

09:43:15 create a registration system, where landlords will identify

09:43:18 the rental units, identify the people responsible, and who

09:43:24 we need to contact with regard to property maintenance, and

09:43:27 if there are violations, who we send that violation to, to

09:43:33 try to identify a local agent.

09:43:36 Other things we are looking at doing is creating a grading

09:43:39 system that will help us to identify the rentals, looking at

09:43:46 a grading system from A to F, grade D and F being high risk

09:43:52 rental.

09:43:52 This grading system will allow us to allocate resources,

09:43:55 those with the lower grade, higher risk rental, we will be

09:43:58 inspecting more often than those that have a higher grade.

09:44:03 And we also hope that a grading system like this will try to

09:44:06 motivate landlords to get the higher grades so they don't

09:44:09 have to be inspected as much.

09:44:11 Things that will go into the grading system will be things

09:44:15 like past history, violations, when we do inspect, what the

09:44:21 condition of the units are.

09:44:26 >>CHARLIE MIRANDA: Excuse me.

09:44:27 I'm sorry.

09:44:28 I understand what you said.

09:44:32 And to me, that's picking and choosing.

09:44:36 Even if you are a grade A, that doesn't mean you are going

09:44:38 to be a grade A tomorrow.

09:44:40 So if we are going to pick and choose and say this

09:44:44 individual is all right today, we are going to go after the

09:44:47 others, and if it turns bad you never nobody because you

09:44:51 didn't check.

09:44:54 And let me say that I have rental properties.

09:44:57 I own rental properties.

09:44:59 I don't think it's that difficult to find out who the owner

09:45:03 is by your statement.

09:45:06 You said that you have to get a list of your properties.

09:45:10 There's already a list in the county assessor's office.

09:45:14 Who owns them? You can find that out instantaneously.

09:45:18 You have the address.

09:45:22 And mail out things.

09:45:23 I don't understand what that -- and believe me, I'm not

09:45:28 talking about the list that was talked about by this

09:45:35 committee.

09:45:36 I don't understand that part.

09:45:37 Is there any other government agency that had a rental

09:45:39 system that dropped it in this county?

09:45:43 I don't know.

09:45:48 Hillsborough County had one and doesn't do it anymore.

09:45:50 So what I'm saying to myself is, are all renters bad?

09:45:58 Or are property owners in general not taking care of their

09:46:02 properties?

09:46:03 In other words, when we have code enforcement problems, tell

09:46:07 us which ones come from rental properties, and percent wide,

09:46:12 and tell us which ones come from private ownerships without

09:46:16 rental properties.

09:46:17 In other words, we are saying, what I have heard so far in a

09:46:20 very short statement, that only the owners of rental

09:46:23 properties are creating this problem, even though it wasn't

09:46:27 said that way.

09:46:28 What is the total of the 100% coming to and from where?

09:46:33 Is it coming from a district?

09:46:37 Is it coming from the whole city?

09:46:38 Is it coming from one side of the city?

09:46:40 Is it come from rental properties in some parts of the city?

09:46:43 I don't know.

09:46:45 We are attacking a problem that we haven't identified, from

09:46:48 what the statements have been said so far.

09:46:50 And I'm not talking to you.

09:46:52 Believe me.

09:46:53 But what I'm saying is, I need information before I vote on

09:46:57 something like this.

09:47:00 And again, it's still a work in progress and we are looking

09:47:04 forward to trying to bring something to you that's completed

09:47:07 and ready for you to look at, at the February 27th

09:47:11 workshop, the same day you are going to be looking at bed

09:47:15 and breakfasts.

09:47:17 We think that will be a good time to do it.

09:47:19 Now, the registration system, you talked about that.

09:47:25 Out of city and some out-of-state owners of property, trying

09:47:28 to get where it there's a local person that we can contact.

09:47:45 And this is part of the things we are still trying to work

09:47:57 As I stated earlier, I judge horse racing.

09:48:00 I got thousands of owners that own horses throughout the

09:48:03 country.

09:48:04 99% of them are not where I'm at and I find them

09:48:08 instantaneously, just because they have to have a license.

09:48:12 And in that lay sense I got their address, and in that

09:48:15 address I got their cell number, and in that license I got

09:48:18 their home number.

09:48:22 I write them or I call them so within a day or two I get the

09:48:27 response that I need.

09:48:27 So I'm applying what I do there, what I'm trying to do here,

09:48:33 and it seems to me like -- I don't know.

09:48:36 We just get into it and get out.

09:48:38 Get into it and find out what be the problem is and solve

09:48:40 it.

09:48:41 Just because somebody lives in Topeka, Kansas, or Havana,

09:48:45 Florida, doesn't many that I can't locate them.

09:48:47 And there is a Havana, Florida just outside of Tallahassee.

09:48:51 So what I'm saying is, it's not that difficult to find

09:48:54 somebody in today's technology.

09:48:57 I mean, I don't lose anyone.

09:49:01 I am get them all.

09:49:03 And there's only three of us doing that.

09:49:07 So I don't see how why we have to form a list and find out

09:49:11 who the owner is and all that.

09:49:13 And it becomes cumbersome.

09:49:14 It becomes more and more and more -- maybe I'm wrong.

09:49:18 But I apply whatever works.

09:49:24 And in this workshop in February, are we going to have that

09:49:27 list of where these problems are?

09:49:59 When you say the session on February 27th, I was under

09:50:03 the impression that the tone and subject matter for that

09:50:08 discussion was more related to bed and breakfast than the

09:50:12 vacation rentals, than the residential rentals for

09:50:22 permanent --

09:50:23 >>ERNEST MUELLER: What I was saying is today we were going

09:50:25 to ask that this be put on a workshop that same day, and we

09:50:29 discuss this.

09:50:30 And it just happened to be on the same day you are also

09:50:33 doing bed and breakfast.

09:50:36 >>LISA MONTELIONE: I wanted to clarify that.

09:50:38 You and I spoke about it a couple days ago.

09:50:41 But the agenda item as it reads now is more the vacation

09:50:44 rental discussion.

09:50:45 And as far as the the database and who owns these rental

09:50:48 properties -- and maybe Mr. Slater can verify this -- when

09:51:03 you own a rental property are you supposed to register with

09:51:06 the City of Tampa?

09:51:08 >>JAKE SLATER: City of Tampa neighborhood administrator.

09:51:14 The answer is yes.

09:51:18 >>LISA MONTELIONE: So we already would have from those

09:51:21 registrations who owns that property so the database that we

09:51:23 are talking about already exists, correct?

09:51:27 >>JAKE SLATER: That's correct.

09:51:29 >>LISA MONTELIONE: So that makes at lot easier.

09:51:31 And I know that some of the challenge is -- do they also

09:51:34 need to have occupational license, Mr. Slater?

09:51:37 >>JAKE SLATER: They have to pay like a business tax, yes.

09:51:40 >> So they need to register with the city that they have

09:51:43 rental property and they would also need to have an

09:51:45 occupational license because that is a business?

09:51:48 >>JAKE SLATER: They have to pay a business tax based on the

09:51:52 size of the structure and number of rooms.

09:51:54 >> So we already have the database of those people who are

09:51:59 doing honest business with the city, and I think what our

09:52:03 challenge is are the rental properties where people have

09:52:09 decided to rent out their house and never register with the

09:52:13 city as a rental property.

09:52:16 In some cases probably still claiming the homestead

09:52:20 exemption with the county appraiser, so you, know, they are

09:52:26 saying that they live there but they don't.

09:52:28 They don't register with the city and they don't pay a

09:52:31 business tax.

09:52:32 Those probably are the largest problem we have.

09:52:38 And I'm guessing anecdotally.

09:52:42 >> Our total intent is to address the blight in the City of

09:52:45 Tampa.

09:52:46 And we look at the rental certificate program as the method

09:52:50 for us to address one of those areas.

09:52:53 Currently we have just under 14,000 single-family

09:52:58 residential properties on our tax roll.

09:53:02 I'm not saying that's all of them.

09:53:04 That's the ones on our current business tax roll.

09:53:08 We have about 1900 duplexes, 300 triplexes, 300 quad, and

09:53:20 about 11,000 apartment units, which I think the number is

09:53:23 low for the apartment units.

09:53:26 Those are the ones that are currently on our business

09:53:31 tax/rental certificate tax roll.

