Suspect Arrested After Pointing Gun at Officer and Citizen

WHEN: January 12, 2011, 9:20 p.m.

WHERE: 10th Street North and Yukon Street East, Tampa

VICTIM #1: Treva Wilborn, B/F, 01/09/1993, 8517 North 15th Street, Apartment B., Tampa

VICTIM #2: Tim McGinnis, W/M, 28 year old Tampa Police Officer, hired 1/1/2010

SUSPECT: Steven Barone, W/M, 09/04/1981, 10122 Kenlake Drive, Riverview

CHARGES: Aggravated Assault on a Law Enforcement Officer, Battery, Aggravated Assault with a Deadly Weapon, Carrying a Concealed Firearm, Obstructing or Opposing an Officer with Violence, Possession of a Controlled Substance and Leaving the Scene of an Accident

DETAILS: The suspect was involved in a single car accident at I-275 and Busch Boulevard. He drove his 2005 black Ford Focus into the median on Busch Boulevard and blew out his front tire. A witness stopped and the suspect got out of his car, approached the victim’s car and asked for a ride. She said no and he began beating on her window calling her derogatory names. She called 911 and he took off on foot south. Officers were dispatched to the area and while Officer Tim McGinnis was searching for the suspect in the area of 10th Street North and Yukon Street East, he saw a woman (Treva Wilborn) waving at him for help. The suspect was standing with her. As the officer got out of his car and the suspect pointed a gun at Officer McGinnis. The officer pointed his gun at the suspect and the suspect took off on foot. Officer McGinnis chased the suspect; the suspect turned around several times and pointed his gun at the officer. As they approached the 8600 block of North 10th Street, the suspect threw his gun into the street and got down on the ground. He was arrested. After interviewing Treva Wilborn, she stated that the suspect, pushed her, pointed the gun at her and pulled back the lever. That is when she flagged down Officer McGinnis. Officers recovered the gun which was not loaded. It appears that the suspect was under the influence of drugs and or alcohol.

Officer Tim McGinnis is a midnight officer and is off today. He will not be available for interviews.
