Details:

On September 25, 2011, at 4:34 a.m., the two defendants approached the victims. Defendant Brooks pointed a silver pistol at the victim's and stated, "give us all of your money, everything you have." When the W/M victim told them he didn't have any money, he was struck on the head with the firearm. Defendant Brooks then grabbed the female victim (restricted) by the throat and pushed her to the ground. Once on the ground, Defendant Brooks sexually battered the victim. The defendants then ordered both victims to lay on the ground and fled the area in the victim's 2010 blue BMW, which had cell phones, an I-pad and other property inside.

At 5:45 a.m., a call was received by TPD Communications that a bullet was shot into an apartment wall (110 Broad St. E. C303) almost striking the homeowner. Officers responded and determined that the bullet came from Apt. D301, which is the adjoining apartment. Officers responded to D301 to continue the investigation. There they made contact with the subjects inside and the homeowner/witness advised that the gun was accidentally fired by her friend (defendant Brooks). The homeowner / witness then consented to a search of her Apt, at which time, Officers located the cell phones and other property stolen during the earlier robbery, including BMW keys. Officers also located a silver .380 Davis Industries semi-auto and a .45 Cobray one-shot Derringer. The victim's stolen vehicle was located in the parking lot of the Oaks of Riverview complex, at 110 E. Broad.

The victim's positively identified both defendants during a show-up. A witness provided information that the defendants were attempting to sell the stolen property and BMW they just got from a "lick." The defendants would not admit to the offenses. Both have significant criminal histories. Brooks was released from prison on June 11, 2011, after serving a 10-year sentence for armed robbery. Harrison has been in and out of the prison system several times. Harrison and Brooks are father and son.

Brooks was charged with Armed Carjacking, Armed Kidnapping, Armed Sexual Battery, Dealing in Stolen Property, Felon in Possession of a Firearm (X2), Culpable Negligence and False Name to LEO. Harrison was charged with Armed Carjacking and Dealing in Stolen Property.