09:53:37 >> And just from what I see driving around the city on my

09:53:42 own, and doing my ride alongs with Tampa Police Department

09:53:47 in the north Tampa area, we had said before that most of the

09:53:54 problems in neighborhood when you talk about blight are

09:53:57 folks who aren't taking care of their properties, aren't

09:54:02 keeping them up to standards, and it's minimal living

09:54:05 conditions.

09:54:05 So when you call blight, I call unsafe housing.

09:54:10 So we are talking about the same thing.

09:54:12 And it's really the condition of the homes that people are

09:54:16 forced to live in because they feel like they don't have a

09:54:18 voice.

09:54:21 They complain to the landlord, and if they complain to the

09:54:23 landlord, as we have seen recently in the newspaper, they

09:54:26 get kicked out.

09:54:27 So the problem really maybe never rises to the surface where

09:54:32 they are coming to us, because we do have an avenue for

09:54:35 people to complain, right.

09:54:36 >> Yes.

09:54:39 Yes, we do.

09:54:40 >>LISA MONTELIONE: And for the people out there watching or

09:54:43 maybe for printing in the newspaper, if someone is living in

09:54:45 a substandard housing rental unit, who are they contact?

09:54:50 >> They can go on our Web site.

09:54:52 They can do it through a customer center.

09:54:54 They can call us directly.

09:54:56 >>LISA MONTELIONE: And that could be anonymously?

09:54:59 >> Yes.

09:55:00 >>LISA MONTELIONE: So they don't feel like they would be

09:55:03 targeted by the landlord by leaving their name?

09:55:07 >> Yes.

09:55:08 >>LISA MONTELIONE: They could figure it out where they live

09:55:10 and what they are inspecting.

09:55:12 The issue that I had when I rode with code enforcement,

09:55:15 which was awhile back, is that we have very limited staff.

09:55:20 I mean, even though you have been able to add staff thanks

09:55:23 to the administration and the budget expansion of your

09:55:25 department, which is great, but we still have limited number

09:55:27 of staff that can perform these rental inspections.

09:55:32 So if you can maybe tell us a little bit about how that's

09:55:38 progressed or changed with the addition of staff in your

09:55:43 department.

09:55:43 >> We currently have four dedicated inspectors handle the

09:55:48 rentals inspection program.

09:55:52 We are looking -- this is already mentioned to better

09:55:57 address the way that we do it to make it more timely, to

09:56:00 make it more efficient, and to keep current with the amount

09:56:04 of overall changes in the property ownership.

09:56:09 Again, whether you add up all of these rental properties in

09:56:13 the City of Tampa -- Tampa is one of the largest cities that

09:56:16 I have been able to find in the country that has a proactive

09:56:19 rental inspection program.

09:56:23 Tampa is one of the largest.

09:56:25 We are actually looking at ways to better perform, to better

09:56:32 serve the public, and again to address the blighted areas in

09:56:36 the City of Tampa.

09:56:38 We are sometimes accused of being too heavy handed of going

09:56:43 into properties, that they don't want us in, or we are also

09:56:48 being accused of actually not doing enough with the rental

09:56:51 system program.

09:56:53 It's a difficult situation.

09:56:55 It is.

09:56:56 And I would like to be able to come back at the end of

09:57:00 February with some more detailed answers for you folks.

09:57:04 >>FRANK REDDICK: Thank you, Mr. Chair.

09:57:09 Mr. Slater, when I look at a lot of the rental properties in

09:57:12 the city of Tampa, a lot of these properties are rented out

09:57:17 are section 8.

09:57:18 >> Yes, sir.

09:57:20 >>FRANK REDDICK: My question is, is it possible to cross

09:57:22 reference the section 8 rentals to those who have registered

09:57:27 with the city where they are in compliance by registering

09:57:32 with the city, and those who might be special 8 rentals that

09:57:36 are property owners that are not registered with the city?

09:57:40 It seems to me that this section 8 rental can obtain some

09:57:45 section 8, and because I know in my neighborhood, and many

09:57:53 in the community in East Tampa, the majority of those homes

09:57:58 are rented out through section 8.

09:58:01 I don't know if these people are homeowners by registering

09:58:04 with the city are not.

09:58:05 But I'm pretty sure we can cross reference that by checking

09:58:09 the section 8 department and determine who owns those

09:58:12 properties and seeing if they are registered or not.

09:58:15 >>JAKE SLATER: Yes, sir.

09:58:18 We have met with the Tampa Housing Authority about a month

09:58:20 ago, and we are in constant contact with them, and they do

09:58:25 inspection program on their own through an outside vendor.

09:58:31 The issue is that they have a better handle for us because

09:58:34 if they don't meat the standards, the Housing Authority,

09:58:37 they don't get paid.

09:58:40 They don't get the monthly checks.

09:58:43 So they have more of a hammer than we do with regards to the

09:58:47 overall enforcement process.

09:58:48 But we are meeting with the Housing Authority, and we are

09:58:54 getting like an active list so we can cross reference and

09:58:57 work the overall problem together.

09:59:03 >>YVONNE CAPIN: Yes, since section 8 was brought up, from my

09:59:05 understanding, section 8 is more a market rent.

09:59:10 When you look at section 8, that's more of market, when the

09:59:16 rents come in, that's subsidized, right? Which that's not

09:59:22 the case with all the other rentals.

09:59:24 And there's a difference, because section 8, as you said,

09:59:28 they inspect.

09:59:29 And if they are not up to standards, they don't get paid.

09:59:32 And, also the renter is also inspected.

09:59:36 The renter also -- so both the lessor and lessee are both

09:59:43 inspected under section 8.

09:59:44 I wish we had more of that. Because when you rent and you

09:59:47 get market value, then you can see where they would have --

09:59:56 you know, that would help in keeping the properties up.

10:00:01 I mean, we just saw the whole fiasco that happened over at

10:00:06 the county with subsidies, and it was not -- you know, these

10:00:14 homes, this money was being paid out, and they were not held

10:00:20 to the standards.

10:00:21 So that's where section 8 comes in.

10:00:24 And they do come down hard.

10:00:26 Section 8 is both very beneficial to the person that's

10:00:31 renting, and to the landlord.

10:00:34 And unfortunately, I feel we don't have enough of both.

10:00:39 >> What kind of alarmed me was we met with the Housing

10:00:44 Authority, that they shared with us that the amount of

10:00:46 applications coming in, in Hillsborough County on a monthly

10:00:49 basis, section 8, qualifications has gone up every month for

10:00:58 the last couple of years, and that's the overall rental.

10:01:01 >> They have a huge waiting list.

10:01:03 >> Yes, they do.

10:01:06 >>YVONNE CAPIN: I can't remember the number now, but I met

10:01:09 with the Housing Authority and they told me, it seemed like

10:01:12 almost insurmountable.

10:01:14 >> It's quite large to be honest with you, yes.

10:01:17 >> Thank you.

10:01:20 >>MIKE SUAREZ: A question.

10:01:27 What we always tell you, Jake, is one of the tools you need

10:01:30 to actually solve some of these issues, okay?

10:01:33 We have a new computer system that allows us to do a lot of

10:01:38 different things, and hopefully it will help us use some of

10:01:40 the data that we already have, and hopefully already been

10:01:43 inputted to help us track some of these rentals, first of

10:01:46 all.

10:01:47 Second of all -- and this is something that since the mayor

10:01:50 mentioned it yesterday, and something that we should talk

10:01:52 about, which is our AP now for City of Tampa, there is a

10:01:56 general code enforcement button to go and report code

10:02:02 enforcement.

10:02:03 I would suggest that you might do one specifically to this

10:02:06 issue so that we can get those kind of reports that people

10:02:10 mate want to, you know, not only take a picture and show us

10:02:14 where it's at, but in addition be able to report some of the

10:02:17 issues with their particular landlord, and particular rental

10:02:20 property.

10:02:21 I think that we need to use every tool available.

10:02:24 And I would just suggest for them to add that on there, I'm

10:02:28 sure it's a difficult thing to add concerning landlord, or

10:02:33 however you want to put in the here.

10:02:34 But we have this tool available, but start using it even

10:02:38 more so.

10:02:39 This is brand new to us.

10:02:40 And secondly, I think we need to really come up with a

10:02:45 specific process of how we list those properties that are

10:02:50 rentals, and how the regular inspection is done and how we

10:02:54 can clean up the process itself, because, you know, the

10:02:57 problem you have is that you have limited resources, and you

10:03:00 have got a lot of rentals.

10:03:01 The numbers that you just repeated to us, you know, 11 that

10:03:05 you apartment units, and you mentioned, you think that

10:03:09 that's low.

