DETAILS:
About 3:57 AM, 10/27/09, Lt. J. Diaz observed the listed defendant, in actual physical control of a 2010 Chevrolet Impala. The defendant was sleeping in the vehicle, which was positioned in the middle of the intersection of Dale Mabry HW N/ Dr. ML King Bl. Lt Diaz made contact with the defendant, and had to wake him up. The defendant was the sole occupant of the vehicle. During contact with the defendant, Lt. Diaz noted clues of impairment consistent with consumption of alcoholic beverages and/or drugs. Lt. Diaz requested a DUI investigator respond to the scene.
MPO S. Cragg responded to the scene and made contact with the defendant, and noted clues of impairment including a distinct odor of an alcoholic beverage from the defendant's mouth, bloodshot/glassy eyes, and a noticeable sway upon standing unsupported. The defendant agreed to perform field sobriety exercises. During these, the defendant exhibited numerous clues of impairment.
The defendant was arrested for DUI, and transported to Central Breath Testing where he refused to provide a breath sample upon request. He was booked into the jail without incident.
The defendant is currently an offensive lineman for the Tampa Bay Buccaneers.
