13:03:06 We are here today on the second reading of Chapter
13:03:10 11-3 of our ordinances.
13:03:16 If you have any questions regarding the changes of the
13:03:18 actual ordinance that we provided you a couple of
13:03:21 weeks ago, please let us know and we'll answer
13:03:24 questions for you.
13:03:25 >>JOHN DINGFELDER: We didn't have a whole lot of
13:03:30 discussion on the first reading, and just to do a
13:03:34 background, we all try our best to get along with the
13:03:40 county, you know, in as many ways as possible.
13:03:43 So with that question -- or with that comment, I would
13:03:47 like to know what type of negotiations or mediation
13:03:52 that we have had with the county on this issue.
13:03:57 To try and come to perhaps a more peaceful resolution.

13:04:03 >> TOYIN HARGRETT: We don't have a representative
13:04:06 from the fire department per se with us today.
13:04:08 But, like I said, to my understanding, there have not
13:04:11 been any negotiations.
13:04:13 What happened was, when we were -- when the TSA met,
13:04:17 they had a vote, and that vote was to allow
13:04:21 Hillsborough County in.
13:04:21 That was their decision that they made at that time.
13:04:23 That vote was contingent upon the county making an
13:04:27 amendment to their chapter 6-09 which would in effect
13:04:31 remove the city's right of first refusal to provide
13:04:35 emergency services at Raymond James stadium.
13:04:38 On the than that, the discreet meeting, that incident,
13:04:43 haven't been negotiations.
13:04:46 I believe they have talked with the county to try to
13:04:48 arrange a meeting with the city, but that meeting has
13:04:51 not yet taken place.
13:04:55 >> I will support the ordinance.
13:05:00 I will support Tampa city firefighters.
13:05:03 However, this thing obviously looks like it could well
13:05:07 be headed to court.
13:05:10 And I think at some point, the average citizen might

13:05:13 scratch their head and say, why is the city and the
13:05:18 county going to court and spending time and money
13:05:20 litigating something that's perhaps not that important
13:05:23 to the average citizen?
13:05:24 So with that said, I know it's not just you, Toyin,
13:05:30 but with that said, I'll just urge the legal
13:05:33 department and the administration to do everything it
13:05:34 can to get to the table, to find a mediator and see if
13:05:38 there's some sort of negotiated compromise that could
13:05:40 be worked out.
13:05:43 >>CHARLIE MIRANDA: I am going to move the ordinance if
13:05:46 I can at this time, and I feel like Mr. Dingfelder
13:05:48 said, I think the least that we say in this hall this
13:05:51 morning in, this room, the better we are, because as
13:05:55 was said by Mr. Dingfelder, the probabilities of this
13:05:59 going to court are a little greater than not going to
13:06:02 court at this time.
13:06:03 And certainly actions by individuals, and honorable,
13:06:07 that sit on the Sports Authority, both jurisdictions,
13:06:10 city, county, an appointee from the governor's office.
13:06:15 This is not about turf war, in my opinion.
13:06:20 This is in the City of Tampa.

13:06:21 Like I stated earlier, the past week or so, if this
13:06:27 was to happen here, there's really no stopping the
13:06:32 feelings of the Port Authority, the Aviation Authority
13:06:34 possibly, and others.
13:06:35 And it's certainly an injustice if that happens.
13:06:39 I don't want to go after the county.
13:06:41 I have no desire to do that.
13:06:42 And I'm not looking for protectionism.
13:06:44 But what I'm looking for is that everything has
13:06:47 boundaries.
13:06:47 The City of Tampa has its own boundaries.
13:06:50 Guess what, Hillsborough County has got their own
13:06:52 boundaries.
13:06:53 Guess what, the State of Florida has got a boundary.
13:06:54 And when you look north and south, the United States
13:06:57 has a boundary with Canada and Mexico.
13:07:00 So when they say there shouldn't be any boundaries,
13:07:03 they better rewrite history. With that I would like
13:07:06 to move the ordinance.
13:07:07 I move an ordinance amending section 11-3 --
13:07:13 >>THOMAS SCOTT: Before you do that, Mr. Miranda, Let
13:07:14 me see if anyone from the public wanted to address

13:07:24 11-3 entitled applicability of the City of Tampa code
13:07:26 of ordinances by clarifying the jurisdiction of the
13:07:29 City of Tampa's fire rescue division relative to the
13:07:33 provision of stand-by medical service, providing for
13:07:35 severability, providing an effective date.
13:07:38 >>THOMAS SCOTT: It's been moved by councilman Miranda,
13:07:40 seconded by councilman Dingfelder.
13:07:42 All in favor -- that's right, need to call roll.