10:03:10 Now, if you think that's low, that means that you know that

10:03:13 that you haven't inspected everybody.

10:03:16 And the number of duplexes and triplexes, obviously duplexes

10:03:20 are huge.

10:03:21 Eights human nudge.

10:03:22 And some of those may or may not be originally have been

10:03:26 approved for buildings.

10:03:29 That's one issue.

10:03:30 That's different than what you have to deal with.

10:03:32 But secondly, we need to really get a handle on the

10:03:34 information we are receiving, and use some other cross

10:03:38 reference information so that we can go out there and get

10:03:43 the folks that are abusing the system and make sure that

10:03:47 they are doing the right thing.

10:03:48 I think it's a problem that we have, that we may have too

10:03:52 much information without a way of essentially cleaning it up

10:03:54 and putting a process together.

10:03:56 Because sometimes having a lot of information doesn't really

10:03:59 help us unless we get a process and really go after what

10:04:02 that information actually means.

10:04:03 So please make sure you tell us the tools you need in order

10:04:07 to straighten that up, if there are any tools, and then

10:04:10 secondly, try and give us a good idea of what it is now, if

10:04:14 you don't mind.

10:04:22 they are on the register, how often do we go and inspect,

10:04:25 that type of thing.

10:04:26 >> As I mentioned before, the rental program is on our

10:04:33 priority for this year to look at it, to approve it, to

10:04:36 address the overall deficiencies and to improve the entire

10:04:42 overall system, because they have not been addressed in

10:04:47 quite a few years.

10:04:48 And again, the rental properties actually increased, and it

10:04:53 has caused some serious issues in the City of Tampa.

10:04:57 Right now rental properties are exploding.

10:04:59 More people are going into rentals, with purchasing.

10:05:02 Because of that, and because of what happened with the

10:05:06 downturn and the economic collapse, you know, a lot of homes

10:05:54 So we are jumping around a little bit.

10:05:56 But part 5 was regarding the effectiveness or ability to

10:06:04 issue civil citations to the property owner.

10:06:10 This was back in December, I think it was.

10:06:12 We met with the greater Tampa association of realtors, and

10:06:16 the realtors were very interested in us making progress,

10:06:20 because it affects their ability to sell homes, or even

10:06:25 those that are engaged in the rental business to move their

10:06:31 product, their housing stock, because of some of the

10:06:35 problems that are in the neighborhoods, and they were very

10:06:38 interested in helping.

10:06:41 Have we made any progress on that?

10:06:44 >> We are in the process of implementing that right now.

10:06:48 I will be perfectly frank with you.

10:06:50 It's an administrative -- it takes a lot of admin work.

10:06:54 But we are implementing that.

10:06:56 And I didn't realize that I had to talk about that today on

10:06:59 that one.

10:07:01 But we are working toward that.

10:07:05 I agree that it is an effective tool, and in my

10:07:09 conversations with the realtors, they are also behind it.

10:07:40 issues on the enforcement side.

10:07:49 An update on the solid waste code enforcement implementation

10:07:55 The cross training in the five solid waste officers began on

10:07:59 October 3rd, 2013.

10:08:01 All five solid waste inspectors are prepared to issue civil

10:08:05 warnings and also civil citations for the following

10:08:09 violations.

10:08:10 Overgrowth.

10:08:11 Trash, accumulation debris.

10:08:13 And inoperative type of vehicles.

10:08:17 The overall training has continued once a week with code

10:08:20 enforcement to a sure that they are included in any updates

10:08:25 in our overall process.

10:08:28 The mayor signed the executive order last month, and we are

10:08:35 meeting with the solid waste supervisors to go operational

10:08:39 on the 15th of this month.

10:08:43 I'm excited about this.

10:08:44 This will give us five additional inspectors, and one

10:08:49 overall supervisor.

10:08:52 The enthusiasm has been great.

10:08:55 The partnership has been wonderful.

10:08:57 And I feel very, very confident that it will have an impact

10:09:01 on the City of Tampa.

10:09:03 It actually gives us five more folks in the field to address

10:09:08 the major overall issues in the City of Tampa.

10:09:10 And as we move actually forward with that, we will be

10:09:14 working then into other areas of code enforcement and zoning

10:09:18 issues, land use issues, building issues, things of that

10:09:23 nature, which we are responsible for the enforcement of.

10:11:25 and solid waste department to appear and provide a report

10:11:28 regarding the feasibility and cost, if any, of establishing

10:11:31 a training program for all city personnel pertaining to code

10:11:35 enforcement violations.

10:11:37 And I think I remember part of that discussion, and it was,

10:11:41 you know, we have a lot of people who are out on the street,

10:11:44 you know, as part of their everyday work, and it would be

10:11:50 helpful, especially because of the technology we have now,

10:11:53 even using our new, you know, application, whether you have

10:11:59 iPhone or android, if they are driving around making

10:12:02 something really blatant, they should be able to report that

10:12:06 themselves, and not always relying on the citizens or the

10:12:10 neighbors or somebody to report it.

10:12:12 We have got a lot of eyes on the street, so to speak, and if

10:12:17 there's a way that -- not maybe intensive training, but at

10:12:22 least some cursory training on how to report, or when to

10:12:27 report a violation or potential violation or hazardous

10:12:34 situation, then we can really increase -- at least maybe

10:12:42 we'll get more results from having more people be able to

10:12:49 proactively address it.

10:12:51 >>CHARLIE MIRANDA: In other words, what you are saying is

10:12:52 4,000 eyes are better than 4.

10:14:10 Just to be very precise for each item in particular, and we

10:14:15 spoke about this behind the scenes with each of you a little

10:14:18 bit.

10:14:18 Number one was looking at requiring leases submitted on an

10:14:21 annual basis when they are utilized for alternative parking.

10:14:25 The second part of that, it does say as suggested by Cathy

10:14:30 Coyle, I did suggest the first part and not the second,

10:14:33 related to granting waivers in the public hearing.

10:14:35 So just to be clear, it is our recommendation that right now

10:14:40 through the design exception process, which is the

10:14:43 administrative approval for the off-site parking, it's a

10:14:47 very fair process.

10:14:49 What you are proposing on our site, the usage on your site

10:14:55 has to be from the off-site parking lot by zoning.

10:14:59 The parking does have to function properly per code, and it

10:15:02 does have to be actually legally established and has to be

10:15:06 within a thousand feet.

10:15:07 There does have to be a lease with approval by city attorney

10:15:12 with certain terms, and it does run with the land as a

10:15:17 condition of whatever permit it is tied to.

10:15:20 So what's missing from that, what we are recommending on an

10:15:29 annual basis the person that has that off-site parking to

10:15:31 come in and resetter if I and file, and that parking is

10:15:36 still available to them.

10:15:38 It's basically like an annual recertification.

10:15:41 And the outcome of that would be if that does not happen, or

10:15:44 if they cannot certify that, then they would be put on

10:15:49 notice that they are potentially in violation of whatever

10:15:52 permit is that they had related to in most cases, or in some

10:15:57 cases, like with an alcohol special use comment.

10:16:04 Item number 2 is formalizing zones where multimodal mass

10:16:11 transit corridors, mass transit facilities are available,

10:16:14 made part of a staff report.

10:16:17 That's actually a fairly simple issue.

10:16:19 We wouldn't have to create or formalize anything additional.

10:16:23 There is already a general finding as part of the staff

10:16:25 report that we can simply put in there for City Council

10:16:29 whether or not it is a transit corridor, already adopted in

10:16:31 the comp plan.

10:16:33 The bus route it happens to be on, whether or not it's part

10:16:36 of a CRA, there's already the formalized zones identified in

10:16:40 the comp plan, and carried out through our code so we can

10:16:43 simply identify them for you.

10:16:45 Whether or not there are changes available.

10:16:47 The third item deals with the alternative parking

10:16:51 arrangement for a thousand feet or over a thousand fate.

10:16:54 And then the situation where it's over a thousand, we look

10:16:59 at contracts, and in tandem.

10:17:08 My recommendation -- and I believe I mentioned this to each

10:17:12 of you -- is to treat the thousand feet to 1320 which is

10:17:15 actually a quarter mile which is the acceptable distance.

10:17:22 1320 would be the number, and when you are beyond that 1320

10:17:27 feet, that we do require the valet, and we are also

10:17:31 suggesting that for valet parking, not just the annual

10:17:35 recertification of those contracts, be filed back, but those

10:17:41 valet companies actually operate for the city, and we could

10:17:47 talk about that in more length.

10:17:49 And we talked about this for a lot of different things

10:17:51 because then we are dealing with the operator as opposed to

10:17:53 the property owner.

10:17:55 And the fourth one is essentially having us look at other

10:17:59 areas, and what they do, whether or not anyone does it

10:18:03 differently, or has something unique.

10:18:06 Ms. Kert did go through in a cursory manner a lot of

10:18:10 different places around the state, and even some outside of

10:18:12 the state, just looking for valet regulations, off-site

10:18:15 parking regulations, and just as a mixed bag, everybody does

10:18:20 it a little differently.

10:18:22 But the common themes and the places that you allow off-site

10:18:27 parking, regulate valet, in most cases it's either smaller

10:18:33 towns or in certain districts or along certain corridors.

10:18:36 Many of the places do allow 100-foot in front of the parking

10:18:39 to be valet, or depending on the use.

10:18:45 The distance is there from 300 feet to half a mile.

10:18:54 And the common theme between all of them is there is some

10:18:58 type of contract or certification or something for these

10:19:01 companies that actually has to continue to be, so there's

10:19:08 some type of filing or some type of licensing.

10:19:10 So in general there's the three things that it boils down to

10:19:14 for that question, if we do allow the valet to be used,

10:19:19 what's the distance?

10:19:20 And that's what I would recommend beyond the 1320.

10:19:26 What percentage would be allowed to be provided in valet

10:19:29 parking?

10:19:30 And like I said, many of these locations are 100.

10:19:38 Actually all of it on-site.

10:19:40 The percentage is something we should talk about definitely.

10:19:42 But if they do have it, particularly if they have an annual

10:19:49 recertification, then I think it's something we should

10:19:51 consider at a higher percentage.

10:19:53 >>MIKE SUAREZ: I have a question.

10:19:55 And I want to make sure I got this in my head.

10:19:57 You just mentioned that had you recommend that we increase

10:20:00 it to 1320 in order to -- and anything more than that, that

10:20:08 it be valet?

10:20:10 >> If you are beyond that, and you want to have it be

10:20:13 considered as part of your required parking, then it would

10:20:16 have to be valet.

10:20:17 You are not forcing someone to walk more than a quarter

10:20:19 mail.

10:20:22 >> I just wanted to get that straight.

10:20:24 And that's why when you brought up the additional feet, I

10:20:28 wasn't sure where you were going with that.

10:20:31 So I just want to make sure it's clear in my head.

10:20:36 The emphasis is always going to be on, as you mentioned,

10:20:40 on-site parking, in addition to adjacent parking that's as

10:20:43 close as possible.

10:20:45 And that's non-valet.

10:20:46 However, I mean, there's a lot of facilities that use valet

10:20:50 even within the spacing, because there's not enough spaces

10:20:55 to go around.

10:20:55 So they squeeze in more, meaning that the valet may be only

10:21:00 a few feet away from the entrance, but yet they still use

10:21:05 valet.

10:21:05 The valet is not a requirement one way or the other.

10:21:10 Only beyond that, that we actually ask the consideration.

10:21:16 >> And I will get to the valet piece of it.

10:21:19 >>MIKE SUAREZ: I just wanted to get that.

10:21:27 >>CATHERINE COYLE: And there's actually some pending rules

10:21:28 that we are working on internally with transportation and

10:21:30 legal on valet in particular, because they use public

10:21:35 rights-of-way.

10:21:38 straight.

10:21:39 >> No problem.

10:21:41 Then the last consideration for valet is in the context of

10:21:44 them using valet for on-site, to meet the required on-site

10:21:48 parking, is that we allow them to be double counted, do we

10:21:52 allow them to share that lot, or do we make them whole, do

10:22:00 we make each use come in and add current number of spaces?

10:22:04 And if there's only 100 spaces on the lot and it's four

10:22:08 users that want to use them but the total they need is 120,

10:22:11 do we allow that to be shared or do we have to make each one

10:22:14 whole?

10:22:14 Our code makes people be whole, unless you share by hour.

10:22:22 >>LISA MONTELIONE: We already know our code doesn't work.

10:22:34 So I would say that to make it whole, or keep it the way it

10:22:39 is, and keep it whole, and not allow the sharing, would

10:22:44 continue to make our code not work.

10:22:50 We wouldn't have so many complaints, not only from the

10:22:54 neighborhoods but from the businesses themselves if it did

10:22:56 work.

10:22:57 So what we are here trying to do is create something that's

10:23:00 better than what we have now, and I think that the valet

10:23:06 companies we heard from in a previous workshop or staff

10:23:09 report, time, we heard from some of the valet companies.

10:23:12 It may have been during the quasi-judicial hearing, which I

10:23:15 think it was, and they are professionals at what they do.

10:23:20 They know how to utilize those lots for the best of their

10:23:24 ability, and the situation, especially concentrated in the

10:23:31 SoHo area, you know, folks park their car, and then visit

10:23:35 three or four different establishments.

10:23:37 So each of those establishments, then that one car would

10:23:40 technically be shared, because they are not valeting their

10:23:45 cars only to one establishment and then driving to another

10:23:47 establishment and valeting their car again.

10:23:50 They are valeting their car once with one establishment and

10:23:53 then visiting three or four others.

10:23:55 They may have, you know, dinner at chiefs and then go

10:24:00 somewhere else to have drinks or, you know.

10:24:04 So requiring each of them to have, you know, one lot

10:24:09 dedicated, or number of spaces dedicated would be

10:24:13 ineffectual.

10:24:14 So the recommendations that I would have for the off-site

10:24:19 valet lot, and we can talk about the tandem parking lots

10:24:23 around, and we did this for downtown, is if you do have a

10:24:25 lot, and if you have an attended lot, even the valet

10:24:33 situation, where it's a lot that cars are being put by

10:24:36 attendants, that we do park in tandem because you have

10:24:41 someone that can move the cars around.

10:24:43 If a lot that you are parking yourself, then we don't allow

10:24:47 you to traditionally park tandem because you can't move the

10:24:50 cars behind you.

10:24:51 So that was the recommendation I made the last time.

10:24:53 If it is a lot where there is someone that's actually

10:24:56 manning it or maneuvering the cars, that we allow them to

10:25:04 park in tandem, that would be allow them to place more cars

10:25:07 on the site.

10:25:08 So that's our recommendation there as well.

10:25:10 So I think with the regular monitoring certification of

10:25:15 these things, also, for the valet companies themselves, and

10:25:22 allowing them to park tandem would certainly allow them to

10:25:26 work in a better way.

10:25:28 Keep in mind the foundation of all of this is the fact that

10:25:32 we require parking and we have certain ratios in the code.

10:25:37 So that's really begs the question, if you say this doesn't

10:25:40 work, are the ratios right?

10:25:42 That's really -- a lot of complaints that you get from the

10:25:46 neighborhood, traditionally the ones that we enforce it on

10:25:50 are when lots pop up in residential areas on lots that they

10:25:54 shouldn't be a residential lot.

10:25:59 Those are several that we had to take through enforcement.

10:26:01 >>CHARLIE MIRANDA: And brief me, I think the majority of

10:26:03 time they do work.

10:26:04 The only question -- are you finished?

10:26:08 >>LISA MONTELIONE: Well, I have one other question.

10:26:12 I'm sure you received a copy of it.

10:26:15 Each one of us received copies of it.

10:26:18 A January 6th, 2014 letter from Mark Bentley, and he

10:26:24 laid out some suggestions --

10:26:29 >> I had an opportunity to look at it yesterday.

10:26:33 >> So he being somebody who represents a lot of business

10:26:37 owners who deal with the application to the city and trying

10:26:41 to assist in finding a common space between what we have

10:26:49 now, and what we might consider.

10:26:53 I would ask that the recommendations that he made be

10:26:57 carefully reviewed, and perhaps there are some of the things

10:27:03 that he's saying in here that we could incorporate into

10:27:07 whatever changes we contemplate because there were quite a

10:27:12 few things here that to me make sense.

10:27:14 And, you know, I do want to get to a place where during a

10:27:22 rezoning hearing or during a special use application, we are

10:27:26 not having to rehash this subject sometimes three or four

10:27:32 times in the same night.

10:27:33 So it would behoove us to have some standardized process.

10:27:41 And he's proposing an alternative parking program which

10:27:46 would be a separate permit for businesses operating in the

10:27:49 SoHo area.

10:27:51 For their parking needs.

10:27:52 So I think if we had some kind of steady, regular process,

10:28:00 we wouldn't be tacked with making decisions --

10:28:04 >> Actually, we do have a standard utilized everyday

10:28:11 process, or our design process is used -- every week we get

10:28:16 a new application.

10:28:16 People utilize it, the recalls that wave in our code, and

10:28:19 they have the leases, they have the uses that are properly

10:28:24 permitted, they have the spaces that are properly permitted.

10:28:27 Remember, the cases that come before you, if they are

10:28:30 saying --

10:28:32 >>LISA MONTELIONE: I understand that, Ms. Coyle.

10:28:37 Not only from the public.

10:28:38 And it's not just the public, the citizens in the cases you

10:28:43 explained, but it's people parking in front of their, you

10:28:45 know, their houses, and on the side streets, and maybe

10:28:50 pulling up on the right-of-way in front of their house and

10:28:53 blocking the right-of-way.

10:28:55 There are a myriad of complaints that we get from the public

10:29:01 who come here even speak during public comment or during the

10:29:04 regular session or show up, or send e-mails, or make phone

10:29:08 calls to us when a particular rezoning or special use

10:29:12 application is happening.

10:29:13 So we can't neatly put those complaints in one box.

10:29:18 They run the gamut from what we hear.

10:29:20 And we hear it on a very regular basis and we hear it from

10:29:24 the business owners as well.

10:29:27 And I hear that a lot of our code -- and you are going

10:29:33 through systematically and trying to fix a lot of problems

10:29:36 in our code that has existed for maybe a century -- I'm

10:29:42 exaggerating, but a very, very long time, and I know that it

10:29:46 takes time for you with your staff to go through and make

10:29:49 these changes, and we are.

10:29:50 We are making headway.

10:29:52 We are getting better.

10:29:53 But there's still, I think, some work to be done.

10:29:57 And I would seriously consider the suggestions that he's

10:30:01 making here, and maybe just a pilot, maybe test it out for a

10:30:06 year or two and see how it works.

10:30:08 If the idea doesn't work, or some variation of his idea

10:30:13 doesn't work, then we can try something else or go back to

10:30:15 where we were.

10:31:34 traditionally these are used for commercial uses.

10:31:40 So they wouldn't be embedded in the neighborhood, unless the

10:31:43 neighborhood has commercial zoning.

10:31:45 >>CHARLIE MIRANDA: So let's say the lot is zoned properly

10:31:48 and everything is copacetic and is being done.

10:31:51 My only concern, not the attorneys or the representative of

10:31:53 the people who come here who ask for relief, because they

10:31:57 are trying to do the job and they are presenting the facts.

10:32:00 But if someone gets that lot assigned to that business, and

10:32:06 you and I have discussed this before, and that business, be

10:32:11 it whatever, loses that license, does that have an impact on

10:32:18 that original business license?

10:32:22 They got what they got because they had that alternative

10:32:24 parking.

10:32:25 But in being fair to all, they lose their turn at parking

10:32:33 for whatever reason.

10:32:34 Doesn't want anyone to develop or whatever.

10:32:40 Explain to us what happened then.

10:32:41 >> The parking that's put off, and that is considered as

10:32:46 part of your required parking, and that alternative, that

10:32:48 meets your requirement.

10:32:49 If you lose it, you no longer meet the requirement.

10:32:52 So you are subject to enforcement.

10:32:54 So if it's tied to an alcohol permit or another special use

10:32:58 permit, or some type of other permit that we have, then,

10:33:01 yes, you are technically potentially in violation.

10:33:04 And in the case of an alcohol case -- and that's why I want

10:33:07 that annual filing, that are still valid.

10:33:11 If you lose it, I am going to write you a letter and say it

10:33:15 appears that you are in violation of your alcohol permit.

10:33:24 come back and provide it within X number of days.

10:35:39 behalf the city of Tampa, Florida industrial development

10:35:42 revenue note, Lowry park zoo, 2014, which will finance the

10:35:49 acquisition, construction, renovation, and equipping of

10:35:54 veterinary hospitals, animal holding, commissary and science

10:36:01 center, quarantine holding, and the Florida interpretation

10:36:06 center, 1101 west Sligh Avenue, Tampa, Florida 33604, and as

10:36:15 Mr. Territo mentioned, the proceeds of the --

10:36:38 I think we have one of the greatest zoos around.

10:36:41 You can compare it with anywhere in the country.

10:36:43 And it's run by people who are so dedicated and so helpful

10:36:48 when you get there, and they talk to you.

10:36:51 And, in fact, people go there repeatedly.

10:36:56 And that's what makes it the success that it is.

10:36:58 They continue to go back.

10:37:00 And because they are treated well.

10:37:04 And does an outstanding there, and with very little public

10:37:11 input.

10:37:12 If I recall the numbers, 2 or 3%, and compared to other

10:37:18 zoos, they take 40, 50, 60% of public money.

10:37:21 And this zoo, it's financing and doing it on its own, and

10:37:25 sometimes, like anything else, it struggles, but you know

10:37:31 what?

10:37:31 They are very successful.

10:37:33 I thank all of the employees, the board members, I believe

10:37:39 council member Suarez is there, and some chairman appointed

10:37:42 him but I don't even like the chairman and he does a good

10:37:45 job, and I appreciate the job that Councilman Suarez does

10:37:48 there, and all the rest of them.

10:37:50 Yes, sir.

10:37:52 I think that you probably see that chair every morning.

10:37:56 But one thing that we need to remember is that it is a

10:37:59 public asset owned by the city.

10:38:00 It's one of the few things that we do that we own that we

10:38:05 don't have to put a lot of money into it.

10:38:10 As the previous zoo was a complete embarrassment to the

10:38:13 city, this zoo now, under the leadership of Mr. Pugh, is an

10:38:17 absolute gem and something that should be celebrated

10:38:21 throughout the city.

10:38:21 We were very lucky to have him.

10:38:23 We are very lucky to have the board members that are on that

10:38:26 zoo board, both the foundation side and on the trustee side,

10:38:30 and I will tell you it's a great pressure to serve on that

10:38:33 board.

10:38:33 I appreciate you pointing me to that board.

10:38:36 And always remember that our money, we tab very good care of

10:38:39 what we spend dollars on, and the zoo is very cognizant of

10:38:45 their relationship to us as a city, and they do not come to

10:38:48 the well very often to ask us for a whole lot of stuff.

10:38:51 This is something that is a very easy thing for us to do,

10:38:55 and I appreciate your help in doing this, and thank you,

10:38:57 chair,.

10:39:28 >> The maturity is a six-year final -- actually, it will be

10:39:38 amortized over a longer period of time.

10:39:40 I forget the exact amount.

10:39:42 But it's being done as a draw-down loan and they expect to

10:39:47 pay it as pledges are received.

10:40:02 >> This is not moneys the city is loaning.

10:40:05 They are actually getting it from a bank.

10:40:06 It's not our loan to them so they are not paying us back.

10:41:37 I had the opportunity to speak with actually all five of you

10:41:39 beforehand.

10:41:40 As you directed in your motion.

10:41:42 This is dealing with the alcohol regulations for downtown,

10:41:45 and looking at extreme lining some of those processes.

10:41:49 What I have given you when, what we had was a document

10:41:54 entitled January 6th, 2012, and on the second and third

10:41:58 pages were the current regulations in a matrix form, and I

10:42:02 had recommended on page 3 some of those minor modifications

10:42:06 for clean-up of the language, changing the term music to

10:42:10 sound, correcting the outline format.

10:42:13 We had A and B and it should be one and two.

10:42:17 Chapter 3 was mentioned for hours.

10:42:19 It's chapter 14 now, some basic clean-up items.

10:42:24 The recommendation that we had for some situations that we

10:42:30 have had downtown, others have come in and asked for a place

10:42:35 to have on-site consumption and package in each of the

10:42:39 business, but we didn't have the opportunity

10:42:40 administratively in downtown.

10:42:43 And when I highlighted to council was when we changed the

10:42:49 recalls it was literally a complete oversight on my part and

10:42:52 I won't even blame Mrs. Kert for it.

10:42:56 We obviously meant for uses downtown to be administrative

10:43:02 because we had the bars downtown put in administratively but

10:43:07 not other interesting uses.

10:43:09 So if you are a hair salon downtown and you want to sell

10:43:14 wine to your customer you can't unless you come to City

10:43:16 Council.

10:43:16 So with that being said, we were recommending just a

10:43:20 catch-all only downtown in the Channel District for general

10:43:24 and incidental sales.

10:43:25 And then I mentioned two criteria, the possibility, one was

10:43:29 the outdoor amplified sounds, stopping at 1:00, potentially,

10:43:33 which A lines itself with the regulations for downtown.

10:43:38 And the second criteria is the common one in every single

10:43:43 category that we have which is no sales allowed in the

10:43:46 parking or loading areas.

10:43:47 And I left enough space on the page if there are any other

10:43:50 conditions you wanted to mention or talk about or have any

10:43:54 questions on.

10:43:54 But I can include this in the January cycle because it's

10:43:57 before the deadline, and to move forward with it.

10:44:01 Just for the record, the people that are listening, it's

10:44:04 solely downtown in the Channel District because I am focused

10:44:07 on that particular motion based on the motion of council,

10:44:11 this is not city-wide.

10:44:12 And the reason for the catch all for general sales, and

10:44:15 that's why I included the definitions on page 2, the only

10:44:19 establishment that we have for alcohol is a bar or lounge.

10:44:27 50% or less.

10:44:28 And thinking of going through trying to define every single

10:44:32 possible use that has alcohol would be a nightmare.

10:44:37 So it seems the most logical catch-all.

10:46:39 the general incidental sales in both Channelside and in the

10:46:44 central business district.

10:46:50 And there is a central business district code that allows

10:46:54 administrative approval of bars and lounges and so on?

10:46:59 >> Yes. 2010 that was the only specific area that council

10:47:04 and the public are comfortable as far as administratively.

10:47:08 >>LISA MONTELIONE: And we would not want to offer

10:47:15 Channelside?

10:47:15 We are hoping what Channelside is or becomes, encouraging

10:47:22 and making it less cumbersome, and Channelside would be

10:47:29 where I want to go, because we want that area to develop and

10:47:31 grow and prosper, and -- the.

10:47:41 >>CATHERINE COYLE: It's a policy decision.

10:47:42 The only thing I would recommend, if it has locations that

10:47:49 are brought up our there is some other use than alcohol --

10:47:52 >> It was brought to my attention by a business owner that

10:47:55 had to come to us and didn't know why this had to come to

10:47:58 us.

10:47:58 >> Right.

10:48:00 But as far as allowing a bar administratively in the Channel

10:48:02 District, as an extension of downtown, it's a policy

10:48:07 decision by council.

10:48:08 >>LISA MONTELIONE: I would like to see that change.

10:48:12 I guess we'll see some of the others.

10:48:15 Channelside has this distinctive character from downtown,

10:48:21 but when people who are in the outer reaches of the city or

10:48:27 in the county or in Pinellas, they maybe don't see the

10:48:29 difference between Channelside and downtown because of the

10:48:33 activity of the two.

10:48:34 >> The only thing I would add it is a smaller area and does

10:48:38 have a higher concentration of residential units in the

10:48:40 area.

10:48:40 So general incidental sales is probably a little more

10:48:44 customary to retail components.

10:48:49 I guess in the context of having a bar on every block, it's

10:48:56 really a policy decision.

10:48:57 >>LISA MONTELIONE: Okay.

10:49:00 And number 5, you and I had talked about this as well, in

10:49:04 the modifications, that I would like to see -- and I guess

10:49:11 we have separate motions.

10:49:12 I would make a separate motion for this.

10:49:14 That the hours of operation and the outdoor amplified music

10:49:23 be tied together, because the hours of operation, you have

10:49:26 currently is limited 11 to 1 a.m., would be outdoor

10:49:33 amplified sounds, which you change from music to sounds,

10:49:37 would be till 11.

10:49:39 I would like to make a motion to align those two for

10:49:42 consistency and we don't have two different standards, that

10:49:45 you can be open till 1 but you have to stop playing music at

10:49:48 11 outside.

10:49:51 It would be confusing to enforce, I would assume.

10:49:54 And the other is that when we talked about it -- and I think

10:50:00 there's only a couple of places in the city where really

10:50:02 this would apply.

10:50:05 My district of New Tampa being one, we used the example when

10:50:08 we met of be a Chili's located on Bruce B. Downs, and behind

10:50:18 the Chili's is a Home Depot.

10:50:21 There is no residential anywhere close by, by any stretch of

10:50:24 the imagination, is all commercial, and I think that that

10:50:32 provision for outdoor amplified music shouldn't apply when

10:50:39 you are in a setting like we have in International Plaza,

10:50:44 one of the places that you brought up, where it's a

10:50:46 commercial development, it is all commercial development,

10:50:49 it's upwards of so many thousands square feet, the number

10:50:53 that you and I came up with was 10,000 square feet,

10:50:56 multi-tenant, on a commercial roadway such as an arterial

10:51:01 roadway, where there's in a reason why we should prohibit

10:51:06 outdoor amplified sound at a place like that, because, I

10:51:10 mean, there's nothing around that or no residential around

10:51:17 that center that would cause, you know, anybody discontent.

10:51:22 So I would like to see that if maybe you can explain more

10:51:27 eloquently than I do.

10:51:28 >> Just to clarify, we did discuss it.

10:51:31 And what I mentioned, too, was, my concern on doing it was

10:51:37 obviously even in new Tampa where you have the large

10:51:40 commercial parcels, there are some pockets where there are

10:51:44 apartments, or subdivisions behind it.

10:51:47 I didn't want to embed in the administrative process a

10:51:51 distance separation for sound, exemptions to sound, or

10:51:55 distance of any kind, because the S-1 process, too, and of

10:52:02 the costs less as well.

10:52:03 So having the distance separation requires additional work

10:52:08 for the surveyor to do and additional requirements for

10:52:10 review, which can be costly, which we have heard over time

10:52:14 how much that costs.

10:52:15 So in listening to what you talked about, I mentioned

10:52:22 convenience, retail, if you are log at something like that,

10:52:27 trying to define it, but you want it to be all commercial,

10:52:30 multi-tenant, bigger event, a Walgreens or something, large

10:52:36 commercial --

10:52:38 >> And that development.

10:52:41 >> On an arterial roadway, not just a cross street, that you

10:52:44 are going to puck up collectors like MacDill, talking

10:52:48 arterial, you are talking Hillsborough.

10:52:50 The big part of Dale Mabry, Dr. Martin Luther King, Bruce B.

10:52:55 Downs.

10:52:56 >> Yes, 8-lane roadway.

10:52:58 >> The only way to be do it is that it's not adjacent to be

10:53:01 a residential zoning district specifics.

10:53:07 But that's -- as I mentioned, there has to be a consensus

10:53:18 the criteria and thinking about some of the -- some of the

10:53:23 requests or the discussions that we have been having.

10:53:29 We have been having a lot of meetings up in New Tampa, and,

10:53:33 you know, one of the things that residents say is missing is

10:53:37 that, you know, type of wine bars, venue where you can go

10:53:42 and sit outside, and listen to music, and enjoy the

10:53:48 beautiful weather we have here that are they don't have in

10:53:49 the rest of the country.

10:53:52 >>LISA MONTELIONE: Yes, some of them restaurants, yes.

10:53:55 >> So we discussed as a special restaurant requirement.

10:53:59 You could literally say Bruce B. Downs.

10:54:35 because of that unique pattern, I would prefer to keep to

11:10:30 On the list of criteria for the specific special use, you

11:10:43 There is an existing nonconforming structure in the rear

11:10:48 that is being converted for the extended family residence

11:10:57 The structure is at a zero setback on the rear, and a 1.6

11:11:03 setback on the western side.

11:11:06 The code requires a 3-foot setback.

11:11:09 You look closely at that drawing, you will see that the

11:11:12 structure does encroach into the public right-of-way -- of

11:11:16 the alley.

11:11:17 The applicant has gone through the process to get approval

11:11:20 from the city for the encroachment of that structure.

11:11:25 We have no objection at that point going forward with

11:11:30 council considering the waivers to allow for that structure

11:11:33 being used for the extended family residence.

11:11:36 That is the one criteria that the applicant is needing

11:11:38 relief on.

11:11:40 Otherwise, the structure will be housing for his

11:11:48 mother-in-law.

11:11:48 I also wanted to point out in the submittal to you, I did

11:11:54 receive a number of letters in objection and in support of

11:12:00 the applicant.

11:12:01 Some of the letters indicated that the property was -- I

11:12:09 wanted council to be aware that he did submit comments to

11:12:13 convert the structure to a single-family residence, which

11:12:17 the code requires as an extended family residence,

11:12:20 supporting single-family dwelling use.

11:12:23 So staff has in objection with them going forward in that

11:12:31 regard.

11:13:26 I live in this neighborhood.

11:13:27 I work in this neighborhood.

11:13:31 I'm a teacher at Blake high school.

11:13:32 My wife is a social worker.

11:13:46 You I'm invested in the neighborhood and I was blessed a

11:13:49 couple of years ago, because of the whole economic situation

11:13:56 the house basically, the cost of the home dropped almost 50%

11:13:59 and that's the only way I was able to afford that on a

11:14:01 teacher's salary.

11:14:03 I had an unused garage that it just seemed like a good idea

11:14:11 to fix it up and my mother-in-law oh could stay there.

11:14:13 I do admit we started this process unusually without

11:14:17 obtaining a permit.

11:14:18 This is my first home.

11:14:19 For the past six months been working with the city, and

11:14:22 filing the paperwork to get it resolved.

11:14:27 Really, my heart is to provide space for her.

11:14:34 This is my home.

11:14:35 The community is my home.

11:14:36 I have no intentions to be a neglect owner or this is not a

11:14:41 boarding home.

11:14:43 So with your permission I would like to continue to move

11:14:45 forward with that project.

11:14:54 Let me get some clarification from you.

11:14:57 Because I know I received quite a few e-mails from people

11:15:02 who live in that community.

11:15:06 Prior to you coming before us, have you had a chance to meet

11:15:10 with the representatives of that community?

11:15:17 >> I had to send out the general notice, and then I sent a

11:15:22 notice to the neighborhood association.

11:15:25 To my knowledge, until yesterday I was not aware that anyone

11:15:30 had any objections.

11:15:31 I received a call at 4:00 yesterday alerting me to this.

11:15:38 My neighbor is the previous neighborhood association

11:15:42 president, and so she was not aware there was an issue

11:15:47 either.

11:15:47 She actually wrote a letter in support of this project.

11:15:49 She owns the property next to me and behind me.

11:15:53 And so I'm not quite sure where or why opposition has come

11:16:00 up.

11:16:01 But all the people that live and know me, you know, support

11:16:06 and I have some supporting letters here.

11:16:08 And the objections that were raised, I'm not sure if you had

11:16:13 a chance to read my letter just trying to clarify some of

11:16:15 the misconceptions.

11:16:17 But Mrs. Bailey, I feel, doesn't know the facts of the case

11:16:22 nor does she know me.

11:16:23 And I really wish that she would -- actually went to the

11:16:28 neighborhood association meeting yesterday, once I was aware

11:16:32 of the objection, but she wouldn't even considering

11:16:34 listening.

11:16:35 She would object to it.

11:16:37 And so I had --

11:16:39 >> That's the reason I raise the question, is because the

11:16:42 e-mail that I received is from Mrs. Bailey, and she has an

11:16:50 allegation that she made that you started construction prior

11:16:55 to seeking the proper permit.

11:16:57 >> Yes, sir.

11:16:58 When we first started the project, we did not have any -- so

11:17:07 that was brought to our attention in June.

11:17:09 We have been trying to follow procedures to take care of

11:17:12 that and resolve that process.

11:17:13 And we initially, I went down to go and get a permit, and

11:17:18 then all of a sudden I was made aware that you have a

11:17:20 structure that's encroaching.

11:17:22 I said, what do you mean?

11:17:23 You know, I was buying a home.

11:17:28 I wasn't really -- I was excited.

11:17:33 And I wasn't aware this was an issue when I bought the home.

11:17:36 In the past, trying to figure out what to do, we thought

11:17:39 about vacating the alley.

11:17:41 That was not feasible.

11:17:42 Then I guess we went with the encroachment application.

11:17:46 And so that's really what happened.

11:17:50 But since we were made aware that you could not do the work,

11:17:54 we have stopped, and we have done everything that's been

11:17:56 asked of us up to this point to be comply with what the city

11:18:00 wants as far as fees and everything else.

11:18:03 >>FRANK REDDICK: Let me ask you this final question.

11:18:07 You mentioned that the previous president.

11:18:12 >> Say it one more time?

11:18:14 >>FRANK REDDICK: The previous president of the neighborhood

11:18:16 association has property next door to where you currently

11:18:19 are buying this property.

11:18:25 How many?

11:18:26 Is it one person or more than one person that will be living

11:18:28 in this property?

11:18:32 >> My family lives there, sir.

11:18:35 And the home is 3500 square feet.

11:18:41 I have a wife and a son.

11:18:44 And I have people with me who I would consider family.

11:18:49 For me family goes beyond blood.

11:18:52 I didn't see my mother until I was 16 years old.

11:18:54 So just because you are blood, I feel like family goes a

11:18:58 little longer than that.

11:18:59 These are people I trust.

11:19:00 These are God parents to my kids.

11:19:02 These are people that we share life together.

11:19:04 And because of circumstances, I have a home, and I have been

11:19:06 able to provide that space for them in the meantime.

11:19:12 But in the meantime, you know, I can provide something quiet

11:19:18 for my mother-in-law.

11:19:19 >>FRANK REDDICK: And in conclusion, let me just say, vacant

11:19:26 properties, properties that are in that neighborhood, and if

11:19:29 someone like you is willing to invest and raise your family,

11:19:33 and you are a professional person, you say you teach at

11:19:36 Blake?

11:20:33 father, with your waive, you ought to be good citizens for

11:32:26 As a practical matter many times when the City of Tampa is

11:32:28 called upon to provide either translation, which is the

11:32:32 written interpretation, or interpretation of the oral

11:32:35 interpretation services for folks, it happens in many ways.

11:32:39 It happens for example when a citizen calls in, and to be

11:32:43 speak with a staff member in the department and there's

11:32:45 difficulty communicating.

11:32:46 It happens sometimes in public meetings.

11:32:48 While you ask specifically about quasi-judicial proceedings,

11:32:52 the approach that the city takes to all of those is the same

11:32:55 when they have notice beforehand.

11:32:57 And what we generally do is when we are notified, which

11:33:00 often comes through the clerk's office or through a

11:33:03 department directly, then a staff member will contact human

11:33:07 resources, they will consult with the language bank which is

11:33:11 basically a list of city employees, and their capacities

11:33:14 where languages are concerned.

11:33:16 We get that information from the employees directly when

11:33:19 they are hired, and also through our know your roll survey

11:33:23 completed on an annual basis of all employees.

11:33:26 Then our HR department tries to match up and employee with

11:33:29 the necessary skills to serve as the interpreter for the

11:33:32 particular proceeding or communication that needs to take

11:33:35 place.

11:33:37 In general that works very well, and we believe than is in

11:33:40 compliance with the applicable and relevant laws.

11:33:47 The challenge is where we don't have that notice, where

11:33:49 someone shows up for communication and in a us --

11:33:52 quasi-judicial proceedings, when someone comes that has some

11:33:55 trouble communicating.

11:33:56 >>LISA MONTELIONE: I had asked for this because we have had

11:34:04 several -- and Mr. Miranda can be attest because he's the

11:34:06 one that's been serving as translator -- hearings over the

11:34:10 past year where E the individual cannot speak English, or

11:34:16 the English is so limited that it's the shaking of the head

11:34:23 yes or no type of situation.

11:34:24 And notice beforehand confuses me.

11:34:28 Because if they are here before us during a hearing, they

11:34:31 have gone through a lot of meetings with staff before they

11:34:35 get here.

11:34:36 So apparently there's some miscommunication or there's a

11:34:41 direction that's not being given to staff to provide, or to

11:34:47 make sure that that provision is provided for when they get

11:34:50 to the hearing.

11:34:51 Because maybe the staff member they are meeting with speaks

11:34:53 that language.

11:34:56 And it doesn't occur to them that this might be an issue

11:34:59 when they show up for the hearing.

11:35:00 >> It's entirely possible that that is exactly what's going

11:35:03 on, because I do think in many instances we do have staff

11:35:06 who are able to communicate, and it is not a function of

11:35:12 notice being given beforehand.

11:35:13 >>LISA MONTELIONE: I understand, but maybe there's some

11:35:16 policy that needs to be put in place, or maybe some

11:35:19 additional, you know, training or orientation that needs to

11:35:23 be, or orientation and HR that needs to be added.

11:35:28 If you are dealing with someone who English is not their

11:35:31 first language, and they are in be a process that will take

11:35:35 them before -- whether it's variance review board, the ARC,

11:35:42 any process, hearing process, then you must alert the city

11:35:51 clerk, or you have to help this person beyond them sitting

11:35:57 across --

11:35:59 >> No, that makes a lot of sense actually.

11:36:01 And in fact what I was going to recommend to you from the

11:36:03 legal department today is that we work in conjunction with

11:36:05 administration to develop a policy specifically geared

11:36:08 toward making sure that we are following both the law and

11:36:11 through best practices.

11:36:14 >>LISA MONTELIONE: That's what I am trying to get at.

11:36:16 And perhaps maybe you can find out the possibility of

11:36:19 establishing a training session for those who will be

11:36:25 serving as interpreters, because it is a special skill, and

11:36:30 especially during a quasi-judicial hearing, you want to make

11:36:34 sure that that person's thoughts and desires are properly

11:36:38 communicated.

11:36:39 >> You certainly do.

11:36:40 The way that's generally handled, and it's a good point that

11:36:43 you raise, qualifications of interpreters that have long

11:36:46 been an issue both in state courts and federal courts.

11:36:49 There are different laws that be a reply depending on the

11:36:52 type of proceedings.

11:36:54 The way that it's generally handled from a legal perspective

11:36:57 is to ensure that any interpreter is sworn, that they will

11:37:02 be translating correctly and to the best of their ability.

11:37:05 It's not -- it's not to necessarily fully resolve all the

11:37:08 issues that can occur, but that is the legal requirement

11:37:10 that addresses that.

11:37:11 And then there are specific requirements with regard to the

11:37:14 ADA, for example, there is state statute and Federal statute

11:37:17 that speak to when you are dealing with sign language, there

11:37:21 are very specific certification requirements they have to

11:37:23 have.

11:37:29 We have seen that recently.

11:37:30 And this would also incorporate limited English proficiency

11:37:35 as well.

11:37:35 So my ultimate recommendation is going to be that the legal

11:37:38 department work with our administration to develop a policy

11:37:41 specific to quasi-judicial proceedings so that we know, for

11:37:45 example, the answers to those questions, what happens when

11:37:47 someone shows up, and we do not have an interpreter readily

11:37:52 available, because one of the things that we do now, for

11:37:54 example, it is not a best practice sitting on a board to

11:37:58 serve as the translator.

11:38:00 And we would like to be able to figure out how to have a

11:38:05 consistent policy that we use not just before council but in

11:38:08 all of our quasi-judicial proceedings in the city.

11:38:10 I think we are already doing it in the practical matter,

11:38:13 just improve that process.

11:38:34 Here is the question that I have.

11:38:37 And this literally was a conversation I had with an attorney

11:38:41 many years ago.

11:38:42 He was representing a client who was sold an insurance

11:38:49 product that he did not understand it.

11:38:51 And the interpreter was someone who was either in the

11:38:53 household or a neighbor who did not understand the terms

11:38:56 that were being provided to them in English, to then

11:38:59 translate into Spanish.

11:39:01 Here is the problem that we have.

11:39:02 And this is across not only the city but across all kind of

11:39:09 disciplines, which is the idea.

11:39:11 And you made a comment about HR has a language bank.

11:39:14 Okay.

11:39:14 Now, if I have an HR employee that is not trained, and some

11:39:22 of the legalese that is dealt with in quasi-judicial, okay,

11:39:26 we open ourselves up to a misinterpretation and a problem if

11:39:31 they do not understand, to explain it to them in Spanish.

11:39:35 God knows, I know that Mrs. Kert and some of the other

11:39:37 people that are before us concerning zoning issues,

11:39:40 sometimes I don't understand the English that they are

11:39:42 speaking.

11:39:43 Let alone trying to translate that.

11:39:45 So I think that we have a real -- a much bigger issue.

11:39:49 I don't think it -- it doesn't stop here.

11:39:52 And Mrs. Montelione touched on it.

11:39:56 What's that process that we are dealing with, because knock

11:39:59 on wood, we have not been taken to task for any kind of

11:40:01 interpretive services we have been providing to people when

11:40:06 we go through these zoning hearings -- zoning process, but

11:40:11 there is that liability issue that is opened up because, you

11:40:15 know, if you have someone who is an attorney that is trained

11:40:20 but may not be as fluent in Spanish that they may think that

11:40:23 they are, and not able to explain to them in the kind of

11:40:27 legal terminology that's necessary by state law, we can

11:40:30 present a much more difficult question somewhere down the

11:40:37 line.

11:40:37 So the discussion is important for that reason and that

11:40:40 reason alone of the having interpretive services here

11:40:43 necessarily, I don't think it's absolutely necessary.

11:40:45 I think that the process definitely as you mentioned has to

11:40:47 be looked at.

11:40:49 I don't know if there's any court cases in the past to which

11:40:52 someone has said, I didn't understand what they said to me.

11:40:56 Okay.

11:40:57 And one more antidote that I present to you.

11:41:01 I had a client that has many Spanish speakers.

11:41:04 They sign off on a form saying that they have not had any

11:41:10 auto accidents, every weak, okay.

11:41:13 They interpret it as, this is how they have to receive their

11:41:17 check.

11:41:18 Okay?

11:41:19 And, you know, that's a miscommunication.

11:41:23 They don't know what they are signing most of the time

11:41:25 because they don't even red Spanish, yet alone English.

11:41:29 So part of the problem is how do you deal with a situation

11:41:31 that you want someone to assign a legal document that they

11:41:35 cannot either understand that is in writing, or a person not

11:41:42 interpreting exactly what it means.

11:41:44 So that's where I think we have a rale difficult situation.

11:41:49 I won't say a problem per se because I don't think we have

11:41:51 had any legal issues pertaining to it.

11:41:54 But it's something that we mate want to think about.

11:41:56 >> Yes, I think it's a good point, and I am not aware of

11:42:02 specific problems that we have had with this, but certainly

11:42:04 issues that all of you have raised, absolutely that get

11:42:08 raised on a regular basis where interpreters and translators

11:42:11 are concerned.

11:42:12 And there is a wealth of information.

11:42:15 And resources available to us to consult as we develop a

11:42:18 policy that can help us determine how top address these

11:42:21 consistently.

11:42:29 We have had other languages come before us.

11:42:31 But many Spanish speaking. Anyway, one of the things,

11:42:37 sometimes the people bring their person to interpret for

11:42:41 them, and I know that it is asked when anyone is going to

11:42:47 speak on a quasi-judicial to be sworn in.

11:42:50 But I think that when they bring someone to interpret for

11:42:54 them, specifically ask that person that they have been sworn

11:42:58 in, because they may not have -- or they may be asked at

11:43:05 that point to come up and interpret for them.

11:43:09 And we have had all contained of situations, and it's really

11:43:13 interesting, the interpretation and how people understand,

11:43:18 even in English, when someone speaks, what someone hears,

11:43:24 can be completely different.

11:43:25 So it may not be the language barrier at all.

11:43:27 It's what you bring -- what you bring to the situation.

11:43:37 But it is a very good -- I don't want to say problem, but

11:43:43 issue to bring up that we had before us, although I will say

11:43:48 our chairman has done a commendable job on interpreting.

11:43:53 Everyone stands up there and nods their head.

11:43:55 And I did speak Spanish.

11:43:58 So I do understand it.

11:44:08 And when they are nodding their head I did pretty much

11:44:10 understand.

11:44:13 And make sure that they understood.

11:44:19 >> When that has occurred, the issue there is certainly not

11:44:27 in this instance one of accuracy.

11:44:29 It is an issue because the interpreter becomes a witness

11:44:32 themselves.

11:44:32 And so if ware ever to be challenged later in the future,

11:44:37 that is what we don't want, Mr. Chair or anyone else, to

11:44:41 have to become a witness.

11:44:48 But in the beginning, how did it get here if they didn't

11:45:00 okayed it, who responsible to them, just initial it.

11:45:04 I know there's a language bank.

11:45:08 There were even city employees who spoke Russian and

11:45:12 And it's not just about two languages.

11:45:13 It's about many languages.

11:45:15 And I just want the process where it's changed, where

11:45:19 everything is legally.

11:45:25 So when they come here, they may not speak a language.

11:45:27 But if you put a $5 bill, 10, 50, 100, and they know the

11:45:32 difference between all of them.

11:45:33 So what I am trying to say, I don't want an actor being here

11:45:37 to just act.

11:45:38 And I'm talking about the petitioner, not the employee.

11:45:41 And I want it done right.

11:45:43 And if you have to go to court, there's nab doubt that that

11:45:47 person knew what they were doing, that there was somebody

11:45:49 there that signed off, and they interpreted for them.

11:45:52 And that's all I want.
